20.1

RAV Project Environmental Management


RAVCo Approach to Environmental Management

As described in SECTION 21, RAVCo has made a variety of corporate Commitments regarding implementation of required environmental actions, investigations and documented procedures during project construction and operation. Adherence to these Commitments will ensure that project planning, design and construction proceed in keeping with sound environmental practices, and that the recommendations and requirements of the BCEAA/CEAA environmental assessment review process are followed throughout construction. As the project progresses, all applicable environmental assessment and planning findings will be incorporated into project design criteria and Concession Agreement conditions in response to various requirements documented elsewhere (including SECTIONS 6 to 18).

20.2

RAVCo/Concessionaire Commitment Responsibilities

Tables 21.1 and 21.2 in SECTION 21 describe the Commitments, responsibilities and assurances related to construction and operation of the RAV Project. These tables identify the following: the party responsible for implementation of each Commitment; the party responsible for overseeing the implementation and completion of each Commitment; the approximate implementation period (i.e., activity period); whether agency submittals are required and the date by which any such submittals must be made; and whether there is a need for residual effects follow-up.

Presentation of this information is intended to demonstrate, to the BCEAO and CEAA, the participating review agencies, First Nations and the general public, the responsible and diligent manner in which RAVCo intends to undertake, oversee and deliver its project-related Commitments.

20.2.1

Contract Requirements and General Environmental Practices

RAVCo has committed to ensuring that the RAV Project is implemented in accordance with all permits, licenses and approvals issued for the project, as well as all applicable legislation. The Concessionaire will be given the authority, either of its own accord or upon RAVCos direction, to suspend any activities or operations that are in contravention of any environmental legislation or regulation, or that are causing or potentially could cause, detrimental environmental impacts.

20.2.2

Permits, Licenses and Approvals

In addition to project approvals under BCEAA and CEAA, RAVCo is responsible for acquiring: a development permit from VIAA for the airport segment of the RAV Line; approval from Transport Canada under the Navigable Waters Protection Act for the two proposed Fraser River crossings; and project approval from the North Fraser Port Authority and the Fraser River Estuary Management Program.

As described in the BAFO instructions, the Concessionaire is responsible for identifying and acquiring all other permits, licenses and approvals, including municipal permits and approvals required for project construction and operation. These will include, but may not be limited to: Section 35(2) Authorizations under the Federal Fisheries Act for works involving crossings of fish-bearing waters and/or impacts to fish and fish habitat; Federal approval for ocean disposal of materials removed from tunnels or other subsurface excavations; Section 9 approvals under the BC Water Act for any works in and about a watercourse; facility alteration permit under the VIAA Construction Bylaws and Policies for the Airport portion of the RAV Line; and

municipal approvals, including those related to zoning, development permits, building permits and applicable by-laws such as tree removal, noise, hours of work, street access and traffic control.

RAVCo has commenced discussions with DFO and presented conceptual design information based on the current RAVCo reference alignment on the North Arm and Middle Arm crossings. This will assist the Concessionaire with its Section 35(2) Authorization applications under the Fisheries Act, requesting formal approval to construct these crossings. In the event that fisheries habitat compensation is required, the Concessionaire will ensure that detailed final design and construction plans, as well as all relevant supporting data, are submitted to DFO in sufficient time to obtain these Authorizations so that construction schedules are not delayed. Similarly, documentation required for the acquisition of all other permits, licenses and/or approvals will be submitted to the regulatory agencies within a timeframe that allows for agency review and approval and avoids delays in the construction schedule. The Concessionaire will comply with the terms and conditions specified in all regulatory permits, licenses and approvals. Any Environmental Inspection(s) and/or Quality Assurance/Quality Control (QA/QC) analysis undertaken by RAVCo will not relieve the Concessionaire of the sole responsibility for the performance of the work in accordance with the terms of the Concession Agreement and the Concessionaires Environmental Management Plan (EMP), the terms and conditions of the EAC and other permits, licenses and approvals, and applicable RAVCo Commitments.

