Plaintiffs filed a motion to supplement to bring this Courts attention to factual
developments that occurred after the pending motion for preliminary injunction was fully briefed

and argued. In casting about for a counterweight to Judge Stones granting of J.s stepparent
adoption, Defendants now attempt to further supplement the record with information about an
unrelated case that was resolved a month before Defendants filed their opposition to the
preliminary injunction. Defendants have already raised new cases and legal arguments for the
first time on the eve of and even in the middle of oral argument. But their latest attempt to
raise new arguments that they failed to raise in a timely manner is a bridge too far.
In any event, Judge Fausts ruling in Doe is irrelevant to this case. Judge Faust denied a
TRO but purposely avoided ruling on the merits of the Doe plaintiffs claims. In contrast, Judge
Stones grant of Js stepparent adoption petition was a ruling on the merits after full briefing.
That adoption would not have been possible without concluding that Mr. Milner and Mr.
Barrazas marriage is valid and can be recognized as a basis for granting related legal rights,
regardless of the stay in Kitchen.
For these reasons, the Court should allow and consider Plaintiffs proposed
supplementation, and disregard Defendants improper, implied motion to admit and consider the
private proceedings in the Doe case.
