AFFIDAVIT
I, Name of person, 32-year old, single, Filipino and a Resident of _______________________________, after having been sworn to in accordance with law, do hereby depose and say the following to wit: 1. That I know personally the person of Name of person, whom we respectfully call Name of person, because he is our long time neighbor. I and some residents of __________ know him as a driver for hire usually for a contract known as Pakyaw or Padjak basis using his white Multi-cab. 2. That when his children left to Saudi Arabia or elsewhere for work, he was left alone in their house at ________________________ divorced from his wife. Being alone, he asked our favor to accompany him at his house especially during night time. Considering that he is like father to us, I and Name of person accompanied him and we sleep at his house during night time. I, Name of person and Name of person usually slept in the sala on portable foam. Sometimes I accompanied him to Zamboanga Port to fetch passenger/s for pakyaw/padjak basis when vessel from other places arrives. Because of this, I came to know some port drivers like him and one of them is Name of person known as Name of person; 3. That last July 11, 2013, in the observance of the month of Ramadan, we woke up at around 3:00 oclock in the morning to prepare and eat our morning dinner known as Sahul. Thereafter, we attended a morning prayer Subo in a congregation at________mosque. At about 5:00 in the morning, we went back to his house to sleep; 4. That while we were sleeping, I awakened by the noise on the gate. I heard somebody knocking on the gate, and I also heard a voice of a male person calling Name of person. I saw Name of person stood up and asked Hisiyoyan? (who is that?). I also heard a male voice from outside the gate replied hi kara (its kara). Name of person said tagadkaw (wait) the said person replied biskay kaw haturan in pashero ko, nagkangi in pasaheroko. (Hurry up transport my passenger, my jeep got trouble) then Name of person said tagad kaw magsalin pa ako (wait I will change my cloth). Name of person said kasay kaw nag o-us-us tood in pasahero ko (Hurry up my passenger is in a hurry). When Name of person went out, I heard the sound of opening the gate, I stood up and peeped through the door. I saw Name of person standing outside the gate then I lay down again. I also heard the engine of Multicab of Name of person started and the sounds like it was slowly moving from the garage. Then I went to sleep; 5. That at about 3:00 oclock in the afternoon when I was in the premises of our house, I heard from our neighbor that Name of person was arrested by the police. Later, I went outside, there I saw some policemen from _______ Police Station. It was at that time I came to know the abandoned white Multicab and I saw

it parked 3 houses away from the house of Name of person. The Police asked me some questions and I told them about the matter; 6. That, I am executing this affidavit of my own free will and volition, and inorder to attest the truthfulness of the foregoing facts.

Then Name of person said kasay kaw nag o-us-us tood in pasaher oko (Hurry up my passenger is in a hurry) and Name of person replied ok na; 6. That, when Name of person opened the door, I realized that it was already around 7:00 oclock in the morning. I stood-up and peeped through the door when I heard the opening of the gate. I saw Name of person standing outside the gate. I did not mind because I know Name of person as a driver like him, and they were talking about their occupation. Then I heard the engine of Multicab of Name of person started and the sounds like it was slowly moving from the garage;

7. That, around 12:00 oclock mid-day of same date, I heard from our neighbor, that Name of person was arrested by Ayala Police in the morning for abduction. 8. That in the afternoon, police officers from ______ Police arrived. At about 6:00 oclock in the evening, police officers from Sta. Maria Police Station on board an L-000 arrived. One of them tried to start Name of person MulticabPlate No YHA 870 because the ignition key was left on the Ignition switch. However, it did not start. They asked our help to tie the said Multicab with a rope to their L-000 van and pulled the same, according to them to Sta. Maria Police Station; 10. That, I am executing this affidavit of my own free will and volition, and inorder to attest the truthfulness of the foregoing facts.

