A Before making an application for a plot in MI! area3 please prepare a brief pro=ect profile
covering the following points#
a6 Brief details of the product to be manufactured. If of !hemical nature3 detail
manufacturing process with flow chart and block diagram in respect of utili.ation of
land.
b6 9equirement of the area.
c6 +roposed built up area for the factory3 godown3 open storage for raw material3 if
any.
d6 *uture e0pansion3 if any3 and construction details for the same on the above
lines.
e6 /ater requirement for manufacturing - processing and domestic use.
f6 >uantity of effluent discharged in case of chemical unit :processing and domestic
separately6.g6 Investment in land3 plant and machinery.

A As a first step3 you have to apply in the application form popularly known as @/hite Application

and quantity of effluent.6

If you are applying in the capacity of a chief promoter of a proposed private limited
or a public limited company3 you should clearly mention the fact in your application.
If you are applying on behalf of a group of companies and if at the time of making
application3 it is not known as to which of the companies from your group will
implement the pro=ect or promote a new private-public limited company3 you
should clearly mention this in your covering letter and also enclose list of
companies which are likely to take part in implementation or promotion of a new
company.

submit your application for offer letter.

A "he process fee is a nonrefundable fee3 which is required to be paid along with application for offer
letter to cover the preliminary e0penses regarding scrutiny of the application. "he process fee is to
be paid by emand raft only in favour of Maharashtra Industrial evelopment !orporation. "he
present rates for process fees are as follows#