20.3

Environmental Inspection

Effective environmental inspection involves the commitment of all project personnel, including those involved in project management, engineering and construction, to comply with environmental procedures and government regulations. The Concessionaire will be responsible for providing and deploying an Environmental Inspector who is experienced in large-scale construction projects and who will be responsible for day to day monitoring. RAVCo, in turn, will provide an Environmental Manager and/or environmental staff, who will

oversee the work and carry out periodic QA/QC audits of project activities and procedures to ensure that the project is being managed to the satisfaction of RAVCo and the Relevant Authorities, as per the EMP and EAC Commitments. The Environmental Inspector will ensure that environmental management measures, controls, and specifications are implemented as per the terms and conditions of EAC, other regulatory permits, licenses and approvals, as well as RAVCos requirements. Input provided by the Environmental Inspector during the project planning and engineering design processes will ensure that environmentally sound procedures and construction practices are incorporated into project design and work plans. The Concessionaire will ensure that the Environmental Inspector is on-site during all construction activities that have the potential to cause detrimental environmental effects and that are deemed to require environmental monitoring services. The ultimate goal of the environmental management program will be to guide the project from inception to completion with minimal adverse environmental impacts. Generally, it is expected that the Concessionaires Environmental Inspector will:

be responsible for the effective implementation of the EMP; be involved in the processing of regulatory permits and approvals; provide input to design and the development of environmentally sound planning, design and construction practices; identify the aspects of the project that require environmental monitoring and, on that basis, develop an appropriate monitoring schedule; conduct routine and random inspection of construction activities, practices and control structures; issue stop work orders as necessary to prevent activities and/or adverse environmental impacts that would contravene the terms and conditions of environmental permits and approvals and/or other regulatory requirements; document environmental monitoring results and prepare reports for RAVCo and government agencies as required or appropriate; consult with regulatory agencies, RAVCo personnel, site engineers and contractors and provide technical assistance to the Concessionaire such that any environmental issues that arise during construction are dealt with effectively; deliver worker orientation and training sessions; and

attend on-site and progress meetings with the Concessionaire and other members of the project team, as well as agency representatives, as appropriate.

Examples of some of the activities and facilities to be monitored by the Environmental Inspector during construction include: Settling Ponds. The Environmental Inspector will evaluate settling pond system designs to ensure compliance with water quality standards for total suspended solids (TSS) and other parameters. The Environmental Inspector will assess all associated control measures, including dykes, liners, skimmers, booms and intake/discharge points, as well as the effects of discharge on water levels and quality in the receiving environment. Topsoil Storage. The Environmental Inspector will evaluate removal, storage, and stockpiling methods and will assist the contractor(s) in implementing measures that prevent leaching, erosion, and runoff from stockpiles into the receiving environment. Hazardous Materials Storage and Handling. The Environmental Inspector will evaluate on-site hazardous materials storage methods, hazardous waste handling and transportation procedures, and spill response readiness. The Environmental Inspector will ensure that all on-site personnel are aware of the impacts associated with spills of hazardous or harmful substances and of regulatory requirements under the Environmental Management Act Spill Reporting Regulation, and other applicable legislation. Air Quality and Noise Levels. The Environmental Inspector will assist the Concessionaire, contractors and on-site personnel in implementing measures that minimize air emissions and noise levels associated with the operation of construction machinery and equipment. Construction Vehicles and Equipment. The Environmental Inspector will assist the Concessionaire in ensuring that all machinery used on-site is new or in good repair, free of external oil and grease and that any spills or leaks from machinery are immediately cleaned up and the clean up materials removed off-site to an appropriate facility. The Environmental Inspector will conduct regular inspections of vehicles involved in construction to ensure that they are equipped with spill kits. Specific inspection and reporting protocols, schedules, relationships and final submission requirements between RAVCo, the Concessionaire and/or the

Relevant Authorities will be further defined during final contract negotiations and EMP preparation.

