EXPLOSIVES REGULATIONS, 1970

In exercise of the powers conferred on the Minister responsible for Lands and Mineral
Resources by section 5 of the Explosives Ordinance (Cap. 254) these Regulations are made
this day of 1970.

Division 1

CONVEYANCE AFTER LANDING

1. Unless the Comptroller of Customs otherwise directs all explosives when first imported
or conveyed coastwise shall immediately after being put on shore be conveyed to an
explosives magazine duly appointed by the prescribed officer.

2. If the explosives are not effectually protected from accident by fire from without by
being conveyed in the interior of a carriage which is enclosed on all sides with wood or
metal they shall be completely covered with painted cloth, tarpaulin, wadmill tilts or
other suitable material, so as to effectually protect the explosives against fire.


3. Where explosives are conveyed in any motor vehicle such explosives shall only be
conveyed between the hours of sunrise and sunset.

4. Any motor vehicle when conveying explosives shall carry in front and rear a red flag
bearing letter E in black so affixed as to be clearly visible.


5. No motor vehicle while conveying explosives shall exceed a speed of forty miles per
hour.

6. Any motor vehicle conveying explosives shall be accompanied by the holder of a
Certificate of Competency issued under sub- regulation (2) of regulation 177 of the
Mining Rights Regulations or, when such holder is not available, shall be under police
escort unless a special police permit to dispense with such requirements be obtained.


7. A person whilst conveying explosives or whilst on, in or attending any carriage
containing explosives or whilst acting as watchman over any explosives shall not
smoke.


8. Whilst the conveyance of explosives is going on all persons engaged in such conveyance
shall observe all due precautions for the prevention of accidents by fire, explosion or
concussion and for preventing any unauthorized person from having access to the explosives
so being conveyed, and shall abstain from any act whatever which tends to cause fire.

of such explosives, or of any article carried therewith, and for preventing any other person
from committing any such act; and any such person who, after being warned, commits any
such act shall be deemed to commit a breach of this regulation.

9. Detonators shall not be conveyed in the same compartment of a carriage as dynamite and
other nitroglycerine compounds.
10. When cases of explosives are conveyed by carriage such cases shall be kept flat and
secured against friction.
11. Steam driven vehicles shall not be used to convey explosives.
12. No carriage conveying explosives shall be so loaded as to exceed the limits of weight
prescribed in respect of such carriage by any Ordinance for the time being ii force and the
Regulations, Orders and Rules made thereunder and the conveying of explosives by carriage
in contravention of such prescribed limits shall be an offence against these Regulations.

13. (1) The conveyance of explosives shall proceed with due diligence between the coast and
their proper destination. No explosive shall be kept in any building used at the same time as a
dwelling place. At resting places on overland journeys explosives shall be placed on the
outskirts of towns and villages and at a reasonable distance from any dwelling.

(2) Any carriage bearing explosives shall not proceed along the track of any railwaY, nor
shall they be allowed within twenty yards of any such track, except when crossing the same
by any recognized path or road, or when carrying the explosives to a railway station for
dispatch by train.

14. During conveyance overland, explosives shall always be in the charge of some
competent person and at resting places shall be, day and nigh adequately guarded where
necessary with the help of the police in charge of the area of such resting places.

EXPLOSIVES REGULATIONS, 1970

DIVISION 2storage

15(1) No store or magazine shall be used for the storage of explosives unless licensed for
that purpose by the prescribed officer. A license under this regulation shall specify the
maximum amount of plosives which may be stored and may require that shat explosives shall
be stored in such manner that any authorized person inspecting the store or magazine shall
be able to see each individual package, and may contain such other special conditions as the
prescribed officer may think fit; and no explosives shall be stored to a greater amount or in
manner other than that specified, permitted or required by the license:

Provided that where on the surface the quantity of explosives does not exceed a maximum of
two cases or one hundred pounds in weight, the prescribed officer may authorize the storage
of such explosives in magazines the details of which have been supplied to and approved .by
him, so, however, that such explosives shall be kept in safe and secure wooden boxes:

Provided further that no such magazine shall be authorized which is within one hundred feet
of anything liable to ignition, or of a furnace, steam boiler, entrance or outlet of a mine, shaft
or winze in the course of sinking.

