There is a large gum tree near the fence which has three large branches that are at risk of falling. I have had an
arborist come and examine the tree and he advised that the branches show signs which indicate that they might fall.
My grandchildren sometimes play under the tree and I am concerned for their safety.
I also have an outdoor pergola under the largest branch and it may be damaged if the branch falls.

No but I am concerned for the safety of my grandchildren and anyone else in the front yard. I try not to let the
grandchildren play in that part of the yard due to the risk of a falling branch. I am also less likely to use my pergola
because of the risk of injury.

WHAT TYPE OF APPLICATION ARE YOU MAKING?
A minor civil dispute about minor debt can involve disagreements with another person, business or
company about a xed or agreed sum of money, valued up to $25,000.
Examples include:
an unpaid invoice or account
rent arrears
half the cost of a dividing fence, as agreed before it was built, work done and/or goods supplied
as requested, money lent and not repaid, wages owing, an IOU, a dishonoured cheque.

Copies of the application and providing copies to other parties
When lodging your original application and any attachments, you must also provide two copies of all
of the documentation being lodged and a stamped, self-addressed envelope. If there is more than
one respondent, an extra copy of the application form and attachments must also be included for
each additional respondent.

1. I issued my neighbour Mrs House with a Notice for removal of particular overhanging branches on 22
November 2011. I asked Mrs House to arrange for the branches to be removed by 10 January 2012. A copy of
the Notice is attached here.
2. Mrs House did not respond to the Notice and did not act by 10 January as requested.
3. I feel that Mrs House has been avoiding me. I have attempted to discuss the matter with her over the fence
but she does not wish to engage with me.
4. I then arranged for tree loppers to remove the branches overhanging my fence on 29 January 2012. The cost
was $516.20 and the receipt is attached. The tree loppers we used provided the cheapest of two quotes we
received. Copies of each quote are attached.
5. I request that QCAT order I be reimbursed $258 toward the cost of the tree loppers and the $21 QCAT filing
fee by Mrs. House.