20.3.1

Environmental Inspection Summary Reports

The Environmental Inspector will keep a Construction Environmental Inspection Field Log for the RAV Project that summarizes activities and actions taken to minimize project impacts and that documents the effectiveness of mitigation measures. Notes will be taken, supplemented by photographs. The log will provide a comprehensive account of environmental issues and observations, a description of actions required and taken, and an indication of how specific issues were resolved. This log will form the basis of any required agency submission and may, if necessary, will be used to produce an Environmental Progress Report and/or serve as information for RAVCo during implementation of the QA/QC process. The Construction Environmental Inspection Field Log (see sample shown in Figure 20.1) will include the following items: time, date, and weather conditions; contacts and/or discussions with the contractor, on-site personnel, government agencies, members of the public etc.; descriptions of construction activities; descriptions of specific mitigation measures and an evaluation of their effectiveness; a list of names and other relevant information pertaining to any environmental incidents; records and test results of ongoing monitoring; a description and evaluation of emergency response measures; a summary of decisions made that affect the environment, including those associated with staging of the work and initiating new control measures, as well as those made during communications with on-site personnel and regulatory agencies; recommendations for future remedial action(s); date and description of issues resolved; and any other observations or information deemed relevant.

Specific inspection and reporting protocols, schedules, relationships and final submission requirements between RAVCo, the Concessionaire and/or the Relevant Authorities will be further defined during final contract negotiations and EMP preparation.

20.3.2

Environmental Awareness Program Materials

The Environmental Inspector will present materials on environmental awareness (see SECTION 20.4.10) to all on-site personnel prior to the commencement of construction and as frequently as necessary throughout the project to help them understand the Projects environmental issues and regulatory compliance requirements. Through this process, the Environmental Inspector will: assist all personnel in ensuring effective implementation of the EMP; enhance personnel awareness and appreciation of the biophysical and/or socio-community resources likely to be affected during construction; provide a rationale for the protection of these resources; familiarize personnel with the causes of environmental problems and how they can be avoided; provide guidance regarding how specific mitigation measures are to be implemented; and help to ensure that all construction practices are carried out in an environmentally responsible manner.

20.4

Environmental Management Plan

An EMP outline (see below) was developed and presented to the Contractor Teams in the early stages of the RAV Project RFP process. In addition, the technical design and construction elements sections of both the RFP and BAFO instructions provided prospective Contractor Teams with a general outline of required EMP components. The Contractor Teams, in turn, incorporated and elaborated on this information in their BAFO submissions. It is expected that the selected Concessionaire will use this outline as a reference during EMP preparation.

The EMP components identified in the RFP and BAFO instructions are based on environmental requirements typically associated with large-scale construction projects, as well as existing legislation, regulations, guidelines and available best management practices. It remains the policy of RAVCo, and ultimately the Concessionaire, to protect and safeguard environmentally sensitive areas and culturally important features within the RAV Project corridor. The Concessionaire will be expected to conduct business in a manner that minimizes environmental impacts and ensures compliance with all environmental legislation, regulations, permits, licenses, agreements and rules applicable to the project. The Concessionaire will submit the EMP for review and approval by RAVCo prior to construction. Component plans to be included in the EMP are: Surface Water Quality and Sediment Control Plan Contaminated Sites Management Plan Hazardous Materials Management Plan Spill Prevention and Emergency Response Plan Solid Waste Management Plan Air Quality and Dust Control Plan Noise Management Plan Landscape Design and Restoration Plan Archaeological Monitoring Plan Environmental Education and Awareness Plan

In addition, the Concessionaire will prepare an Operational Environmental Management Plan (see SECTION 20.5). Adherence to the RAV Project EMP during construction will ensure that the Concessionaire complies with all applicable Federal and Provincial legislative and regulatory requirements and local government by-laws, as well as best management practices. Outlines for each of the EMP component plans are provided below.

