Dear Comrades,

Contempt petition hearing 30.9.2013

Madras High Court took up the contempt petition filed by the Circle Association as well
as the Federation against Sri Pratip Chaudhuri and others came for hearing today. While
Sri Pratip Chadhuri the respondent No: 1 was not present, other two Respondents S/sri
Ranjith Goswami the CGM (HR) and N R Satpathy DGM & CDO were present. Our
Advocate Ms. R. Vaigai stated that it was possible for the Bank to effect the Check Off in
one day. She also pointed out that in case of one officer in North Eastern Circle the
check off was effected in the salary on 25
th
but withdrawn after a day. She pointed out
that the Senior Counsel argued on 25
th
that it will take seven to eight days to effect the
check off which was totally a wrong statement. She pointed out that the Chairman did
not want to effect the check off before his retirement. Senior Counsel who appeared for
the Bank today stated that the Chairman had no role in this and he could not come
today only because he is retiring from the Bank today. He went to plead that Chairman
should be exempted from appearing in person as it was only the Chief General Manager
(HR) Mr. Ranjith Goswami who had issued the order and he was present in the Court.
The Banks advocate requested that Shri Pratip Chaudhuri may be asked to appear in
the Court on another day. This was agreed by the Court and the date has been fixed as

October 2013.

During the course of the argument the Banks Counsel reiterated that the check off will
be effected in the month of October for 2 months together whereas our Counsel
demanded that the check off should be implemented within a day or two. The Banks
counsel stated that he requires time to find out from the Bank whether it was possible.
Our Advocate demanded that an affidavit to be filed to that effect that it is not possible if
the Bank says so. She circulated the Banks Circular on HRMS issued in 2009 to prove
that the system was centralized and it does not require too much of time to do the
modification.

Based on the arguments of both sides the Honble Justice directed the Banks Counsel to
file counter affidavit for the contempt petition and send a copy to our Counsel at least
before 2 days so that the case can be heard on 10
th
. The Banks Counsel requested that
the modification petition filed by the Bank also could be taken up. Our advocate insisted
that the contempt has to be heard first which was accepted by the Honble Court.
