Tissystemofreviewandapprovalrequirementsisintendedtoensureadequateoversightandmonitor-
ingofMCC-fundedprocurementactivities,helpdetecterrorswhentheycanbeeasilycorrectedandto
otherwiseavoidproblemsinsuchprocurementactivities.Itissubjecttomodicationorexceptionat
anytimebyMCC.
P..a TeMCAEntityshallensurethatallprocurementactionsdescribedinAttachment forgoods,works,
consultantandnon-consultantservicesinfurtheranceoftheCompactandfundedinwholeorinpart
byMCCfundingshallbesubjecttothepriorapprovaloftheMCAEntitysProcurementDirectoror
boardofdirectors(orequivalentgoverningbody)forthecorrespondingtypeofactionordollaramount

Part 15. Combating Tracking in Persons
P15.1 Background
MCChasazerotolerancepolicywithregardtotrackinginpersons.Trackinginpersons(TIP)isthecrimeof
usingforce,fraud,andiorcoerciontoexploitanotherperson.Humantrackingcantaketheformofdomesticser-
vitude,peonage,forcedlabor,sexualservitude,bondedlabor,andtheuseofchildsoldiers.Tispracticedeprives
peopleoftheirhumanrightsandfreedoms,increasesglobalhealthrisks,fuelsgrowingnetworksoforganized
crime,andcansustainlevelsofpovertyandimpededevelopment.TeU.S.Government,ledbytheDepartmentof
State,iscommittedtomakingprogressagainsttheglobalcrimeandhumanrightsabuseofTIP.MCCiscommit-
tedtoworkingwithpartnercountriestoensureappropriatestepsaretakentoprevent,mitigate,andmonitorTIP

P15.2 Dened Terms
Forthepurposesoftheseprovisions,thetermssetforthbelowaredenedasfollows:
P.a. coercionmeans(a)threatsofseriousharmtoorphysicalrestraintagainstanyperson,(b)anyscheme,
plan,orpatternintendedtocauseapersontobelievethatfailuretoperformanactwouldresultin
seriousharmtoorphysicalrestraintagainstanyperson,or(c)theabuseorthreatenedabuseofthelegal
process.
P.a.a commercialsexactmeansanysexactonaccountofwhichanythingofvalueisgiventoorreceivedby
anyperson.
P.a. debtbondagemeansthestatusorconditionofadebtorarisingfromapledgebythedebtorofhisor
herpersonalservicesorofthoseofapersonunderhisorhercontrolasasecurityfordebt,ifthevalue
ofthoseservicesasreasonablyassessedisnotappliedtowardtheliquidationofthedebtorthelength
andnatureofthoseservicesarenotrespectivelylimitedanddened.
P.a. employeemeansanemployeeofabidder,supplier,contractor,subcontractor,consultant,orsub-con-
sultantdirectlyengagedintheperformanceofworkunderthecontractwhohasotherthanaminimal
impactorinvolvementincontractperformance.

ofseriousharmto,orphysicalrestraintagainst,thatpersonoranotherperson,(b)bymeansofany
scheme,plan,orpatternintendedtocausethepersontobelievethat,ifthepersondidnotperformsuch
labororservices,thatpersonoranotherpersonwouldsuerseriousharmorphysicalrestraint,or(c)by
meansoftheabuseorthreatenedabuseoflaworthelegalprocess.
P.a.6 fraudmeansanyactoromission,includinganymisrepresentation,inordertoinuence(orattemptto
inuence)anypersontoengage(knowinglyorunknowingly)inanyoftheactivitiesprohibitedbythis
Part.Examplesoffraudinclude,butarenotlimitedto,falsepromisesforspecicemployment,prom-
isesofmoneyorothercompensationthatisneverpaid,workingconditionsthatarenotaspromised,
andapersonbeingtoldheorshewouldreceivelegitimateimmigrationpapersorlegalauthorizations
necessarytoworkthatareneverreceived.
P.a.; involuntaryservitudeincludesaconditionofservitudeinducedbymeansof(a) anyscheme,plan,or
patternintendedtocauseapersontobelievethat,ifthepersondidnotenterintoorcontinueinsuch
conditions,thatpersonoranotherpersonwouldsuerseriousharmorphysicalrestraint,or(b)the
abuseorthreatenedabuseofthelegalprocess.
P.a., severeformsoftrackinginpersonsmeans(a)sextrackinginwhichacommercialsexactisin-
ducedbyforce,fraud,orcoercion,orinwhichthepersoninducedtoperformsuchacthasnotattained