20.4.1
20.4.1.1

Surface Water Quality and Sediment Control Plan


Sediment and Erosion Control

The Concessionaire will prepare a Surface Water Quality and Sediment Control Plan, to be reviewed by RAVCo prior to construction commencement, indicating how discharges from the project site and related work areas, including but not limited to access roads, excavations and soil fill areas, will be managed. The Plan will describe the following: measures to minimize sedimentation of watercourses, ditches, and storm sewers in the vicinity of the project site, and to prevent the discharge of deleterious substances (e.g., raw concrete, concrete leachate) or debris to the receiving environment; methods for material placement and/or disposal that will prevent the entry of construction and excavation wastes, overburden, soil or other substances deleterious to aquatic life into any watercourse, or ditch or storm sewer system connected with a watercourse; measures to prevent impacts to marsh, mudflat and riparian habitat, unless otherwise authorized by DFO and MWLAP; detailed procedures for collection and analysis of water quality samples to ensure that site runoff complies with the Canadian Council of Ministers of the Environment (CCME) (1999) Canadian Water Quality Guidelines for Aquatic Life and/or any project-specific requirements identified by regulatory agencies; a description of the responsibilities of the Environmental Inspector with respect to Plan implementation; protocols for regular monitoring, maintenance and repair of stormwater drainage and sediment control systems to ensure that that these systems function effectively under all site conditions and until such time as the affected area has been stabilized and there is no longer a risk that sediment-laden waters could be discharged to the receiving environment; measures to ensure the safe handling and off-site disposal of deleterious materials (e.g., concrete wash water) at an approved location1;

Note: No facilities for on-site disposal will be allowed or provided for by RAVCo or the Concessionaire.

protocols to be followed in the event that the Environmental Inspector determines that the quality of the discharge water leaving the site exceeds, or has the potential to exceed, prescribed levels. This shall include a description of the Environmental Inspectors authority with respect to issuance of stop work orders; procedures for immediate notification of RAVCos Site Superintendent, Environmental Manager, RAVCo Project Office and/or Relevant Authorities in the event of an environmental incident such as discharge of deleterious materials from the project site; measures to be taken to address and resolve issues arising from noncompliance with applicable standards, criteria, guidelines and/or approvals to the satisfaction of RAVCo and the Relevant Authorities.

20.4.2

Contaminated Sites Management Plan

The Concessionaire will prepare a Contaminated Sites Management Plan, to be reviewed by RAVCo prior to construction commencement. The Plan will describe measures to ensure that all imported fill, including sand and other soils brought onto the Site, or fill moved between locations throughout the Site, is clean and conforms to the residential land use criteria established in the Contaminated Sites Regulation under the Environmental Management Act.

20.4.2.1

Sampling and Contaminant Analysis of Imported Fill

The Contaminated Sites Management Plan will include provision for a proposed sampling plan for all fill materials that are brought to site. The sampling plan, which will be submitted to RAVCo for review and approval, will indicate: the proposed source(s) of fill materials; existing and historic land use in the area on and adjoining the source(s) of the fill material; presence or absence of any indications of contaminant risk, including aboveground or underground storage tanks, and/or visible staining of soils in the source area; types of fill materials (e.g., sand, gravel, pit run, topsoil); estimated volumes of fill materials;

chemical parameters for which the fill materials are to be tested; frequency of testing; and the name of the analytical laboratory that will undertake the testing.

Following RAVCo review and approval of the imported fill material sampling plan, the Concessionaire will be responsible for obtaining representative samples of imported fill materials and undertaking chemical analyses to certify that the fill materials to be brought on-site meet or are cleaner than the residential land use criteria specified in the Contaminated Sites Regulation. The Concessionaire will make all testing and analytical results related to the imported fill available for RAVCo QA/QC purposes, upon request. The Concessionaire will ensure that imported fill brought onto the Site does not enter into watercourses, wetlands or stormwater systems in the project area.

