WHEREAS M/s. Kwality Food Services (P) Ltd., 137-A, Jhaw Talla Road, Kolkata-700
016 , West Bengal having office at 122, Karnani Mansions, 21, Park Street, Kolkata-700 016 is
an establishment covered under the Employees Provident Fund & Miscellaneous Provisions
Act, 1952 (hereinafter referred to as the said Act) have failed to remit the statutory dues
under the said Act amounting to Rs. 64,996.89 (Rupees sixty four thousand nine hundred
ninety six and paise eighty nine only) for the period 12/94 to 2/2002.

AND WHEREAS it is understood that M/s.Calcutta Club Ltd. is a Sundry Debtors of the
establishment M/s. Kwality Food Services (P) Ltd Code No. WB/34898 and a substantial
amount is payable by M/s. Calcutta Club Ltd. to the said establishment to M/s. Kwality Food
Services (P) Ltd.

AND WHEREAS in exercise of the powers conferred on me under Section 8F(3)(i) of the
said Act, M/s. Calcutta Club Ltd. was directed / ordered to pay the amount payable within the
stipulated period, by way of a Demand Draft drawn in favour of Regional Provident Fund
Commissioner, West Bengal being part /full realization of the Statutory dues noted above, by
the establishment has failed to remit the amount till date.

AND WHEREAS under the provisions of Sec. 8F(3)(x) of the said Act any person to
whom the notice under the Sub-Section is sent, fails to make payments in pursuance thereof
to the Regional Provident Fund Commissioner so authorized on this behalf shall be deemed to
be an employer in default in respect of the amount specified in the notice.

AND WHEREAS it is understood that M/s. Kwality Food Services (P) Ltd,
Director(s)/Partner(s) of the said establishment are maintaining the above mentioned
establishment as defined U/S 2(C) of the said Act are liable for remitting the above said dues.
Now, therefore, in exercise of the powers conferred on me U/S 8F(3)(i) of the said Act you are
hereby ordered to pay Rs. 64,996.89 (Rupees sixty four thousand nine hundred ninety six and
paise eighty nine only) or such sum standing to their credit within three days of receipt of this
order by way of Demand Draft being the amount payable by the above mentioned defaulter.
Should the amount to their credit be less than the above mentioned arrears and further if any
amount that may be credited to their account at any time subsequent to the receipt of this
order or any fixed deposit or their deposits that may be standing to the credit of the above
mentioned establishment / persons of which may be credited subsequent to this order be
made over to the Regional Provident Fund Commissioner, West Bengal until the above
mentioned arrears are remitted by them. The Demand Draft drawn in favour of Regional
Provident Fund Commissioner, West Bengal may be sent to the undersigned by Registered
Post. It may be noted that as per the provisions of Sec. 8F (3)(iv) of the said Act, 1952 every
person to whom an order is issued under this Sub- Section shall be bound to comply with
such notice, and in particular where any such notice is issued to a Post Office, Bank or an
insurer, it shall not be necessary for a Pass Book, deposit policy or any other document to be
produced for the purpose for any entry endorsement or the like being made before payment is
made not withstanding any rule, practice or requirement to the contrary.

It may further be noted under the provisions of Section 8F(3)(x) of the said Act, any
person to whom the notice under this Sub Section is sent, fails to make payments shall be
deemed to be an employer in default in respect of the amount specified in the notice and
further proceedings shall be taken against him for the realization of the amount as if it were
an arrears due from him in the manner provided Under Section 8B to 8E of the said Act and
this order shall have the same effect as the attachment of a debt by the Recovery Officer in
exercise of his powers under Section 8B of the Act.

It is also to be kept in view that if any amount is due from an employer (whether in
respect of the employees contribution deducted from the wages of the employees or the
employees contribution) the amount so dues shall be deemed to be the first charge on the
assets of the establishment, and shall not withstanding anything contained in any other law for
the time being in force, be paid in priority to all other debts vide Section 11(2) of the
Employees Provident Fund and Miscellaneous Provisions Act, 1952.

Road,Jagatdal,24 Parganas (North),West Bengal having office at 116/1/1 Mahatma Gandhi

Floor), Kolkata 700 007 is an establishment covered under the Employees Provident
Fund & Miscellaneous Provisions Act, 1952 (hereinafter referred to as the said Act) have failed
to remit the statutory dues under the said Act amounting to Rs. 6,25,27,832/- (Rs. six crores
twenty five lacs twenty seven thousand eight hundred thirty two only) for the period up to
4/85, 10/88 to 10/89, 2/90 to 5/92, 8/94 to 9/94 & 5/95 to 10/95.

And whereas it is understood that you are a Sundry Debtor of the establishment and a
substantial amount is payable by you to the said establishment.

Now, therefore, in exercise of the powers conferred on me under Section 8F(3)(i) of the
said Act, you are hereby ordered to pay the amount payable by you to the said establishment
forthwith by way of a Demand Draft drawn in favour of Regional Provident Fund
Commissioner, West Bengal being part /full realization of the statutory dues noted above. The
said Demand Draft may please be sent to the undersigned by name through Authorized
Representative or by Registered Post. It may be noted that this order will remain in force till
such amount payable by you to the said establishment squares up the amount as aforesaid or
it is withdrawn by the subsequent order.

It may also be noted that as per the provisions of Section 8F(3)(iv) of the said Act,
every person to whom an order is issued under this sub section shall be bound to comply with
such notice notwithstanding any rule, practice or requirement to the contrary.


Further more under the provisions of Section 8F(3)(x) of the said Act any person to
whom the notice under this Sub Section is sent, fails to make payments in pursuance thereof
to the Regional Provident Fund Commissioner so authorized on this behalf shall be deemed to
be an employer in default in respect of the amount specified in the notice and further
proceedings may be taken against him for the realization of the amount as if it were an arrear

If any amount is due from an employer/ establishment (whether in respect of

This has a reference to the subject cited above.

This is to bring to your kind knowledge once again that
several attachment Orders dated 28-08-2002 & 29-08-2002
have been served on Zonal Manager (East), Food Corporation
of India, 10A, Middleton Row, Kolkata- 700 071 by the
Recovery Officer, Employees Provident Fund Organisation in
respect of 11 (eleven) Jute Mills for realization of their
Provident Fund dues.

In this connection, Shri M.M. Das & Shri S.K.
Srivastava, Enforcement Officers of this department met you in
person on 02-09-2002 as per the advice of Shri S. Ganguly,
Dy. Zonal Manager (East). During the course of discussion the
following questions/queries were raised by you.

1. In the attachment Orders, nowhere it has been
specified to withhold the money lying with the
F.C.I.
2. No time limit has been mentioned in the attachment
Orders.

Your kind attention is invited to para 3 of the
attachment Orders wherein it is clearly mentioned that you are
hereby Ordered to pay the amount payable by you to the said
estt. forthwith by way of Demand Draft drawn in favour of
the Regional Provident Fund Commissioner, West Bengal
being part/full realization of statutory dues. This clearly
indicates that the Orders are applicable with immediate effect
and unless and until the amount is withheld it can not remitted
to the Regional Provident Fund Commissioner, West Bengal.