labororservices,throughtheuseofforce,fraud,orcoercionforthepurposeofsubjectiontoinvolun-
taryservitude,peonage,debtbondage,orslavery.

P15.3 Prohibition
MCChasadoptedazerotolerancepolicyregardingTIP.Bidders,suppliers,contractors,subcontractors,consul-
tants,sub-consultantsandanyoftheirrespectiveemployeesshallnot:
a. engageinsevereformsoftrackinginpersonsduringtheperiodofperformanceofanycontract
funded,inwholeorinpart,withMCCfunding,
b. procurecommercialsexactsduringtheperiodofperformanceofanycontractfunded,inwholeorin
part,withMCCfunding,or
c. useforcedlaborintheperformanceofanycontractfunded,inwholeorinpartwithMCCfunding.

P15.4 Requirements
a. Eachbidder,supplier,contractor,subcontractor,consultantorsub-consultantshall:
i. notifyitsemployeesof(i)MCCszerotolerancepolicywithregardtoTIPandtheprohibited
activitiesdescribedinsectionP.,and(ii)theactionsthatwillbetakenagainstemployeesfor
violationsofthispolicy.Suchactionsmayinclude,butarenotlimitedto,removalfromthecon-
tract,reductioninbenets,orterminationofemployment,and
ii. takeappropriateaction,uptoandincludingtermination,againstemployeesorsubcontractorsor
sub-consultantsthatviolatetheprohibitionssetoutinsectionP..
b. Eachbidder(whethertobeasupplierorcontractor)orconsultant,aspartofitsbidorproposal,shall:
i. certifythatitisnotengagedin,facilitating,orallowinganyoftheprohibitedactivitiesdescribed
insectionP.forthedurationofthecontract,
ii. provideassurancesthattheprohibitedactivitiesdescribedinsectionP .willnotbetoleratedon
thepartofemployeesorsubcontractors,orsub-consultants(asthecasemaybe),ortheirrespec-
tiveemployees,and
iii.acknowledgethatengaginginsuchactivitiesiscauseforsuspensionorterminationofemploy-
mentorofthecontract.
P15.5 Notication
Abidder,supplier,contractor,subcontractor,consultantorsub-consultantshallinformtheMCAEntityimmedi-
atelyof:
a. anyinformationitreceivesfromanysource(includinglawenforcement)thatallegesitsemployee,
subcontractor,sub-consultant,ortheemployeeofasubcontractororsub-consultant,hasengagedin
conductthatviolatesthispolicy,and
b. anyactionstakenagainstanyemployee,subcontractor,sub-consultant,ortheemployeeofasubcon-
tractororsub-consultant,pursuanttotheserequirements.
P15.6 Remedies
InadditiontootherremediesavailabletotheMCAEntityorMCC,abidders,suppliers,contractors,subcontrac-
tors,consultants,orsub-consultantsfailuretocomplywiththerequirementsofthisPartmayresultin:

a. requiringthesupplier,contractor,subcontractor,consultantorsub-consultanttoremovetheinvolved
employeeoremployeesfromtheperformanceofthecontract,

c. suspensionofcontractpayments,
d. lossofincentivepayment,consistentwiththeincentiveplansetoutinthecontract,ifany,forthe
performanceperiodinwhichtheMCAEntityorMCCdeterminednon-compliance,
e. terminationofthecontractfordefaultorcause,inaccordancewiththeterminationclauseofthe
contract,and
f. suspensionordebarmentofthebidder,supplier,contractor,subcontractor,consultantorsub-consul-
tantfromanycontractfunded,inwholeorinpart,withMCCfunding.