A "he offer letter is normally issued within ?) days from the date of receipt of application for offer
letter. /ithin this period3 your requirement as well as availability of land and water at the location
are considered and decision is taken by the D<and Allotment !ommitteeE to offer land.
5ffer letter is valid only for a period of ?) days from the date of its receipt and automatically lapses
at the end of ?) days. However3 Allotment Authority is competent to revalidate the offer letter at the
premium rates in force at the time of revalidation provided a suitable plot is available.
/ Wh#t !s the "e+t ste&?
A Along with the offer letter you will receive the Application for Allotment <etter or @Blue Application
*orm@ duly affi0ed with special adhesive stamp. "his final application duly completed in all respects
should be submitted by complying following#
a6 emand raft payable to Allotment Authority for the full amount of ,arnest
Money eposit :,M6 as indicated in the offer letter. :)8 percent of the total
premium amount6.
b6 In case of an e0isting partnership firm or a +rivate <imited !ompany3 the
applicant should apply as a +artner or as a irector. *or a proposed +vt. <td. !o.3
the applicant should apply as a promoter.
/ Whe" !s the Allotme"t Lette !ssued?
A "he concerned office of MI! will issue the allotment letter within ?) days from the receipt of your
application along with ,.M..
In case you do not receive the Allotment <etter within ?) days3 please get in touch or write to the
concerned office.
"he allotment letter indicates the allotment of the specific plot with plot number and area of the plot
in sq.metres
"he allottee is e0pected to pay the balance occupancy price :)8 per cent of the total premium
amount6 for the plot allotted to him within B8 days of the receipt of the allotment letter.
+lease comply with other conditions as mentioned in the allotment letter#
a6 Balance occupancy price is e0pected from the allottee within B8 days and in case
of delay beyond B8 days3 the allotment is liable to be cancelled.
b6 However3 if the allottee has difficulty in paying the balance occupancy price
within the stipulated period3 he may request the authority concerned for e0tension
of the period for payment.
c6 Allotment authority is empowered to give e0tension for payment of occupancy
price upto a ma0imum period of ?)8 days after charging interest for delayed
payment at the prescribed rate for the e0tended period beyond B8 days. At
present3 the rate of interest is ?7 F percent per annum. But the amount of interest
will be paid by allottee in advance. "hereafter the e0tension in granted.
d6 After obtaining e0tension3 please pay the occupancy price within that e0tended
period.
e6 *ailure to make payment of balance occupancy price within ?G8 days from the
date of receipt of allotment letter results in automatic cancellation of the allotment
of the plot and the ,arnest Money eposit paid by the applicant is refunded after
deducting )A service charges.
/ Whe" c#" I *et &ossess!o" of the &lot?
A After you have paid the full occupancy price :together with interest for delayed payment3 if any6
the concerned 9egional office of MI! or 'eneral Manager3 istrict Industries !entre :I!6 would
arrange to hand over the possession of the allotted plot. &imultaneously3 Agreement to lease in
e0ecuted duly paying stamp duty within H8 days. If the allottee fails to e0ecute Agreement to lease
within time period of H8 days :the date of possession will be taken into consideration for counting
the time scheduled6 the allotment cancelled.
/ C#" I mot*#*e the &lot fo *ett!"* the f!"#"c!#l #ss!st#"ce?
A Yes3 you can. You may approach the concerned 9egional 5fficer of MI!3 who will issue a !onsent
<etter on furnishing a copy of the sanction letter for the loan and the mortgage of MI! plot is
normally permitted in favour of &tate <evel *inancial Institutions3 $ational *inancial Institutions3
$ationali.ed Banks and !o%operative Banks.
However3 the permission for mortgage of MI! plot in favour of individual person or private money
lending institutions is not granted.
MI! has entered into a bi%partite agreement with the $ational and &tate <evel *inancial
Institutions3 authori.ing the concerned financial institutions to hypothecate the MI! plot without
making separate agreement in respect of allotted plot. &imilarly3 there is no need to obtain a fresh
permission for the mortgage at the time of granting additional term loan. In such cases3 a written
communication regarding additional term%loan is required to be sent to MI! within B8 days of the
disbursement of additional term loan.
&ometimes3 requests for D&econd chargeE are received from Banks in respect of /orking !apital
loans sanctioned by them. &uch requests are granted on production of $o 5b=ection !ertificate from
the concerned term%lending institutions.
"he other condition is that the allottee3 should have completed the construction of factory building
and gone production or the plant and machinery are installed or likely to be installed.
/ Ho) to e+ecute the A*eeme"t to Le#se?
A After receiving the balance amount of occupancy price :i.e. remaining )8 per cent of the premium
amount6 within stipulated time3 a mutually convenient date and time will be fi0ed by the concerned
9egional 5ffice of MI! - I! for e0ecution of the Agreement to <ease.
Agreement to <ease is to be e0ecuted in duplicate in the prescribed form. "he allottee has to pay
stamp duty as per stamp duty act and e0cite the documents of Agreement to lease within H8 days.
/ Who c#" e+ecute the A*eeme"t to Le#se?
A a6 +roprietary *irm#
In case of proprietary firm3 proprietor himself has to e0ecute in his individual capacity.
b6 +artnership *irm#
:i6 In case of an e0isting and registered partnership firm3 all the partners e0cept
minors will have to remain present for the e0ecution of Agreement to <ease.
:ii6 If any one or more partners are not available3 remaining partners can e0ecute
