The meeting from mahaguns side was attended by Mr.

Satinder (I believe he was Mahaguns


Legal expert) and Ms. Aditi.
We presented them with the following questions. I shall write their answers as per my
understanding and my other friends who attended the meeting may add on to it or correct me. I
shall refrain from drawing any conclusions. It is up to all to comment.

Questions and Answers
Ques. 1 When land was acquired by Noida authority for the Mahagun Moderne Group
Housing?
Ans:- Mahagun had got possession of land in May, 2010 after having gone through two
tier bidding process. They were at that point not sure when the land was acquired by Noida
authority. Ms. Aditi offered to find that out and inform.
Ques. 2 Under which notification this land was acquired i.e. is it the same notification i.e.
the one dated January, 15
th
, 2009 under which the greater noida land was acquired or some
other? Also was it post 2009 notification or before that?
Ans 2. They offered to find out.
Ques 3. Whether all claims of farmers have been settled or not? Specifically the promise of
developed land promised to farmers has been given to them or not by noida authority.
Ans 3. The officials stated that to their knowledge all claims of farmers are settled and
there is no case pending. Regarding allotment of land to farmers in same sector they said that it
would not be done within this project. They said that the project was in perfect dimensions
meaning thereby a perfect rectangle and not hap hazard like some other projects in this area
and hence it seems that all the issues of farmers were settled and all the intermediate land
acquired.
Ques 4. Whether the master plan, area plan and plans for all buildings have been
sanctioned?\
Ans 4. They said that all the plans on the Moderne have been sanctioned and project is
progressing fast.
Ques 5. Are there any cases of farmers pending before any court in UP wherein the land of
Mahagun Moderne Group Housing is a subject?
Ans 5. Mahagun officials said that they are not party to any litigation between the
farmers and noida authority as far as moderne is concerned. They said they are not aware of any
such litigation. They are undertaking efforts to find out about any pending litigations.
Ques 6 How much amount Mahagun owes the Noida Authority and the Banks?
Ans 6. This is internal to the Mahagun accounts and they did not want to disclose.
Ques 7 What steps mahagun is taking to tide over the situation?
Ans 7. They said that they are doing their due diligence and are willing to accept any
inputs from us. They said that we should also participate and find out any relevant information.
They offered to go anywhere with us/visit any departments of noida authority to find out more.
Ques 8. How would Mahagun tide over the situation if the worst happens in this area? Is the money
paid by the Investors safe?

Ans 8. They said money is safe and there are various clauses in the agreement to signify that. They
promised that there would be no escalation of prices because of this agitation.

We also saw the lease deed and possession certificate but because of paucity of
time could not scan through the entire lease deed. The other relevant observations
were:-
1. Mahagun has registry/possession of the entire land for which they had bid i.e.
entire area of Moderne. It means that if mahagun bid for 10,000 sq meters then
they have bonafide registry/possession of entire land. This according to them is
not the case for all the builders. Some builders in that area had won bids for a
larger area but got possession for a lower area and thus had registry/possession
for a smaller area. The remaining area for which these builders did not get
possession was disputed area. So mahagun modern is clear according to them.
2. Mahagun officials are in process of due diligence and would undertake
efforts to find out about any cases pending in relation to modernes land.
3. Mahagun officials stated that there would be no escalation on the project on
this count. If there is any escalation then the same shall be charged from new
clients who would buy this project and not all of us.
4. We made specific mention of the dire need on their part to post pictures of
construction progress on their website. Mahagun officials offered to do so every
two months and have decided to start a open letter.
I feel the next crucial date is June 15
th
. This was the deadline set by farmers in Noida before
which they want settlement of their claims from Noida Authority as per article shared by Mr.
Akash. So we have to keep our eyes and ears open.
