!er the Agreement' we have subscribed to transmission o SMS Messages to Subscribers via SITI!" Messaging

:uring the term o the Agreement we shall make a continuous eort to strictly com*ly with the a**licable Telecom 7egulatory Authority
o India rules and regulations (;T7AI 7egulations<) in orce including but not limited to regulations a**licable or the .ational )ustomer
!reerence 7egistry (;.)!7<) commercial communications and or the content o the SMS Messages4
>e shall strictly com*ly with T7AI 7egulations a**licable to the SMS Messages as stated in the below *oints4
(a) Any virus and malicious code that might disru*t' disable' harm' erase memory o' or otherwise im*ede o*erations' or unctions o
any sotware' hardware' wireless device' com*uter or any network
(b) Any vulgar' obscene content' adverse' oensive & derogatory reerence to (i) cor*orations or brands? (ii) any *ersonality' living
or dead? (iii) communities' living or e+tinct? (iv)to any city' building' geogra*hical eature' etc4 that can be singularly & uni@uely
identiied in the world? (v) gender and (vi) *hysical & racial attributes4
(c) Any content' which is lascivious or a**eals to the *rurient interest or the eect whereo is such as to tend to de*rave or corru*t
any *erson4
(d) Any content' the *resentation' dissemination or disclosure whereo' inringes any intellectual *ro*erty right or conidentiality
obligation
(e) Any content which SITI!"' acting in its sole discretion' declares to be o**osed to standards o morality or decency' or to be
o**osed to *ublic *olicy or any adverse' oensive & derogatory reerence to any SITI!" or any other com*anies' organiAations'
religious associations' *olitical *arties' governments (state and central)' anyoneBs *rivate lie' any other commercial and nonC
commercial entities4

For Transactional Messages' the e+act message content o the messages that will be sent through the Transactional message account
*rovided to us by SITI!" is shown in Anne+ure A4 >e agree to send no other messages than what is shown in Schedule A without the
e+*ress written consent o SITI!"4
For Transactional Messages' the internal *rocess we will ollow to ensure that no messages other than what is shown in Anne+ure A will be
sent through the Transactional message account *rovided to us by SITI!" is described in Anne+ure B4 >e agree to ollow this *rocess
without ail' and agree not to change this *rocess without the e+*ress written consent o SITI!"4
For activation o a Transactional message account' SITI!" reserves the right to re@uest a de*osit against the allocation o the service
account4
>e undertake to com*ensate' indemniy' deend' and hold SITI!"' its oicers' directors' agents' and em*loyees (each' an ;Indemnitee<
and collectively' the ;Indemnitees<) harmless rom and against any and all liabilities' damages' losses' e+*enses' claims' demands' suits'
ines' or Gudgments (collectively ;)laims<)' including reasonable attorneysH ees' costs' and e+*enses incidental thereto' which may be
suered by' accrued against' charged to' or recoverable rom any SITI!" Indemnitee' by reason o any )laim arising out o or relating to
the content o the SMS Messages4 .)!7 Iiolations' breach o T7AI 7egulations by )ustomer' breach o )onidential Inormation and&or
third *arty intellectual *ro*erty by )ustomer' any act' error or omission' or misconduct o )ustomer' its oicers' directors' agents'
em*loyees' customers and subcontractors' during the *erormance o this Agreement' including' without limitation' )laims arising out o or
relating to9 (a) bodily inGury (including death) or damage to tangible *ersonal or real *ro*erty? (b) violation o any law or regulation? or (c)
breaches o any re*resentations made in this undertaking or Agreement4
>e acknowledge and agree that SITI!" may either review or disclose the content o such SMS Messages transmitted as it deems
reasonably necessary or convert a transactional service account into a *romotional account at its sole discretion4
Incase i any com*laint register rom your account or user id' Jou will have to revert with all the details and valid *roo within D$ hours
rom time com*laint has been raised4 In case you ail to *roduce valid *roo or donBt not res*ond then we will treat as a valid com*laint and
ortiy the *enalty charges4
>e understand that or any deviation on the above *oints SITI!" has the right to (a) terminate the Agreement? (b) deactivate our account? (c) levy
*enalties and (d) take a**ro*riate legal action and claim com*ensation4 Any deviation or violations rom the above *oints by us will attract a ine o
