Request for Public Records [Gov.

Code 6253]

TO: Santa Clara Police Department
Attention: Custodian of Records
Please provide to the undersigned the following records in your possession:
Any information relating to any person arrested and the complaints or requests received by your
department (along with the responses) as it pertains to unlawful selling, serving, storing, keeping,
manufacturing, or giving away of any controlled substance, precursor, or analog in every building or
place wherein or upon which those acts take place as specified in Health & Safety Code 11000-11651
in and around the following address:
1355 Jefferson Avenue, Santa Clara, California
The requested information will be used both to abate an ongoing public nuisance and prohibit future
reoccurrences, and, in particular, to abate a public and private nuisance at a building where controlled
substances are manufactured, sold and kept, by bringing a complaint in the Superior Court of California
for a temporary and permanent injunction pursuant to Health & Safety Code 11570-11587.
In lieu of these records, a letter or declaration from your department or its relevant peace officers
stating that such unlawful activity is known (or suspected) to occur at, near or related to this location is
sufficient for the purposes of the action.
By law, you have 10 calendar days in which to comply with this request. Authorized fees will be paid to
you on delivery, pursuant to an itemized invoice.
If you refuse to disclose the requested information, please be advised that the burden of establishing
the exemption is on your department [Gov. Code 6255, 6257.5]. Please also note that while a given
exemption may be permissive, it is not necessarily mandatory [Gov. Code 6254]. Under the
circumstances, the public interest served by making the records available clearly outweighs the public
interest served by not making the records available, in that the requested information will be used to
end drug dealing, the associated crime and the disproportional drain on police services at the subject
location.
This request is made pursuant to Government Code 6250 et seq. [see also Gov. Code 6254(f), 6256].

Affirmation of Status for Request for Information [Gov. Code 6254.2]

I have requested access to information kept and maintained by the Santa Clara Police Department as a
private citizen bringing an action to abate and prevent a Section 11570 nuisance against a known drug
house and drug dealer pursuant to Health & Safety Code 11571, and hereby affirm the following:
(1) I do not seek access to the requested information for the purposes of delivering it or offering it
to any arrested persons or persons charged with criminal offenses, nor will I purposefully deliver
or negligently cause the data to be delivered to any such persons.
(2) I agree to treat the disclosed material as confidential. Only judicial officers authorized by the
Superior Court of California will be permitted to view the information. Any information obtained
by your department shall only be used for purposes that are consistent with civil legal
proceedings [Gov. Code 6254(e)].
(3) The information requested does not endanger my safety and will not interfere with the
successful completion of any investigation by your department [Gov. Code 6254(f)(1), (2)].
(4) Under penalty of perjury, I declare that the request is being made for a governmental purpose,
specifically, to enjoin, abate and otherwise prevent a public nuisance (i.e., a drug house)
pursuant to Health & Safety Code 11570.
I am aware that I may be subject criminal penalties under Section 118 of the Penal Code if I make any
statement of material facts knowing that the statement is false or if I willfully conceal any material fact.