the Agreement to <ease provided they hold duly authenticated and specific power
of attorney.
:iii6 If the application is made in the name of promoter of proposed partnership firm3
a certified copy of +artnership eed along with registration proof and a specific
letter from the applicant :i.e. promoter6 regarding transfer and e0ecution of
Agreement to <ease in the name of +artnership firm should be produced.
c6 +rivate <imited - +ublic <imited !ompany#
:i6 In case of companies incorporated under !ompanies Act3 ?()H3 a director or
directors or any other person authorised by the Board of irectors of the !ompany
can affi0 companyIs seal to the Agreement.
:ii6 Authori.ation of the directors is to be in accordance with provisions of the seal3
clause contained in the memorandum and articles of Association of the !ompany.
:iii6 !ompanyIs resolution to the effect to be furnished.
:iv6 If the application is made in the name of +romoter of the proposed +rivate
<imited !ompany and +arty desires to e0ecute the Agreement to <ease in the name
of +rivate <imited !ompany3 a certified copy of the Memorandum and Articles of
Association3 certified copy of !ertificate of Incorporation3 !hartered AccountantIs
!ertificate3 certifying the issued and paid up capital and shareholding etc. and also
specific letter from the original applicant :i.e. promoter6 regarding transfer and
e0ecution of Agreement to <ease in the name of company should be produced.
d6 !o%operative &ocieties and other institutions#
+ersons authorised as per bye % laws or the constitution of such societies or institutions can e0ecute
the Agreement. If !o%operative &ocieties are registered under &ocieties 9egistration Act3 all the
members of the governing Body of such &ocieties can e0ecute the Agreement.
e6 +ublic -+rivate "rusts#
All the trustees of the trust have to e0ecute the Agreement.
+lease 9emember#
:i6 !ompanyJs seal or rubber stamp of the concern and individual-s should be kept
ready while e0ecuting the Agreement.
:ii6 "he Agreement to <ease is to be signed in the presence of two witnesses.
/ As #" #llottee, )h#t !s e+&ected fom me?
A 5nce the Agreement to <ease is e0ecuted3 the possession of the plot is handed over by
demarcating boundaries of the plot on site. A possession receipt is also issued to the allottee.
"he plot is to be utili.ed as per the clauses of the Agreement to <ease within a period of 8B-8C-8)
years from the date of taking over possession of the plot3 if the plot is situated in A1 B3 ! 1 K
.one respectively. "he allottee is e0pected to undertake following steps#
a6 'et the approval of building plans from the concerned @&pecial +lanning
Authority@ :i.e. ,0ecutive ,ngineer in charge of that industrial Area.6
b6 !omplete the construction of the building as per the approved plan.
c6 5btain Building !ompletion !ertificate :B.!.!.6 from the concerned +lanning
Authority.
d6 &tart to use the built%up premises constructed on the plot by installing plant and
machinery.
e6 Before construction of the building3 if the location of MI! area falls within
Mumbai Metropolitan 9egion3 $o 5b=ection !ertificate :$5!.6 is required to be
obtained from the "echnical Adviser of MI!.
f6 "he allottee should ensure to adhere to the schedule mentioned in the
Agreement to <ease and obtain B.!.!.within the stipulated period. However3 where
the plot holder is not able to obtain B.!.!. within the stipulated period3 e0tension
beyond time limit :i.e. B - C - ) years6 has to be specifically obtained from the
9egional officer of MI!. ,0tension in time limit is not granted as a matter of
routine course3 but it is granted after ascertaining the merit of the request as well
as the effective steps taken by the allottee for implementing the pro=ect. *ailure to
obtain B.!.!. within the stipulated period of B - C - ) years :or e0tended period if
such e0tension is granted6 w ould result in cancellation of the allotment and MI!
would take back the possession of the plot. "he amount of 5ccupancy +rice paid by
the allottee will be refunded after due deductions.
/ Who #e the Pl#""!"* Autho!t!es?
A All the industrial areas developed by MI! have been declared as notified areas under M9 1 "+
Act3 ?(HH and MI! has been designated as the &pecial +lanning Authority for such notified areas.
"he +lanning and development control of these notified areas are within the =urisdiction of MI! and
as such approval of Building +lans3 issuing of Building !ompletion !ertificate and granting of
occupation letter are looked after by MI!. "he levy of development charges is also within the
preview of MI! and MI! has also been empowered to decide the rate of such charges.
In view of the above3 you can approach MI! directly for all such matter like Building +ermission3
Building !ompletion !ertificate :B.!.!.63 5ccupation letter3 rainage !ompletion !ertificate etc.
/ Whe" !s the -!"#l Le#se E+ecuted?
A "he *inal <ease for a period of () years in respect of the allotted plot is e0ecuted after the allottee
has completed all stages mentioned earlier and on production of a copy of B.!.!.3 receipts regarding
payment of up to date ground rent and no dues certificate from the concerned ,0ecutive ,ngineer3
MI!.
+lease note the following points#
a6 "he plot holder has to pay ground rent of 9upee one per plot per annum in
advance on or before ?st 2anuary of every calendar year.
b6 "he intending allottee of plot is not allowed to transfer and -or dispose of the
allotted plot without prior written consent from the !orporation.
c6 &ub%letting of the factory building constructed on the allotted plot or any par of
the plot is not allowed without prior permission of the corporation in written.
d6 "he plot holder is liable to pay all rents3 ta0es and assessment dues under the
law in force and also to pay service charges for maintenance of roads3 drainage3
water supply etc.
e6 "he plot holder has to comply with the terms and condition of the Agreement to
<ease - *inal <ease as the case may be and also the laws3 rules and regulations in
force.

