ORDINANCE NO. 12030 C.M.S.
AN ORDINANCE AMENDING ORDINANCE NOS. 11954 AND 11965 C.M.S. AND
CHAPTER 8.22 OF THE MUNICIPAL CODE TO PROVIDE THAT THE HOUSING,
RESIDENTIAL RENT AND RELOCATION BOARD BE COMPRISED OF SEVEN
MEMBERS, TWO MEMBERS TO BE LANDLORDS, TWO MEMBERS TO BE
TENANTS, AND THREE MEMBERS TO BE NEUTRALS
WHEREAS, it is in the interest of the citizens of Oakland to provide through the appointment
process a balanced representation on the existing Housing, Residential Rent and Relocation Board; and
WHEREAS, the original configuration of the Board, determined by Ordinance No, 11954 C.M.S.,
provided for two landlord, two tenant, and five neutral members; and
WHEREAS, the composition of the Board was changed by Ordinance No. 11965 C.M.S. to three
landlord, three tenant, and three neutral members; and
WHEREAS, the current configuration of the Board as modified by Ordinance No. 11965 C.M.S. has
impeded the effectiveness of the Board because of the difficulty in establishing a quorum; now, therefore
THE COUNCIL OF THE CITY OF OAKLAND DOES ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 11965 C.M.S. is hereby rescinded.
Section 2. Section 6A of Ordinance No. 11954 C.M.S is hereby amended to read as follows:
A. The Board shall be composed of seven members appointed pursuant to
Section 601 of the City Charter. Of the Board members appointed, two
shall be landlords, two shall be tenants, and three shall be neutrals (neither
landlords nor tenants).
Sections. Section 6B of Ordinance No, 11954 C.M.S. is hereby amended to read as follows:
B Four Board members shall constitute a quorum, and any decision by the
Board shall require a majority of those members present.
Section 4. Section 8.22.020 of the Oakland Municipal Code is hereby repealed

Section 5. The second paragraph of Section 8.22.030 of the Oakland Municipal Code is hereby
replaced with the following:
"Board" and "Residential Rent Arbitration Board" mean the Housing, Residential Rent
and Relocation Board established by Ordinance No. 11954 C.M.S. as amended.
Section 6. Section 8.22.050.E. of the Oakland Municipal Code is hereby replaced with the
following:
E. Of the Board members appointed, two shall be landlords, two shall be tenants, and
three shall be neutrals (neither landlords nor tenants).