That I know personally the person of Name of person because we have been neighbor for almost 10 years. His house at _________________, this City is adjacent to our house. I and some residents of __________ know him as a driver for fee usually for a contract known as Pakyaw or Padjak basis using his white Multicab at Zamboanga Port. Sometimes people go to his house and contracted him for fee to transport passenger or goods from one place to another; 2. That when his children left to Saudi Arabia for work, he left alone in their house. Name of person and Name of person usually accompanied him at his house; 3. That I also know Name of person also a driver like Name of person because he frequently went to the house of Name of person. 4. That, it is my habit to wake up around 6:00 in the morning to feed my roosters which I keep near the vacant lot beside the subdivision road in front of our house. At about 7:00 in the morning of July 11, 2013,while I was feeding my roosters, I saw a white Multicab coming from Hilltop Subdivision running down on a declining road toward the gate of _________________ but I did not hear any sound coming from its engine. It totally stopped in front of the said gate. Then I went inside our gate and sat on a plastic chair in front of our house about 3 meters away from the gate of the house of Name of person; 5. That seconds later, I saw Name of person walking toward the gate of the house of Name of person. Though I was inside the gate, I can see him clearly because our fence is made up of bamboo slats. I also saw Name of person PO2 Name of person passed-by on board his single motorcycle. Then Name of person knocked on the gate of Name of person house three times and at the same time called the name of Name of person 3 to 4 times. I heard Name of person said hi siyo yan? (who is that?) he replied Name of person (its Name of person) then he added biskay kaw haturan in pasahero ko,nagkangi in jeep ko. 6. That, I went back to the cages of my cocks to check their foods. After a while, I saw the white Multicab of Name of person went out of his gate slowly moving backward and ran forward to the direction of subdivision gate where the white Multicab of Name of person is. Then I saw one of the passengers of Name of person the one who is tall and thin alighted from the rear of Name of person Multicab and walked near the gate. This time Name of person was already sitting inside his Multicab; 7. That when the white Multicab of Name of person came near the gate of the subdivision, the other passenger who is a big man and sitting in the passengers sit in front of Name of person Multicab alighted carrying a child without upper garment. Name of person likewise alighted from his Multicab. The big man while still carrying the child, boarded to Name of person Multicab and sat on the passengers sit in front. The tall and thin man boarded to the back of Name of person Multicab. Then the Multicab ran leaving Name of person and his Multicab. Name of person started pushing his Multicab inside the subdivision gate and stopped in front of Block 1, Lot 3. Then he started the ignition. Sometimes the engine starts but shut off again, and sometimes it did not start; 8. That, at this time I went near Name of person Multicab and sat on the wooden bench beside the road where I saw the plate No. of Name of person Multicabas YHA 870. Name of person (PO2 Name of person) was already there,and we had a conversation with Name of person. Name of person also talked with us while he was trying to fix his Multicab. After how many minutes, I went inside our house when Name of person drove his motorcycle home; 9. That at about 11:30 in the morning of same date, while I and my younger brother were outside of our house (on the wooden bench), our neighbor police officer Name of person assigned at Ayala Police Station, passed-by on board a motorcycle. He told us that Name of person was arrested by Ayala Police in the morning for abduction. This time Name of person was not there but his Multicab was still there; 10. That one of our neighbor informed Name of person, the son of Name of person who is in Manila thru cellphone about the incident. In the afternoon, police officers from _________ Police arrived. They took pictures on the Multicab and asked us some question which we also told them. At about 6:00 oclock in the evening, police officers from Sta. Maria Police Station on board an L-300 arrived. One of them tried to start Name of person Multicab because the ignition key was left on the Ignition switch. However, it did not start. They asked our help to tie the said Multicab with a rope to their L-300 van and pulled the same, according to them to Sta. Maria Police Station; 11. That, later I came to know the complete name of Name of person as Name of person and the name of the big man as Name of person while the tall-thin man as Name of person; 12. That I am executing this affidavit of my own free will and volition, and inorder to attest the truthfulness of the foregoing facts.

That I am a member of the PNP with the rank of Police Officer 2 assigned with ________ Police Station, Zamboanga City, and presently on schooling for PSJLC at PPSC Pasonanca, Zamboanga City. 2. That I know personally the person of Name of person, a resident of __________________, this City because we are neighbors since Phase I and Phase II of HB Homes are adjacent to each other. I used to play basketball in front of his house when the basketball ring was still in place there. We also used to have fun and conversation with him. I also know him as a driver, driving his white Multicab for Pakyaw or Padjak usually from Zamboanga Port to any palces in Zamboanga City. 3. That I also know Name of person, he is also a driver, and he and some drivers often went to the house of Name of person; 4. That,at about 7:00 oclock in the morning of July 11, 2013, I went to the house of my brother-in-law, SPO2 Name of person at ________________, Zamboanga City, on board my single motorcycle. When I entered the gate of Phase I, HB Homes, I saw Name of person in front of the gate of Name of person. I also saw a white Multicab near the gate of the subdivision; 5. That, when I went back, I saw Name of person fixing the said Multicab Plate No. YHA 000 which already parked inside the gate of Phase I, HB Homes. I parked my motorcycle near the wooden bench behind the said Multicab; 6. That minutes later, Name of person who was then feeding his roosters sat on the wooden bench and we engaged a little bit conversation and jokes together with Name of person. Thereafter, I drove my motorcycle home; 7. That I am executing this affidavit of my own free will and volition, and inorder to attest the truthfulness of the foregoing facts.
