AdwCleaner - Terms of use

BY USING THIS SOFTWARE, YOU ACCEPT THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE , DO NOT USE THE SOFTWARE.

1. PARTIES

This agreement is between the software developer, Xplode ( hereinafter referred to as "the developer" ) , and any user of the software, of failing to have the legal capacity to accept this agreement, its legal representative ( hereinafter referred to as "you" )

2. OBJECT OF THE AGREEMENT

This agreement applies to AdwCleaner ( hereinafter referred to as "the software" ) , downloaded from the website general-changelog-team.fr ( or bleepingcomputer.com ). It also applies to updates of the software and any other related service.

3. DURATION

This agreement is concluded for an unlimited duration. You may terminate it at any time by deleting the software.

4. USAGE RIGHTS

The software is provided free of charge, but it remains the property of the developer. Therefore, all the rights that you are not expressly granted in this agreement remain the responsibility of the developer

4.1. INSTALLATION

This agreement, if accepted, allows you to install any number of copies of the software on your computer(s).

4.2. USE

The software is designed to operate in a specific manner, you must comply with any technical limitations imposed by it.

4.3. TECHNICAL ASSISTANCE

No technical support will be provided due to the use of the software service.

5. PROHIBITIONS

Subject as otherwise provided in regulations in your country, any use other than intended and permitted in these Terms of Use is prohibited, in particular :

5.1. DISTRIBUTION AND SALES

The software is available for free download on general-changelog-team.fr ( or bleepingcomputer.com ). Copying of the software provided by a source other than those describes above without the express written permission constitutes an infringement. Accordingly, it is prohibited to : * Publish the software, including through a third party, without the consent of the developer. * Transfer the software or this agreement to any third party. * Sell, lease or lend the software to a third party.

5.2. MULTIMEDIA ELEMENTS

Remaining the property of the developer, multimedia elements it contains, for example the name of the software or its associated logo may not be used without permission of the developer.

5.3. MODIFICATIONS

Only the normal use of the software, that is to say, according to technical restrictions, is allowed. Therefore, are prohibited : * The fact circumvent or attempt to circumvent any technical limitations in the software; * Reconstitute the software logic, decompile or disassemble.

6. WARRANTIES

The software is provided "as is". You acknoledge that it is likely to present risks associated with its use. There is no warranty as to the results that could provide the software. Similarly, the responsibility of the developer in no event be liable for any damage arasing from the use of the software, including and not limited to loss of data.

7. ACTION

You acknowledge and agree that any dispute will be resolved before the French court jurisdiction.

8. MODIFICATION OF THESE TERMS

You acknowledge and agree that these conditions may have one or more modification(s) occur(s). However, it is possible to terminate the contract by ceasing to use the software.

EN UTILISANT CE LOGICIEL, VOUS ACCEPTEZ LES TERMES DE CE CONTRAT. SI VOUS LES REFUSEZ, N'UTILISEZ PAS LE LOGICIEL.

1. PARTIES :

Le prsent contrat est conclu entre le dveloppeur du logiciel, dit Xplode (ci-aprs dnomm le dveloppeur), et tout utilisateur de ce logiciel, ou, dfaut de disposer de la capacit lgale pour accepter le prsent contrat, son reprsentant lgal (ci-aprs dnomm l'utilisateur, vous).

2. OBJET DU CONTRAT :

Le prsent contrat s'applique au logiciel ci-aprs dnomm AdwCleaner (le logiciel), tlcharg depuis le site general-changelog-team.fr ou bleepingcomputer.com. Il s'applique galement aux mises jour du logiciel, et tout autre service connexe ventuel.

3. DURE :

Le prsent contrat est conclu sans limitation de dure. Vous pouvez y mettre fin tout moment en supprimant le logiciel.

4. DROITS D'UTILISATION :

Le logiciel est fourni titre gratuit, mais il demeure la proprit exclusive de son dveloppeur. Par consquent, tous les droits qui ne vous sont pas expressment octroys dans le prsent contrat restent de la comptence du dveloppeur.

4.1. INSTALLATION :

Le prsent contrat, si vous l'avez accept, vous autorise installer un nombre indfini de copies du logiciel sur votre ou vos ordinateur(s).

4.2. UTILISATION :

Le logiciel tant conu pour fonctionner d'une manire spcifique, vous devez vous conformer aux restrictions techniques imposes par celui-ci.

4.3. ASSISTANCE TECHNIQUE :

Il ne sera fourni aucun service d'assistance technique du fait de l'utilisation du logiciel.

5. INTERDICTIONS :

Sous rserve de dispositions contraires en vigueur dans votre pays, toute utilisation autre que celle prvu et autorise dans les prsentes conditions d'utilisation est interdite, en particulier :

5.1. DISTRIBUTION, VENTE :

Le logiciel est offert au tlchargement gratuitement sur les sites general-changelog-team.fr et bleepingcomputer.com. Toute copie du logiciel fournie par une autre source que celles dsignes ci-dessus et sans l'autorisation expresse et crite du dveloppeur constitue une contrefaon.

En consquence, il vous est interdit, notamment, de : * Publier le logiciel, y compris par le biais d'un tiers, sans l'autorisation du dveloppeur. * Transfrer le logiciel ou le prsent contrat un tiers. * Vendre, louer ou prter le logiciel un tiers.

5.2. LMENTS MULTIMDIAS :

Le logiciel restant la proprit de son dveloppeur, les lments multimdias qu'il contient, par exemple la dnomination du logiciel ou le logo qui lui est associ, ne peuvent tre utiliss sans l'autorisation du dveloppeur.

5.3. MODIFICATIONS :

Seule l'utilisation normale du logiciel, c'est--dire conforme ses restrictions techniques, est autorise. Ds lors, sont interdits, notamment : * le fait de contourner, ou de tenter de contourner les restrictions techniques contenues dans le logiciel ; * Reconstituer la logique du logiciel, le dcompiler ou le dsassembler.

6. GARANTIES :

Le logiciel tant fourni "en l'tat", vous reconnaissez qu'il est susceptible de prsenter des risques lis son utilisation. Il ne sera accord aucune garantie quant aux rsultats qui pourront tre obtenus. De mme, la responsabilit du dveloppeur ne saurait en aucun cas tre engage en cas de dommage dcoulant de l'utilisation du logiciel, en ce compris et de faon non limitative la perte de donnes.

7. LITIGE :

Vous reconnaissez et acceptez que tout litige ventuel sera rsolu devant la juridiction franaise comptence.

8. MODIFICATION DES PRSENTES CONDITIONS :

Vous reconnaissez et acceptez que les prsentes conditions puissent faire l'objet d'une ou de plusieurs modification(s) ultrieure(s). Il vous sera nanmoins possible de mettre fin au contrat en cessant d'utiliser ce logiciel.