20.4.2.2

Sampling and Contaminant Analysis of Excavated Soils

The Contaminated Sites Management Plan will include provision for a proposed sampling plan to identify the chemical composition of all soils to be excavated and removed from the Site. This sampling plan, which will be submitted to RAVCo for review and approval, will indicate: the source(s) of the soils; existing and historic land use in the area on and adjoining the source(s) of the excavated soils; presence or absence of any indications of contaminant risk, including aboveground or underground storage tanks, and/or visible staining of soils in the area; estimated volumes of soils to be excavated and removed; chemical parameters for which the excavated soils are to be tested; frequency of testing; and the name of the analytical laboratory that will undertake the testing.

Following RAVCo review and approval of the excavated soils sampling plan, the Concessionaire will be responsible for obtaining representative samples of excavated soils, and undertaking chemical analyses throughout the

duration of the Concession Agreement to properly characterize and manage the soils in accordance with the Contaminated Sites Regulations and Special Waste Regulations of the Environmental Management Act. Upon request, the results of these analyses will be made available for RAVCo review. The Concessionaire will be responsible for identifying an appropriate disposal location for the excavated soils once the initial chemical analyses are available. This information, as well as a protocol for immediate notification of RAVCo in the event that soils exceeding industrial land use criteria are encountered, will be described in the Contaminated Sites Management Plan.

20.4.3

Hazardous Waste Management Plan

The Concessionaire will prepare a Hazardous Waste Management Plan, to be reviewed by RAVCo prior to construction commencement. The Plan will describe how the Concessionaire will manage any hazardous waste material generated during the RAV Project. The Plan will include address the following: regulatory requirements pertaining to the handling and disposal of hazardous materials and wastes; maintenance of a Workplace Hazardous Materials Information System (WHMIS) to identify all hazardous chemicals used on-site; protocols for correct labeling and documentation of all controlled/hazardous products, including provision for Material Safety Data Sheets (MSDS) for each product brought on site; measures to reduce, reuse, recycle or treat waste, wherever possible; transportation and disposal of hazardous materials at a permitted hazardous waste management facility; proper maintenance and servicing of vehicles and equipment used onsite; environmentally sound procedures for refueling, painting, staining, chemical application and/or transfer and storage of hazardous materials; worker education programs to instruct workers about the contents and significance of WHMIS labels and MSDS, and procedures for working safely with hazardous materials; and maintenance of a log of hazardous waste materials generated by the project that describes the date and time of disposal, the type of material

The Concessionaires Hazardous Waste Management Plan will ensure that all hazardous materials (e.g., solvents, paints, flammable and poisonous products) are managed in compliance with BC Special Waste Management Regulations and by-law requirements of the GVRD, Vancouver and Richmond. The Concessionaire will secure all necessary waste disposal documentation and approvals applicable to the project.

20.4.4

Spill Prevention and Emergency Response Plan

To be prepared for any potential environmental emergency related to the loss of petroleum or other hazardous materials that could arise during RAV Project construction, the Concessionaire will develop a Spill Prevention and Emergency Response Plan. This Plan, which will be provided to RAVCo for review and approval prior to commencement of construction, will facilitate a rapid, safe and effective response to any hazardous material spill or other environmental incident that occurs during the project. Detailed information regarding plan preparation is provided in the BC Guidelines for Industry Emergency Response Plans (MWLAP 2002) and the Canadian Standards Association (CAN/CSA-Z73 I-M91) Emergency Planning for Industry (1991).

20.4.4.1

Spill Prevention and Emergency Response Policy Statement

The Concessionaire will prepare a policy statement for the Plan that includes: a description of the Concessionaires commitment to safeguard the health and safety of project employees and the public, and to protect the environment; a statement of the Concessionaires priorities in the event of a spill (i.e. employee safety, safety of members of the surrounding community, protection of the environment); a clear indication of the identity and level of authority of the first line supervisor in directing emergency response activities; a statement of authority regarding who will be designated to deal with public and media inquiries; a statement concerning the Concessionaires plan to monitor compliance with this policy; the effective date of the Plan; and the schedule for review and for testing/exercising the Plan.

