Charge Description: Any person who is 18 or more years of age and who, except for a lack of instruction
in operating a motor vehicle, would otherwise be qualified to obtain a class D driver's license under this
chapter, may apply for an instruction permit and the department shall issue the permit. The instruction
permit entitles the applicant to drive a motor vehicle for which a class D license is valid upon the highways
for a period of two years if the permit holder: (1) has the permit in immediate possession and (2) is driving
the vehicle while accompanied by an adult licensed driver who is actually occupying a seat beside the
driver. It is a misdemeanor for any person to willfully violate any of the provisions of this chapter unless
the violation is declared by any law to be a felony or gross misdemeanor, or the violation is declared by a
sectionofthischaptertobeamisdemeanor.

Charge Description: No motor vehicle operator who is operating a motor vehicle on the streets and
highways of this state may transport a child who is both under the age of eight and shorter than four feet
nine inches in a seat of a motor vehicle equipped with a factoryinstalled seat belt, unless the child is
properly fastened in the child passenger restraint system. Any motor vehicle operator who violates this
subdivisionisguiltyofapettymisdemeanorandmaybesentencedtopayafineofnotmorethan$50.

STATEMENTOFPROBABLECAUSE

On or about November 21, 2013 at approximately 6:16 a.m., Trooper Azzahya Williams with the
Minnesota State Patrol was on patrol in a marked squad car, when she was dispatched to a traffic call
located near the on-ramp from westbound Highway 7 onto northbound Highway 100 in St. Louis Park,
HennepinCounty,Minnesota.TrooperWilliamslearnedthatagreenPontiacGrandAmbearing
Minnesota License Plate 260-LZJtraveledfromtheroadwayandintoaholdingpond.Uponarrival,
TrooperWilliamsspokewithseveralofficerswiththeSt.LouisParkPoliceDepartment.TrooperWilliams
learnedthatfivechildrenweretrappedinsidethesubmergedvehicle.TrooperWilliamsspokewiththe
driver, subsequently identified via Minnesota DVS photograph and Minnesota Instructional Permit as
MARIONNOELGUERRIDO,Defendantherein.TrooperWilliamsalsospokewithJ.D.O.,whoreported
thathedidnotseethevehiclegointotheholdingpond,butheardawomanscreaming.Hethensaw
Defendant sitting on the roof of the car in the pond, so he flagged down a passerby, asked them to call
911andwenttoassistDefendant.
Trooper Williams then spoke with Defendant, who provided the names of the five minor children, all under
theageof8years,whoweretrappedinthevehicle:A.M.C.,age7Z.M.R.,age6Z.C.M.R.,age5
A.N.L.C.,age5,andA.E.L.R,age1.Allfivechildrenwereunconsciousandinneedofurgentmedical
carewhentheywererescuedfromthesubmergedvehicle.Subsequently,A.M.C.andZ.C.M.R.passed
away.
LawenforcementlearnedthatDefendantwasthemotherofthreeofthefivechildren:A.M.C.,A.N.L.C.,
A.E.L.R.J.T.R.wasthefatherofA.E.L.R.LawenforcementalsolearnedJ.T.R.wasthefatherofZ.M.R.
andZ.C.M.R.
OfficerSiarNademwiththeSt.LouisParkPoliceDepartmenttransportedDefendanttoHennepinCounty
MedicalCenter("HCMC"herein).SergeantEricClausenwiththeMinnesotaStatePatrolandDetective
BernieBogenreifwiththeHennepinCountySheriff'sOfficemetOfficerNadematHCMC.Allthreelaw
enforcementofficialsspokewithJ.T.R.,whoreportedthatheandDefendanthadbeeninarelationshipfor
approximately three years and that earlier that morning, Defendant and the five children were in the vehicle
withhim.HedrovetohisplaceofemploymentinSt.LouisPark.J.T.R.reportedthatDefendantthen
drovethevehicleandthatA.M.C.gotinthefrontpassengerseat.Hereportedthatthefourotherchildren
wereinthebackseat.J.T.R.toldlawenforcementthatthevehiclewasnotinsuredandthatDefendant
drivesthevehicle.AcheckonthevehiclerevealeditwasregisteredtoE.J.P.,J.T.R.'scousin.J.T.R.
reportedthatA.E.L.R.wasinababy'scarseatandthattherestofthechildrenwerewearingseatbelts.
AllthreelawenforcementofficialsthenspokewithDefendant.Theyexplainedshewasnotunderarrest
anddidnothavetospeakwiththem.Defendantagreedtospeakwiththem.Defendantstatedthatearlier
thatmorning,shedroppedJ.T.R.offatwork,whichwasapproximatelytwoblockseastofHighway100.
Defendant stated that A.M.C. was in the front passenger seat and the other four children were in the back
seat.DefendantstatedthatA.E.L.R.wasinababy'scarseatandthattherestofthechildrenwere
wearingseatbelts.Defendantadmittedthatsheonlyhadaninstructionalpermittodrive.Acheckinto
Defendant's Minnesota driving privileges revealed that she did not have a valid Minnesota driver's
license.TheinstructionalpermitrequiredthatDefendanthaveanotheradult,licenseddriveroccupyinga
seatbesideheranytimesheoperatedamotorvehicle.DefendantadmittedthatsheandJ.T.R.havehad
thevehiclefortwoyears.Shedidnotknowhowthevehiclewasinsured.Defendantadmittedshehas
driventhevehiclebefore.Defendantstatedthatearlierthatmorning,shewastravelingfromwestbound
Highway7ontonorthboundHighway100.Defendantstatedthatshesloweddowntoturnandwasnot
drivingmorethan40milesperhour.Shestatedthatthevehiclejerkedtowardtheleft,towardthegrass
andpond.Shestatedshecorrectedandturnedthesteeringwheelintheoppositedirection.Shestated
thevehiclethenfishtailedandtraveledwestintothepond.

At present, Defendant is not in custody.
