FACTS
The matter was initially heard on 2.4.14. The relevant portion of the order is
reproduced below:
4. The Commission after hearing both sides directs the CPIO
to:
i) The Commission directs the PIO to go through the RTI
application again and furnish information against points 7
to 10,
ii) The Commission directs the CPIO to obtain the response
against points 11 to 15 from the driver of the car and the
official to whom it was allotted, in the form of an affidavit
and submit the same to the Appellant.
iii) The Commission directs the PIO to ensure the presence of
the Driver concerned on the next date of hearing i.e. 22
nd
April,
2014 at 2.30.p.m.
iv) The Commission directs the CPIO to furnish file notings of
the subject and reply under point 16, which stated that
appropriate steps to check the NGT cars to prevent such
violations.
5. Since the CPIO, himself, during the hearing had
volunteered to furnish satisfactory reply within one week,
the Commission directs him to furnish the information to
the Appellant within two weeks of receipt of this order as
the additional information sought involves a little more
exercise and report compliance to the Commission by
22.4.14.

2. Heard on 22.4.14. Appellant present. Public Authority is represented by
Shri Chetan Chawla.
3. During the hearing, the Appellant submitted that he has received the reply
today but raised certain doubts. Accordingly, the Commission decided to
adjudicate the matter point wise as given below:

4. The Appellant wanted to know how the car allotted to the Chairman of NGT
was used for transporting goods on a public holiday and wanted to know the name
of the person who travelled in the car. He also wanted to know the list of goods
brought and their purchase vouchers. He also sought the file noting regarding use
of Chairmans car for transporting goods. The Respondent officer submitted that
they do not maintain the log book but after the CICs order dt.2.4.14 had started
maintaining requisition slips. In response to the query from the Appellant, the
Respondent submitted that Shri Pradeep Kumar is a Multi Tasking Staff and not a
regular driver and he is driving the vehicle of the Chairman for few months. The
Appellant wanted to know whether Shri Pradeep Kumar was paid any OTA or
granted any leave in lieu of work done on a public holiday.
5. The Commission directs the PIO to provide the requisite information as
referred in Para 4 and also the relevant file notings and requisition slips to the
Appellant.

6. The Commission recommends the Public Authority to circulate the letter
dt.22.4.14 regarding the compliance of traffic rules to all the drivers of NGT.
7. The Commission also noted that the reply furnished by the Driver is not on
affidavit and no response was received from the official to whom the car was
allotted as directed vide order dt.2.4.14 and expresses its displeasure and warns
the Public Authority to comply with the directions of CIC.
8. The entire exercise to be completed within fifteen days of receipt of this
order including filing of two affidavits as directed vide order dt.2.4.14.
9. When the Commission queried why the driver of the vehicle was not
present despite issuing specific orders in the regard, the Respondent submitted
that the driver is on official duty.
10. The Commission also noted that the RTI application was transferred to
Supreme Court and Traffic Police Headquarters for providing information against
points 7 to 10 and 11 to 15 respectively.

2. The Appellant flied an RTI application dt.9.12.13 with the PIO,
NGT seeking information against' eighteen pOints relating to car