This policy statement will be signed by the Concessionaire.

20.4.4.2

Key Plan Components

The Spill Prevention and Emergency Response Plan will contain the following key components: Pre-emergency Planning. This Plan component will identify potential accidents or malfunctions, including on-site and off-site hazards; calculate the quantity of material that may be released during each potential accident or malfunction; and evaluate the consequences of such occurrences. Emergency Organization and Responsibilities. In this component of the Plan, the Concessionaire will describe an Incident Command System (ICS) that categorizes different types of emergency response into functional components and assigns responsibility for each component to an appropriate individual or agency. Responsibilities for decision making

and the delegation of authority from operations personnel to emergency response personnel will be clearly shown in an emergency organization flow chart. The ICS will identify the roles of specific individuals including: the individual with complete authority; the chain of command; the on-scene authority; and Concessionaire spokespersons, etc. This component of the Plan will describe how and when local fire and police departments, emergency measures organizations, Federal and Provincial authorities, RAVCo, news media, and off-duty workers are to be contacted during working and non-working hours. Spill Reporting. As information about a spill is conveyed through the notification process to Concessionaire personnel, RAVCo and the agencies, it must be clear, concise, accurate, and timely. This component of the Plan will describe the communication protocol, procedures and equipment to be used during an emergency response. Incident Site Security. The Plan will identify the need for site security and the role of security personnel after all potential risks at the incident site have been analyzed. Emergency Response. The Plan will define an emergency classification guide to be applied according to the severity and potential impact of an emergency. Concessionaire personnel who will have on-scene authority to evaluate the situation, assess the magnitude of the problem and activate the response plan will be identified for each type of emergency. For each type of emergency, the Plan will include a specific Emergency Action checklist as per Workers Compensation Board (WCB) Regulations. A detailed procedure for each type of foreseeable emergency, including methods to minimize danger (e.g., which fire suppression agents are to be used and under what conditions, whether a fire should be allowed to burn or be extinguished, which volatile liquids can be neutralized or diluted, what methods are to be used to deal with water- or air-reactive substances, etc.), will be included in the Plan.

The Plan will also describe the location, capability, and limitations of emergency response equipment to be used. Details regarding the availability of specific equipment, its location, how it can be accessed most efficiently, and who has responsibility for accessing and using it in the event of specific types of emergencies will be provided. Evacuation. The Plan will provide for the safe and orderly emergency evacuation of the area(s) affected by the environmental incident, as well as, if deemed necessary, the surrounding community. It will describe the types of warning systems to be used (e.g., sirens, emergency broadcast systems, mobile public address systems, house-by-house contact) during specific types during different types of emergencies to define the affected area and/or extent of evacuation required; depict maps showing both primary and alternate evacuation routes; designate primary as well as alternate off-site assembly areas; identify employees responsible for checking evacuation areas and for taking personnel counts at the assembly area to ensure that the area has been safely evacuated; and provide dispersion estimates for worst and most likely gas/vapour releases to better define the affected areas; The Plan will recognize that the authority to give mandatory evacuation orders is limited to the Fire Commissioner under Section 2 of the Fire Services Act. Site Restoration and Remediation. Actions to be taken to restore the affected environment to pre-incident conditions will be described. Post-Incident Evaluation. The Plan will provide for preparation of a written report describing each emergency incident. Training and Practice Drills. The Plan will describe the nature and frequency of training programs to be provided to Concessionaire and contractor personnel, as well as to the various agencies that would be involved in an emergency response.