(2) A license under this regulation may be revoked by the prescribed officer on conviction of
the owner or occupier of the store or magazine for contravention of any of the requirements
or conditions specified in such license, or, if the license was issued in respect of a store or
magazine on a mining Concession on the abandonment of mining operations on the said
Concession.

(3) A prescribed officer may at any time issue a new license varying the requirements and
conditions contained in a license previously issued under this regulation and thereupon the
last mentioned license shall become void and of no effect.

16. (I) explosives magazines shall be substantial buildings capable of being made properly
secure against unlawful entry.

(2) Detailed plans and specifications shall be submitted and the approval of the prescribed
officer obtained before the Construction of any magazine is commenced.

(3) The buildings shall be constructed of stone, concrete, or any combination thereof.

(4) Partitions and shelves shall be of timber with all nails and crews countersunk and the
holes filled.

(5) The whole of the interior including fittings shall be painted or varnished,

(6) No cases of explosives shall be stored within twelve inches of any wall of a magazine.

(7) The bottom row of cases of explosives shall be not less than six inches above the floor
and the bottom of the top row shall be riot more than six feet above the floor.

(8) The horizontal distance between two rows of cases of explosives shall be not less than
two feet six inches.

(9) Cases of explosives shall be stored in regular layers so that a regular turnover is assured
and the cases easily inspected.

(10) The magazine shall be surrounded by a ramp of loose earth to the height of the eaves
except in the case of an adit magazine which shall have an earth ramp in front of the
entrance carried to a height equal to the height of the adit.

(11) The floor of the magazine shall be of concrete rendered with cement and wooden duck
boards easily removable shall be laid on top of the concrete floor between each row of cases
of explosives. All metal screws or nails used in the construction of the duck boards shall be
countersunk and the holes filled.

17. Every explosives magazine shall be provided with an efficient lightning conductor.

18. No smoking shall be allowed in or near any part of any explosives magazine nor shall any
fire be allowed near the same.

19. No material such as cotton-rags or waste shall be admitted in any explosives magazine
except for immediate use and to be removed immediately after.

20. No person shall enter any explosives magazine with boots or shoes having iron nails, nor
shall he carry or have about him any fire, matches, or any substance or article likely to cause
explosion or fire, nor any steel, iron or grit, but a light of a type approved by the prescribed
officer or some person thereunto authorized by him may be used.

21. No cultivation, shrubs or weeds shall be permitted within a distance of 25 yards from any
explosives magazine.

22. The windows and doors of every such magazine shall be opened each day according to
the state of the weather and great care shall be observed regarding their being closed each
evening.

23. In cases where it is necessary to open a package containing explosives, care shall be
taken to remove it to a safe distance from the explosives magazine, where it shall be opened
and reclosed with great care.

24 Care shall be taken to prevent Concussion in the storage of explosives in any explosives
magazine, and no other materials than explosives shall be allowed in any such magazine.

25. Whenever it is necessary to repair any explosives magazine, the explosives shall be
removed to a safe distance there from until the repairs are completed.

26. All explosives magazines shall be opened without let or hindrance to inspection by the
prescribed officer, or any other officer appointed by him to inspect explosives magazine.

27. It shall be lawful for the prescribed officer or any other officer appointed for the purpose
by him to order the destruction of any explosive found in a magazine, which in his opinion has
become unfit for use, and the same shall be forthwith destroyed, and no compensation shall
be paid therefor.

28. Detailed plans and specifications shall be submitted and the approval of the Chief
Inspector of Mines obtained before the construction of any building, road or Working is
commenced within a less distance from an explosives magazine than the nearest building,
road or working shown on the approved site plan of such magazine.

29. The keys of an explosives magazine shall always be in the custody of, and all holder of a
Certificate of Competency under regulation 177-of the Mining Rights Regulations, save where
the mine manager, in the case of an explosives magazine on a concession hia expressly
authorie3 some suitable person other than the holder of such a Certificate of Competency to
have the custody of such keys and to superintend with the assistance of a holder of
Certificate of competency the issue of such explosives.


