In order to enable the court to find out the
truth and render a just decision, the salutary
provisions of Section 540 of the Code Section !""
of the ne# Code$ are enacted #hereunder any
court by e%ercisin& its discretionary authority at
any sta&e of en'uiry, trial or other proceedin& can
su((on any person as a #itness or e%a(ine any
person in attendance thou&h not su((oned as a
#itness or recall or re)e%a(ine any person in
attendance thou&h not su((oned as a #itness or
recall and re)e%a(ine any person already
e%a(ined #ho are e%pected to be able to thro#
li&ht upon the (atter in dispute* because if
jud&(ents happen to be rendered on inchoate,
inconclusive and speculative presentation of facts,
the ends of justice #ould be defeated+,

-hou&h Section 540 Section !"" of the
ne# Code$ is, in the #idest possible ter(s and
calls for no li(itation, either #ith re&ard to the
sta&e at #hich the po#ers of the court should be
e%ercised, or #ith re&ard to the (anner in #hich
they should be e%ercised, that po#er is
circu(scribed by the principle that underlines
Section 540, na(ely, evidence to be obtained
should appear to the court essential to a just
decision of the case by &ettin& at the truth by all
la#ful (eans+ -herefore, it should be borne in
(ind that the aid of the section should be invo.ed
only #ith the object of discoverin& relevant facts
or obtainin& proper proof of such facts for a just
decision of the case and it (ust be used judicially
and not capriciously or arbitrarily because any
i(proper or capricious e%ercise of the po#er (ay
lead to undesirable results+ /urther it is incu(bent
that due care should be ta.en by the court #hile

should not be used for fillin& up the lacuna left by
the prosecution or by the defence or to the
disadvanta&e of the accused or to cause serious
prejudice to the defence of the accused or to &ive
an unfair advanta&e to the rival side and further
the additional evidence should not be received as
a dis&uise for a retrial or to chan&e the nature of
the case a&ainst either of the parties+,