20.4.5

Solid Waste Management Plan

The Concessionaires Solid Waste Management Plan will describe how all construction debris (e.g., waste wood, metals, concrete and asphalt), will be managed to ensure compliance with the Environmental Management Act and by-law requirements of the GVRD, Vancouver and Richmond. The Plan, which will be submitted for RAVCo review and approval prior to commencement of construction, will detail measures to minimize the amount of construction material used and will describe the Concessionaires approach to waste reduction, re-use and/or recycling. Included in the Plan will be provision for maintenance of a log of all off-site removal of debris and materials. This log will describe the date and time of removal, the type of material removed, the quantity of material involved, and the planned location for disposal, treatment or recycling2. Air Quality and Dust Control Plan

The Concessionaire will prepare an Air Quality and Dust Control Plan that describes measures to be used to control fugitive dust and other airborne emissions associated with vehicle and equipment operation, demolition and/or decommissioning of existing structures, stockpiling of soils, and other

construction activities. This Plan will be submitted to RAVCo for review and approval prior to commencement of construction. The Plan will describe: All regulatory permits to be obtained by the Concessionaire and retained on-site that are necessary for the operation of equipment or machinery capable of producing point-source emissions; prohibitions regarding the application of chemical dust suppressants to control fugitive dust and other airborne emissions, unless otherwise approved; prohibitions regarding the burning of refuse or other material, unless otherwise authorized in an air discharge permit issued by the GVRD or MWLAP; and indoor air quality control measures to be used to ensure that construction workers in portions of the Site within enclosed spaces (e.g., tunnel sections), are not adversely affected by unacceptable exhaust, fugitive dust, or other air emissions.

The Plan will include provision for maintenance of all required air quality monitoring and compliance reports for inspection by RAVCo.

20.4.7

Noise Management Plan

The Concessionaire will be responsible for applying for and procuring any permits required for the operation of construction machinery (i.e., vehicles, excavation equipment) at noise levels that exceed those set out in municipal by-laws in Vancouver and Richmond, and/or for undertaking operations outside normal working hours. The Concessionaire will comply with noise level regulations and guidelines established by the WCB. The Concessionaire will prepare a Noise Management Plan that describes noise mitigation measures to be implemented along the RAV corridor during construction to ensure compliance with these by-laws. The Plan will be submitted to RAVCo for review and approval prior to commencement of construction.

20.4.8

Landscape Design and Restoration Plan

Specific measures to be addressed by the Concessionaire with regard to landscape design and restoration are described in SECTION 8: ARBORICULTURAL SURVEY AND ASSESSMENT. In addition, the Concessionaire will comply with the terms and conditions of any agreements negotiated between the Concession, RAVCo and the municipalities of Vancouver and Richmond. Prior to implementation, all site-specific landscape design and restoration measures will need to be endorsed by affected third parties. Prior to commencement of construction, the Concessionaire will prepare and submit a Landscape Design and Restoration Plan to RAVCo for review and approval. The Plan will identify all expected areas of temporary and permanent vegetation loss (e.g., specific numbers and locations of guideway footings; areas to be disturbed due to their use as laydown or storage areas, construction access, stockpiles, etc.) and will describe site-specific measures for restoration, including but not limited to the following: stabilization of soils and reestablishment of vegetation upon completion of work at a location; establishment of vegetation in and adjacent to the right-of-way in a manner that is compatible with safe operation of the RAV Line, particularly as it relates to slope stability and tree hazard control; subject to discussions with the City of Vancouver and the City of Richmond, preference for selection of native species of grasses, herbs, shrubs and trees when re-planting is required along the RAV corridor; selection of plant species based on their ability to survive site-specific conditions and to afford cover and food for wildlife; integration of revegetation plans for habitat replacement with other impact mitigation objectives (e.g., noise reduction/aesthetic enhancement), where feasible and cost-effective; and assurance that selected vegetation meets all applicable safety standards and addresses safety standards and concerns for adjacent users.

