Cases:

1a. Juarez, a resident of North Carolina, filed suit in the federal district court in South Carolina charging
Appleson, a resident of South Carolina, with fraud in the sale of his painting valued at $80,000. Will
the court refuse to hear the case because it lacks jurisdiction?
I do not see the court refusing to hear the case because federal courts have jurisdiction
over case where the two citizens or parties reside in different states and the amount in
question is $75,000 or more and indeed in this case the two citizens or parties involved in
the case reside in different states and the amount in question is more than $75,000. So I
believe the court will hear the case because they have the legal jurisdiction to hear the
case in its entirety.
1b. Hakolo gave a speech before a group of teachers in which he charged Andover with stealing funds
from the school treasury. When Andover sued, charging slander, Hakolo claimed there was no specific
state or federal law that he had violated. If there are no specific statutes prohibiting slander, can
Andover still sue? Explain your answer.
I do not believe that Andover has the legal right to sue but he may still want to sue in
small claims court. If there is no state or federal law that Hakolo violated then I do not
see what would be the right of Andover to sue. The only way that I would see the
reasoning behind Andover still pursuing the suit would be because he may still feel
violated and may want a judge to decide if he has the legal right to any compensation.
2a. Civello is a secretary employed by a firm that manufactured pharmaceuticals. In the course of her
work, she learned that many test results submitted to federal agencies were clearly and intentionally
inaccurate. When she questioned her boss, she simply stated, If you want to keep your job, youll
have to learn that all pharmaceutical firms do the same thing, and if we didnt, wed be out of
business. Civello was troubled and considered contacting the newspaper or a government
agency. What would be the ethical thing for her to do?
The ethical thing for Civello to do would to be a whistleblower. Civello should contact a
government agency and tell of the wrong doings of her employer. It would be wrong of
her to keep quiet about the wrong doings going on in the company because there is no
telling who has been hurt because of the false test results submitted to federal agencies.
Civello may indeed lose her job but the best thing for her to do is to let someone of a
higher position, that is not involved in her company, know what is going on in her
company so that no one or anyone else gets hurt by the purposefully falsified test results.
2b. Jackson & Jackson, a manufacturer of hospital equipment, distributed a code of ethics to all
employees that, among other things, prohibited employees from giving gifts valued over $25 to
customers. Farly, a senior salesperson, routinely gave gifts valued at $200 to decision-makers of large
accounts. When Farlys activities were discovered, he was fired. Farly claimed that no one complained
when he was the top salesperson most years and that the company made a great amount of money
on his sales. Was the company ethically right in discharging him?
I do feel the company was ethically right for discharging him because the code of ethics
clearly states that there is to be no giving of gifts valued at more than $25. I do believe
that the company should have checked into his actions as far as the gift giving was
concerned. Farly was using his gifts to possibly gain more clientele for himself as well as
the business which limited the clientele for the workers who were following the code to
the letter and received no recognition for the hard work and following of rule and code of
ethics to the letter.