30. Sentries and watchmen shall be on duty at each explosives magazine day and night so
long as there are explosives therein

31. Any such sentries or watch men having been properly posted and not having been
properly relieved who shall desert his post or who shall in any way be negligent in the
performance of his duties as a sentry or Watchman or who shall commit any breach of
discipline when posted as a sentry or watchman or when warned for duty as such shall be
liable to a penalty not exceeding N5O.OO,


32. a copy of the abstract of these regulations and a copy of the original storage license of
the magazine shall be posted or hung up where they can be conveniently be seen and read
in or at each explosives magazine.




EXPLOSIVES REGULATIONS, 1970
DIVISION 3PERMIT TO PURCHASE ETC., EXPLOSIVES
33. (I) The Chief Inspector of Mines may issue permits for the purchase, acquisition or
possession of explosives, and may in such, permit specify (a) the nature (b) amount which
may be possessed at any one time, or Cc) the total amount of explosives which may be
purchased, acquired or possessed under such permit, the purposes for which the same may
be used and the place where it may be used.


(2) A permit issued under this regulation shall be valid for the period therein named, which
shall not exceed twelve months. Such permit shall be in Form A in the Schedule hereto.

34. Permits under regulation 33 shall be made in triplicate: one copy shall be retained by the
officer who issues it, and two shall be delivered to the person to whom it is issued.

35. (I) No person shall sell, give or otherwise deal in or permit any explosive to be taken from
his possession, unless he shall have previously obtained authority in writing from the Chief
Inspector of Mines to do so.
(2) Such authority may be issued for one or more such transactions and with respect to a
particular kind of explosives, and a particular amount thereof, or may be general and for a
period to be therein specified. Such authority shall be in Form B in the Schedule hereto.

36. No person shall sell, give or otherwise permit another person to take from his possession
any explosive unless such other person produces a permit in duplicate issued to him under
regulation 33 of these Regulations, or otherwise than in accordance with the terms of such
permit.

37. If the permit has been issued in Form A, the person disposing of explosives shall endorse
on the two copies the amount to be disposed of and his name and address. If the permit is for
a limited amount and the total amount of explosives so endorsed by him, or by him and any
other person, equals the amount for the purchase, acquisition, and possession of which the
permit has been issued he shall retain one copy and forward the same to the Chief Inspector
of Mines.

38. No person shall purchase, acquire, or possess any explosive without having previously
obtained a permit to do so under regulation 33 of these Regulations or otherwise than in
accordance with the terms of such permit:

Provided that explosives purchased or acquired under a permit in Form A may be possessed
by the person to whom such permit was issued for such period after the expiration of such
permit as the Chief Inspector of Mines may in writing permit.

EXPLOSIVES REGULATIONS, 1970

39 No person shall use any explosives except for the purposes and at the places specified in
the permit issued in respect thereof, except with the written permission of the Chief Inspector
of Mines,

40. (I) A person who has obtained any authority under regulation 35 shall cause to be kept
books showing the name, address and description of the persons to whom he disposes of
explosives, and the quantity and variety of explosives disposed of to such persons.

(2) Such books shall be opened during reasonable hours to the inspection of the
Commissioner of Police, Deputy Commissioner of Police, Superintendents and Assistant
Superintendents of Police and Inspectors of the Mines Department,

(3) A copy of the entries made during the previous month in such books shall be sent at the
commencement of each month to the Chief Inspector of Mines.

41. All thefts and losses of explosives shall forthwith be reported by the owner thereof to the
Police and to the Chief Inspector of Mines.

42. Nothing in these Regulations shall be construed to prevent a permit holder from issuing
explosives to his workmen, for the use of blasting operations confined to the work Controlled
by such permit holder; but such permit holder shall enter each day in a book which he shall
keep for that purpose, the amounts and nature of explosives by him on such day to such
workmen, and such book shall be open to such inspection as is mentioned in regulation 40 of
these Regulations.

43. Any person contravening the provisions of regulation 41 or the provision in regulation 40
requiring copies of entries to be sent each month to the Chief Inspector of Mines, shall be
liable to a fine not exceeding N5O.OO.

44. Workman shall include a person carrying on blasting by contract in a mine.
Prescribed Officer shall mean the Chief Inspector of Mines.

45. The Explosives Regulations in force on the day immediately preceding the coming into
operation of these Regulations are hereby rescinded.
