The attached amendment does not contain any reference to the Administration costs which were in the 191,806 in Attachment B, Schedule A of the contract. The Independent Plan incorporates those costs into the per pound fee. Does this Amendment eliminate the Schedule A charges? Or is the 0.36/lb for the first 2 million pounds (put or pay) in addition to the $191,806?

Several of our clients assumed the new contract provided a rate comparison. Since our Schedule A administrative costs are shared in the per pound fee, I've informed the OEMs that this is not a direct comparison. It would appear that the 191,806, if covered under the first 2 million pounds, would add an additional $.096 to the per pound cost of the contract for Manufacturers in the Independent Plan (45.7 cents per pound). Have the Attachment B, Schedule A costs been removed in this amendment, or are they in additional to the Attachment B, Schedule B costs per pound?

We presume Attachment A, part d, requiring Casella to use R2 certified recyclers from the point of time a hard drive is managed remain in place, and that no non-certified recycler is handling hard drive containing materials who is not R2 or E-Steward certified, and no land application of CRT glass is allowed under the State of Vermont's contract with Casella Waste Systems.

As most of you are already fully aware, the Vermont program has an online registration process which allows you to make updates to the information contained in your registration by simply logging back into the system. Since you all have previously (re-)registered with the Vermont E-Cycles program, you all have also received confirmation emails which contain a link to the site, along with discrete credentials for logging back in to your registration form. If you no longer have access to that information, please contact me directly and I will resend it to you. The log in credentials, as well as the information contained in your registration, are confidential and will only be sent to you upon your direct request.

The Agency has received additional questions related to the State Plan, as well as requests for individual market shares. We are preparing the information, and will forward our responses to your requests as soon as possible.

Should you have any questions related to this email, please do not hesitate to contact me directly for assistance in order to ensure you receive accurate information related to this process.

The Agency is sending this email to those manufacturers and their authorized representatives that filed a notice of intent letter with the Agency on or before September 6, 2013, expressing an interest in the option to participate in an Opt-Out Plan. Please review the following information related to that Opt-Out Plan.

Independent Opt-Out Plan

The Agency has finalized its review of the manufacturer opt out plan prepared by Good Point Recycling; a copy of the plan is attached to this email for your convenience. Out Plan, and the contract for the state program implemented by Casella Waste Management. We encourage you to review these documents and contact the plan administrators or the Agency with any questions. If we receive any additional information from each of the respective plans, we will forward that documentation to you.

We expect the implementation date of the opt-out plan to be 12/1/13.

It will be necessary for those manufacturers that are interested in participating in the opt-out plan to reregister to select that option by December 1, 2013. If you have not updated your registration by this date, you will continue to participate in the state plan.

The Agency is finalizing market shares, and will provide the opt-out plan recycling goal once calculations are complete. If you are exempt for this program year (10/1/13 to 9/30/14)i.e., you sold less than 20 covered electronic devices to covered entities in Vermont during the period 10/1/11 to 9/30/12you have no obligations under the Vermont E-Cycles program.

Re-registration

If you elect to participate in the opt-out plan, you will be required to update your online registration by December 1, 2013. If you choose to continue to participate in the state plan, you do not need to do anything further with your registration.