that too after a petition was filed at Central Information Commission (with copy marked to NGT) for non-
compliance ofRTI petition, provided a totally eyewash reply trying to evade the queries in most irresponsible
manner apparently in a bidto hide a serious irregularity about use ofofficial carallotted to NGT Chairperson (as
revealed in RTI response). Undersigned petitioner made repeated telephonic calls at NGTfor an early response to
the RTIpetition. Butperhapssucha longdelay in responseto RTIpetition mightalsobeduetodiscomfort likelyto
becausedto concernedonesatNGTthroughqueriesof thisRTIpetition.
Learned CPIO in a totally evasive response to queries (7), (8), (9), (10), (ll), (13), (14) and (15) of RTI petition
replied that Information is not available with the department! I filed my first appeal dated 08.02.2014 requesting
CPIO at NGT to be directed to respond to queries of RTI petition by seeking assistance of concerned ones at other
departments of NGT including also Honourable Chairperson of NGT and driver Shri Pradeep Kumar who both
happen to be accountable under RTI Act, under provisions of section 5(4) ofRTI Act. Or else, my RTI petition may
kindly be directed to be forwarded/transferred etc to concerned ones under section 6(3) of RTI Act under intimation
to me.
Response to query (12) never not fitted to the query. I asked for name of the driver of the car bearing registration-
number DLSCBG-0009 having parked the car in 'No-tolerance zone' in Chandni Chowk outside Dariba (Delhi)
around 2 pm on 16.10.2013, and not just name of the regular driver of the car bearing registration-number
DLSCBG-0009. 1 also requested CPIO at NGT to be directed to re-visit the query for a truthful and proper response
if necessary after seeking assistance of concerned ones including also the driver Shri Pradeep Kumar.
Learned CPIO in response to query (16) replied that appropriate steps are being taken in compliance of the Traffic
Rules, but without any copy offile-notings/correspondence/documents etc in this regard. There must be some office-
memos/orders etc in this regard as per response to query (16).
Appellate Authority through an order dated 05.03.2014 directed to transfer RTI petition in respect of queries
numbering (11) to (15) to Delhi Traffic Police while response to these queries especially query-numbers (11), (12)
and (15) can only and only with be NGT itself. Rather NGT driver with the car bearing registration-number
DL8CBG-0009 on 16.10.2013 at about 2 pm could better respond to query-numbers (13) and (14) because it is not
always that Delhi Traffic Police catches every car violating traffic-norms that too especially with cars with Supreme
Court stickers! I therefore appeal that query-numbers (11) to (15) alongwith ordered query-numbers (16) and (1S)
may kindly be directed to be responded by concerned ones at NGT itself including the allottee of the car (NGT
Chairperson) and driver on duty with car bearing registration-number DLSCBG-0009 together with all sought and
~ related documents now to be provided free-of-cost under section 7(6) ofRTI Act.

As a further eye-wash, Appellate Authority directed CPTO at NGT for responding to query-numbers () to (6) also,
for which even the appeal was not made as the appellant was satisfied with CPIO's response on these queries!
Appellate Authority'S order seemed to be a bid to hide the serious irregularity. Interestingly appeal-order revealed
that CPIO did not cooperate in appeal-proceedings, an aspect most shocking and surprising practically for a public-
authority that too when the Appellate Authority is himself the highest administrative post (Registrar Genera) at
NGT. File-notings on handling RTI petition should also reveal administrative and disciplinary action taken against
the CPIO at NGT for such callous handling of RTI petition and subsequent non-cooperation with the Appellate
Authority. The then Honourable Central Information Commissioner Shri Satyanandji Mishra once observed during
a hearing on petition against Reserve Bank of India (RBI) that officers handling RTI petitions and appeals are
otherwise a/so senior responsible officers, which must feel themselves duty-bound to take due cognizance of
irregularities exposed through RTI petitions. File-notings on handling RTI petition should also include if the driver
perfonning duty on government-holiday of Eid was paid prescribed over-time payment, or else if the official car at
Chandni Chowk (Delhi) on 16.10.2013 was driven by some unauthorized person. There is no mention either in
CPlO's response or in the appeal-order if assistance in responding to RTI petition and drafting appeal-order was
taken under section 5(4) of RTI Act from the concerned ones including allottee of the car (NOT Chairperson) and
driver of the car. It is prayed accordingly.

