WHEREAS , the Department of !abor and "mployment 'DOLE( is mandated to protect labor, promote full employment and ensure e4ual wor5 opportunity regardless of sex, race and creed' WHEREAS , the D !" through the &ureau of Rural 6or5ers 'BRW( and the D !"#Regional ffices 'DOLE-RO)( has developed the 7Unla* Ka+,-a.an P og a/ La+an )a Ka-i a0an8, briefly 5nown as Unla* Ka+,-a.an P og a/ which is intended to bring about improved socio#economic well#being of the poor self# employed wor5ers in the informal sector, termed as 9+ 6or5treps' WHEREAS, the :nlad ;abuhayan Program aims to ma5e the livelihood of the poor 9+#6or5treps grow into viable and sustainable businesses through the provision of four <=> ma?or pac5ages of services consisting of the following: a> training, b> business advisory, c> social protection, and d> networ5ing services' $ 6, T0"R"1 R", for and in consideration of the foregoing premises, the parties hereto agree to enter into this M A under the following terms and conditions:

I# DUTIES AND RESPONSIBILITIES OF PARTIES

"nsure that the funds released are used exclusively for the purposes provided for in the approved pro?ect proposal which shall form an integral part of this M A, F' Provide briefing to the PR P $"$T prior to issuance of the fund assistance to ensure that both the technical and administrative concerns relative to the pro?ect are ade4uately addressed, =' Provide technical assistance to the PR P $"$T whenever necessary or as may be re4uested, D' "nsure compliance with the provisions of this M A and of % A %ircular $o' .--*#-/, 6. Conduct regular inventory of the equipments procured by the PROPONENT to determine their physical condition *' Monitor and inspect the pro?ect implementation of the PR P $"$T on a 4uarterly basis, as well as verity financial records and report of the PR P $"$T, C' 9ssue an inspection report and certificate of pro?ect completion within thirty <F-> days from completion of the pro?ect, (' Aerify the validity of the documents supporting the 1inal 1und :tiliGation Report and the li4uidation report submitted by the proponent, /-' Demand the refund of unused funds after pro?ect completion and the refund of any disallowed amount after financial audit by the D !"#$%R andEor the %ommission on Audit, //' wn the e4uipment purchased by the PR P $"$T,

/.' 9nstitute appropriate actions against the PR P $"$T which fails to complete a pro?ect covered by this M A, or for a material violation of the provisions of the M A or of % A %ircular $o' .--*#-/ the costs of which shall be shouldered by the PR P $"$T'

&' The BARANGAY SUMILANG1 PASIG CITY# shall: /' 9mplement the individual livelihood pro?ects of C. beneficiaries based on its approved pro?ect proposal <Annex A> which forms an integral part of this Agreement to achieve the ob?ectives it is committing itself and in accordance with the approved standards, systems and procedures for pro?ect implementation, time schedule, as well as the approved pro?ect cost estimates included in Annex A, .' Provide e4uity of at least twenty percent <.-H> of the total pro?ect as approved by D !", which may be in the form of labor, land for pro?ect site, other facilities and e4uipments and the li5e to be used in the pro?ect, F' :tiliGe the amount received from D !"#$%R solely for the above#mentioned pro?ect, =' 9ssue fficial Receipt < R> for the funds received from D !"#$%R,

D' Procure the e4uipments necessary for the execution of the pro?ect' To ensured the best term and 4uality of purchase, the PR P $"$T shall do a canvass in coordination with D !"#$%R authoriGed officials,III )' Ac5nowledge receipt of the e4uipments procured by the fund assistance through the issuance of a Memorandum of Receipt,III *' :se the e4uipments ac4uired exclusively for the implementation of the approved pro?ect proposal, C' &e responsible for the proper storage and maintenance of the e4uipments, the cost of which shall be part of the PR P $"$T8s e4uity, <"nsure the proper storage and maintenance of the e4uipment> (' +ecure written approval from D !"#$%R for the transfer of any e4uipment from the pro?ect site to another location, /-' Return the e4uipment to the D !"#$%R when circumstances so re4uire' 9n case of loss, damage or deterioration, the PR P $"$T shall be liable for its sound value, //' +hall see5 prior written approval from the D !" in case any deviation shall be made in the pro?ect implementation, /.' Return any amount not utiliGed to complete the pro?ect including interest if any, immediately upon completion of the pro?ect unless a written authority is granted to use savings for other activities related to the pro?ect proposal and refund any disallowances upond demand of D !"#$%R, /F' 6ithin sixty <)-> days after the completion of the pro?ect, submit 1inal 1und :tiliGation Report certified by its Accountant and li4uidation report together with: a> inspection report and certificate of pro?ect completion issued by D !"#

II# IMPLEMENTATION OF THE PRO<ECT:

/' Pro?ect implementation shall commence within fifteen </D> wor5ing days upon receipt of the livelihood grant from D !"#$%R' The pro?ect should be completed within three <F> months from pro?ect commencement'

III# OWNERSHIP
/' The e4uipments procured, if any, shall be owned by the D !"#$%R, .' A Deed of Donation shall be executed by D !"#$%R in case it decides to give ownership of the e4uipments to the beneficiaries of the PR P $"$T'

I$# MODIFICATION4DE$IATIONS4AMENDMENT:
/' Any modificationEdeviationEamendment to this Agreement shall be sub?ect to the mutual consent of the parties hereto, .' 9n case of authoriGed deviations, the amount of financial assistance may be reduced in proportion to the pro?ected expenses reflected in the original proposal, F' Any unauthoriGed deviation whose cost exceeds /DH of the total approved budget shall be charged to the proponent without pre?udice to the pretermination of the M A, =' 9n case of unreasonable delay in the implementation of the pro?ect, a penalty of .H of the total unused funds per month shall be imposed'

$I# EFFECTI$ITY
This Agreement shall ta5e effect upon signing of the parties hereto and shall remain in force for the duration of the implementation of the pro?ect,
