"#$$is %nconstitutional ;and WHEREAS, the %&S& Su're(e Court has ruled that neither Congress nor the )resident can constitutionally authori*e the detention and+or dis'osition of any 'erson in the %nited States, or citi*en of the %nited States under the law of war who is not ser,ing in the land or na,al forces, or in the Militia, when in actual ser,ice in ti(e of -ar or 'ublic danger;and ./0 )arte Milligan, 11 %&S& !, 12334 WHEREAS, for the 'ur'oses of this resolution, the ter(s arrest, ca'ture, detention under the law of war, dis'osition under the law of war, and law of war are used in the sa(e sense and shall ha,e the sa(e (eaning as such ter(s ha,e in the !1! "#$$, Section 1!1.c4; and therefore BE IT RESOLVED, that notwithstanding any treaty, federal, state or local law or authority, enacted or clai(ed, including, but not li(ited to, an authori*ation for use of (ilitary force, national defense authori*ation act, or any si(ilar law or authority enacted or clai(ed by Congress or the 5ffice of the )resident directed at any 'erson in Madison County who is not ser,ing in the land or na,al forces, or in the Militia, when in actual ser,ice in ti(e of -ar or 'ublic danger,it is unconstitutional, and therefore unlawful for any 'erson to6 a& arrest or ca'ture any 'erson in Madison County,or citi*en of Madison County within the %nited States,with the intent of detention under the law of war,or RESTORING CONSTITUTIONAL GOVERNANCE RESOLUTION OF MADISON COUNTY, ALABAMA b& actually subject a 'ersonin Madison County to dis'osition under the law of war, or c& subject any 'erson to targeted 7illing in Madison County, or citi*en of Madison County within the %nited States;and be it further RESOLVED, that Madison County re8uests the $laba(a State 9egislature recogni*e the duty of the state of $laba(a to inter'ose itself between unconstitutional usur'ations by the federal go,ern(ent or its agents and the 'eo'le of this state, as well as the duty to defend the unalienable natural rights of the 'eo'le, all of which is consistent with our oaths to defend the Constitution of the %nited States and the constitution of $laba(a against all ene(ies, foreign and do(estic; and be it further RESOLVED, that Madison Countyre8uests ourCongressional delegation co((ence i((ediately with efforts to re'eal the unconstitutional sections of the !1!