The Appeal No. 4/2014 preferred by Appellant on the ground that CPIO at NGT respond
vide muchmuch delay after filing Petition at Central Information Commission for non
compliance. The response of CPIO is a totally eyewash and trying to evade the queries in
most irresponsible manner. The CPIO provided evasive response to query No. (7), (8), (9),
(10), (11), (13), (14) & (15). Appellant requested that these queries may be responded by
seeking assistance of concerned once at other department of NGT including Hon'ble
Chairperson of NGT and Driver Sh. Pradeep Kumar who both happened to be accountable
under RTI Act. Appellant further taken the ground that RTI Petition may be directed to be
forwarded 1transferred to concerned branch under Section 6 (3) of RTI Act. Appellant further
requested for query No. (7) to (10) may be transferred to Supreme Court. CPIO further may
be directed to revisit the query (12). As per response to query No. (16), CPIO without any
copy of file notice 1correspondence 1documents replied and no step taken in compliance of
traffic rules or office memos 1orders, etc. Appellant further requested for providing free of
cost documents under Section 7 (6) RTI Act.
I have considered the written submissions of the Appellant and gone through the available
record of both appeals filed, the CPIO is directed to go through the record ofNGT and take
assistance of concerned officials 1branches and provide appropriate response to the original
RTI Application.
CPIO is directed to response to query No. (7) to (10) by transferring to Supreme Court of
India under Section 6 (3) of RTI Act with a request that Public Information Officer directly
reply to Appellant within the legal prescribed time limit.
In regard to queries No. (11), (12), (13), (14), (15), the copy of Original Application is directed
to transfer ,to concerned PIO of Delhi Traffic Police who shall directly provide response 1
reply to Appellant within the legal prescribed time limit.
CPIO is further directed to response to remaining queries No. (1) to (6), (16) & (18) to
Appellant within the legal prescribed time limit alongwith relying documents, notings, memo
1order, if any.
Both the Appeals are disposed of accordingly. Copy of order be sent to Appellant and CPIO
for compliance.
Copy of the order shall be placed in both the Appeals.

compliance ofRTI petition, provided a totally eyewash reply trying to evade the queries in most irresponsible
manner.UndersignedpetitionermaderepeatedtelephoniccallsatNGTforanearlyresponsetotheRTIpetition.But
perhaps such a long delay in response to RTI petition might also be due to discomfort likely to be caused to
concernedonesatNGTthroughqueriesofthisRTIpetition.
Learned CPIO in a totally evasive response to queries (7), (8), (9), (10), (11), (13), (14) and (15) ofRTI petition
replied that Information is notavailable with the department! Iappeal that learnedCPIOmay kindly bedirected to
respond to queries ofRTI petition byseekingassistance ofconcernedones at otherdepartments ofNGT including
also HonourableChairperson ofNGTand driverShriPradeepKumarwho both happen to beaccountable
underRTf Act, underprovisionsofsection5(4)ofRTIAct. Orelse,my RTI petitionmaykindlybedirectedto be
forwarded/transferredetctoconcernedonesundersection6(3)ofRTIActunderintimationto me.
LearnedCPIOin replytoqueries(7)to(10)repliedthatInformationis notavailablewiththe department. Sincecar-
stickers ofSupreme Courtare issued with utmost care, this particular information ifnot available withNGT, must
be available with Supreme Court. As such incase information to query (7)to (10) is notavailable withNGT, then
my RTI petition may kindlybedirectedto betransferred to Supreme Courtundersection 6(3)ofRTIAct for these
queriesunderintimationtome.
Response to query (12) does not fit to the query. I asked for name ofthe driver ofthe car bearing registration-
number DL8CBG-0009 having parked the car in 'No-tolerance zone' in Chandni Chowk outside Dariba (Delhi)
around 2 pm on 16.10.2013, and not just name ofthe regular driver ofthe car bearing registration-number
DL8CBG-0009. I appeal that learned CPIO may kindly be directed to re-visit the query for a truthful and proper
response if necessary after seeking assistance of concerned ones including also the driver Shri Pradeep Kumar.
Learned CPJO in response to query (16) replied that appropriate steps are being taken in compliance of the Traffic
Rules, but without any copy offile-notings/correspondence/documents etc in this regard. There must be some office-
memos/orders etc in this regard as per response to query (16). I appeal that all related documents relating to response
to query (16) may kindly be directed to be provided but now free-of-cost under section 7(6) ofRTI Act.
All sought and related documents are now to be provided free-of-cost under section 7(6) of RTI Act. It is prayed
accordingly.
