EMPLOYMENT CONTRACT

;+2 The employee shall be ho%sed in a s%itable accommodation shared with a
reasonable n%mber of employees+
;+= The employer will pro(ide free for wor/ers the necessary safety e>%ipment
s%ch as shoes) &lo(es) &lasses) ear pl%&s) helmets and etc+
;+7 The employee is strictly not allowed to brin& in any /ind of o%tside friends or
relati(es to stay in the accommodation that pro(ided by the Employer+

Medical treatment for site ?n'%ries will be pro(ided free by the Employer) e.cept for
self-inflicted in'%ries s%ch as se.%ally transmitted diseases or any other chronic
diseases that carry by the Employee from his own co%ntry+

"early medical e.amination will be arran&ed as re>%ired by the ?mmi&ration
Department of Malaysia and cost inc%rred will be borne by the Employer+

66+= There will be a&&re&ate 67 days of sic/ lea(e and medical e.penses will be
limited to #M700+00 per year for each wor/er0employee+ The Employee shall
be entitled for paid sic/ lea(e if certified by medically %nfit to wor/ by the
Employer1s Panel doctor+
66+7 The Employee shall be entitled for P%blic Holidays accordin& with the 8tate of
the Malaysia+
12. :ns'ran0e Co8erage an, "e0'rity 5on,
62+6 The employer shall pro(ide ins%rance co(era&e (free for the Employee$ s%ch as
3or/men Compensation 8cheme for Borei&n 3or/ers or Personal 5ccident
Policy a&ainst accident d%rin& the co%rse of employment+ ?n case of a claim
the Employer shall be responsible to help the concerned Employee to s%bmit
for the compensation+ This co(era&e in(ol(es both temporary and permanent
disability ca%sed by in'%ry and death+
62+2 The sec%rity bond shall be borne by the Employer+

6=+6 The Employer shall pay a s%m of e(y #M62<0+00 as employee e(y which
shall be ded%cted #M607+6; per month from the employee1s salary and is
s%b'ect to Malaysian ?mmi&ration aw from time to time+
1#. Transportation
67+6 The Employer shall be responsible to pro(ide s%itable transport to the
Employee0wor/er for d%ty from and to0between the wor/ site and the wor/er1s
hostel+
1(. :n0rement9 5on's an, ot7er Allo.an0es
5ny increment) bon%s and0or allowance shall be &i(en at the sole discretion of the
Employer+ The Employer shall re(iew the salary and ha(e the sole discretion to
decide for any increment) bon%s and allowances after three(=$ months of the
employment period+

1+. Transportation o* t7e ,ea, 5o,y
?n case the employee dies in the co%rse of his employment) the Employer shall be
responsible to arran&e for the repatriation of the dead body of the deceased to his ne.t
of /in in Myanmar and necessary repatriation cost shall be borne by the Employer+

1/. Tra8elling E<penses
6;+6 5ir tic/et for wor/er from Myanmar to Malaysia shall be borne by the
Employee) and %pon completion of the Employment contract the tra(ellin&
e.penses) incl%din& air tic/et from wor/ place to Myanmar shall be borne by
the Employer+
6;+2 ?n case of early termination of employment d%e to reasons as stated in the
5rticle 69 and 6A below) the Employee will f%lly pay for his own ret%rn air
tic/et from Malaysia to Myanmar+
11. Restri0tion
69+6 The employee is not allowed to en&a&e in any employment with other
indi(id%al or&anisation or instit%tion d%rin& the period of this Contract+
69+2 The Employee shall not be accompanied by his family or friends
69+= the Employee shall not cond%ct any miscond%ct and breach of any law or r%les
and re&%lation discipline and wor/+
69+7 the employee shall not commit any immi&ration (iolation or crime d%rin& his
stay in Malaysia+
69+< the employee shall not resort to any stri/e nor in(ol(e in any other tactics s%ch
as &o slow etc+ He shall not en&a&e himself in any political acti(ity and other
acti(ities related to Trade Cnion in Malaysia) nor insti&ate others to commit
s%ch acts+
69+: The Employee shall not collect any money from any other fellow0co-wor/er by
force or coercion for whatsoe(er reason+
69+; The employee shall not en&a&e himself in any romance relationship and0or
marry and0or intend to marry any Malaysia national d%rin& the contin%ance of
the period of this Employment Contract+
69+9 The employee shall strictly follow the Malaysian laws and Company1s r%les
and re&%lation which necessary imposed by the mana&ement or rele(ant
a%thorities+
14. Termination o* ser8i0e
The employer reser(es the ri&ht to terminate this a&reement by ser(in& one(6$ month
notice to the employee on the occ%rrence of any of the followin& e(ents:-
(i$ That if the Employee breaches any of the restrictions in Cla%se 69 mentioned abo(e
or is con(icted of any offence %nder any of the laws of Malaysia+
(ii$ That if the Employee1s 3or/ Permit is cancelled0withdrawn by the Malaysian
a%thorities for any reason whatsoe(er+
(iii$That if the Employee is absent from wor/ for more than three (=$ consec%ti(e
wor/in& days witho%t any reasonable e.c%se+
(i($ That if the Employee is disco(ered0fo%nd to be %nder twenty (20$ years old+
(($That if an a%thorised medical doctor certifies the Employee medically %nfit for
employment+

5ny and all disp%tes between the both parties hereto arisin& from or relation to this
Contract shall be settled amicably thro%&h m%t%al cons%ltation and in accordance
with local Malaysian Employment 5ct and sho%ld be notified to the Myanmar
Embassy at D%ala %mp%r
21. )'e Per*orman0e
The fail%re of the Employer to re>%ire the performance of any item of this contract or
the wai(er of the Employer of any breach of any term of this contract by the
Employee shall not pre(ent s%bse>%ent enforcement of s%ch term) nor be constr%ed as
a wai(er of any ri&hts the Employer may ha(e %nder any term of this Contract
22. Ot7er terms an, 0on,itions
22+6 The Employer shall pay the basic salary of d%e months) if any wor/ers are
repatriated before completin& the contract period) for whatsoe(er reason+
22+2 ?f any wor/er resi&ns willin&ly on his own free will from the ser(ice) then the
air tic/et for repatriation will be borne by the wor/er+
22+= ?f the Employer terminated the ser(ice of any wor/er before completin& the
contract%al period b%t not d%e to the fa%lt of wor/er) then employer m%st
compensate d%ly to the wor/er and the air tic/et for his repatriation to Myanmar
will be borne by the Employer+
2!. Certi*i0ation
The employer and the employee shall read and f%lly %nderstand this Contact and
certify that the terms and conditions to&ether with the application constit%te their
entire a&reement+
The employer and the employee %nderstand that the terms and conditions fa(o%rable
to the Employer and Employee) which are not mentioned in this Contract and are
pro(ided by the laws of the Co%ntry of employment) shall apply and be a part of the
contract+
