Managing Youth Resistance


Under DYS policy 301.05, use of force is limited to exceptional circumstances when all other appropriate pro-active, non-physical behavioral management techniques have been exhausted. When force is deemed necessary, staff are to employ only the minimum amount of physical control necessary to stabilize the situation. The use of physical force, as a last resort, is limited to the following circumstances: When a youth is currently physically violent and poses an immediate danger towards self or others, or When a youth is affirmatively physically resisting institutional rules and poses an immediate danger to self or others, Or when a youth is causing a serious disruption where there is a clear enforcement necessity to move the youth. A written report is prepared following all uses of force and is submitted to the Facility Intervention Administrator (FIA) for review.

Use of Force Review


The FIA completes the review within two business days of receiving the incident packet. The process includes review of all documentation, as well as video, to ensure that the use of force complies with DYS standards. The FIA may deem the use of force as appropriate and within policy guidelines, recommend informal training for staff involved, or recommend that the use of force be handled through investigation. The report is reviewed by several administrators. For quality assurance purposes, 10 percent are selected for the Superintendents review.

Key Statistics
There were 2,733 total use of force incidents reported in 2013 throughout DYS facilities, a 11.0 percent increase from 2012. The overall rate of use of force incidents per youth increased from 4.69 incidents per youth in 2012 to 5.93 in 2013. Circleville JCF had both the largest total number of use of force incidents, with 1,033 incidents, and the highest rate of use of force per youth in 2013. In 2013, Indian River JCF had the highest number of interventions involving a mechanical restraint, totaling 1,098 and reported the highest number of hours that mechanical restraints were utilized, totaling 392.3 hours.