ue to the various reason3 if allottee is not in a position to complete the construction work and
obtain B!! or started the production3 after e0piry of prescribed time limit as follows4 By considering
the progress of the work and effective steps taken by the allottee3 MI! may take the decision for
granting further e0tension on recovery of non refundable additional premium i.e. )A of the premium
rate prevalent on the date of e0piry of time limit.

i6 ,0tension of time limit for producing the B.!.!. is not automatic. ,ach case is
decided by the 9egional 5fficer or the !hief ,0ecutive 5fficer3 as the case may
be3 strictly on merits taking into account all the relevant factors such as the
reasonableness of the request3 steps taken for implementation and the
difficulties encountered by the allottee.
ii6 Mnder no circumstances3 the payment of additional premium for e0tension is
waived.
iii6 "here is no prescribed format or process fee for applying for e0tension. "he
application on plain paper will be accepted and processed by the concerned
authority.

A At the Head 5ffice of MI!3 as well as at all the 9egional 5ffices3 <and
Allotment and 'rievances !ommittees have been set up consisting of &enior 5fficials of MI! :land3
planning and engineering sections63 irectorate of Industries and other promotional agencies like
&I!5M3 M&*! etc. "hese committees meet every week on a fi0ed day. You do not need a prior
appointment to appear before the !ommittee and you can take up any problem regarding plot
allotment3 possession3 change of location of the plot3 building plan approvals3 e0ecution of lease3
consent for mortgage etc. "he committee at the Head 5ffice :chaired by our 2t. !,56 meets every
Monday at B.88 p.m. You may please ascertain from the concerned 9egional 5ffice3 the fi0ed day for
the weekly meeting in the 9egional 5ffice.

affected persons when accompanied by true copies of certificates from concerned
authorities will be given preference. &o also woman entrepreneurs. "echnocrats 1
$9IJs will be given priority in land allotment.

7 If the application is preferred on behalf of partnership firm 3 names of all the partners should be
furnished3 indicating their shares. !opy of the +artnership eed should also be enclosed.
If the application is preferred on behalf of an e0isting !ompany3 +rivate or +ublic <imited3 a copy of
Memorandum and Articles of Association of the !ompany3 together with certificate of incorporation
and a copy of the Board resolution authoring the application to apply on behalf of the company
should be enclosed.
If the application is being made in the capacity of the promoter of proposed company or proposed
partnership3 it may clearly be stated D +romoter of proposed +rivate - +ublic <td. !o. and names of
all the promoters be indicated. In case of proposed partnership firm please state D +romoter of
proposed +artnership *irm E giving names of all the partners.
If it is &ociety whether it is registered under the !o%operative &ocieties Act or &ocieties 9egistration
Act3 may be stated clearly. etails of the 9egistration number and date may be given along with
copy of 9egistration !ertificate. If the application is made as promoter of the proposed !o%operative
society3 names of the promoters with names of the members of the proposed society may be given.
B As per 'overnment of IndiaJs definition3 &mall &cale Industry :&&I6 means an industrial unit having
investment in plant 1 Machinery up to 9s. ?88.88 lakhs. All other units having investment more than
above limits fall under <arge &cale Industry :<&I category.
C +lease attach a brief profile :$ot a pro=ect report6 indicating the salient features of the pro=ect to
help us in assessment of the need based land requirement of your pro=ect along with future
e0pansion plans3 if any.
) Area of plot may be estimated keeping in mind the following factors
a6 <and is given by MI! to accommodate the reasonable requirements of the proposed Industrial
Mnit covering a span of B phases of :each phase of five proposed Industrial Mnit covering a span of B

ground coverage.6