The Concessionaires Landscape Design and Restoration Plan will also include provision for: a Project Arborist (horticulturist) to be retained by the Concessionaire to assist in protecting any trees to be retained;

installation of temporary protective fencing around vegetation to be retained prior to the commencement of any land clearing, demolition or construction work; inspection, monitoring and approval of protective fencing by the Project Arborist prior to commencement of work in the affected area and during the course of construction, as appropriate; the need for prior authorization by the Project Arborist if encroachment into the tree protection zone is required for any reason; and re-inspection of retained trees by the Project Arborist prior to the occupation of the Site. The Concessionaire will be required to submit a detailed post-construction report for RAVCo review and approval, documenting the mitigation and compensation measures implemented with regard to landscape design and restoration. This report, to be described in the Landscape Design and Restoration Plan, will include: measures to be implemented to ensure post-construction care of planted areas and plant stock for the period of time necessary to ensure survival, as identified by qualified professionals; description of an annual monitoring program, including site-specific guidelines, with sufficient detail to demonstrate that criteria for measuring the success of site restoration can be met; and a corrective strategy to be implemented in the event that the required plant survival rates are not realized or anticipated, based on the results of the monitoring program.

20.4.9

Archaeological Monitoring Plan

Prior to construction, the Concessionaire will submit an Archaeological Monitoring Plan to RAVCo for review and approval. The Plan will also be provided for information to the Provincial Archaeology and Registry Services Branch, Ministry of Sustainable Resource Management (MSRM). The Archaeological Monitoring Plan will describe permit requirements under the Heritage Conservation Act and monitoring procedures based on the BC Archaeological Resource Management Handbook (MSRM 1998a) and BC Archaeological Impact Assessment Guidelines (MSRM 1998b). These documents were developed to address monitoring of known or recorded archaeological sites during construction, as well as locations where the

potential exists to encounter undiscovered archaeological remains as a result of construction activities. While it is not anticipated that undiscovered, major archaeological sites will be encountered during RAV Line construction, RAVCo acknowledges that small sites in natural settings and remnants of archaeological sites beneath landscaped, capped or paved urban areas, may be present. The Archaeological Monitoring Plan will describe protocols and actions to be implemented in the event that unanticipated archaeological remains are encountered during construction. In addition to the monitoring and protection of archaeological resources during RAV Project construction, the Plan will describe the roles and responsibilities of the person(s) designated by the Concessionaire as Environmental Inspector and Archaeological Consultant, with respect to archaeological sites and issues.

20.4.10 Environmental Education and Awareness Plan


The success of the RAV Construction Environmental Management Program will depend largely on the ability of the Concessionaire staff, including project management staff, environmental and engineering personnel, and the Concessionaires contracting and sub-contracting personnel to comply with environmental procedures and government regulations. The Concessionaire will develop an Environmental Education and Awareness Plan for the review and approval of RAVCo, prior to commencement of construction. Components of this Plan will subsequently be delivered by the Environmental Inspector, at regular and defined intervals, to all Concessionaire employees. The purpose of the Concessionaires Environmental Education and Awareness Plan will be to: increase employee awareness and appreciation of the environmental resources that could be adversely affected during project construction; provide a rationale for the protection of these resources; familiarize employees with the causes of environmental problems and how they can be avoided; and ensure that environmentally sound construction practices are undertaken in order to achieve compliance with Federal and Provincial environmental

legislation and regulations, as well as all terms and conditions of project permits, licenses and approvals.

20.5

Operations Environmental Management Plan

During final design, the Concessionaire will prepare an Operations Environmental Management Plan describing the environmental management measures and best management practices to be used during RAV Line operation. The Plan will address operation and maintenance activities that may negatively affect environmental and socio-economic/socio-community resources, including but not limited to the following: agency reporting procedures; post-construction monitoring program requirements; operations and maintenance facilities; waste management; energy management; emergency spill response; containment and management; line de-icing; rail grinding; management of stormwater and surface water runoff; noise attenuation; and vegetation management.

Certain components of this Operations EMP outline will be similar to those described in the outline of the Environmental Management Plan for construction (see SECTION 20.4).
