JUDICIAL AFFIDAVIT
Ako si ANTONIO BEBON SOMOZA, 52 anyos ang panu-igon, ulitawo, Filipino ug
kasamtang nagpuyo sa #68 San Juan St., Dumaguete City, ang gi-kiha niining kasoha, nag-asoy
ubos sa panumpa sa mga mosunod:
I, ANTONIO BEBON SOMOZA, 52 years old, single, Filipino and presently residing
at 68 San Juan St., Dumaguete City, respondent in this case, state under oath as follows:

Preliminary Statement
The person examining me is Atty. Karla Elizabeth P. Aguilan with address at Salonga
Center for Law and Development, Villareal Hall, Silliman University, Dumaguete City. The
examination is being held at the same address. I am answering her questions fully conscious that
I do so under oath and may face criminal liability for false testimony and perjury.

Q2. Are you the same respondent in this case?
A2. Yes.

A3. Oo.
Q3. Do you know MELANIA C. TUCO, the complainant in this case?
A3. Yes.



Q4. Gi-unsa nimo pagkaila sa gakiha sa imo iniining kasuha?
A4. Katabang na siya sa among silingan. Iyang agalon, akoang ig-agaw.
Q4. How do you know complainant in this case?
A4. She is the household help of my neighbor, who happens to be my cousin.

Q5. Asa man ka niadtong alas 2:00 sa hapon, Setyembre 11, 2013?
A5. Naa ra sa balay.
Q5. Where were you at about 2:00 in the afternoon of September 11, 2013?
A5. I was just at home.

Q6. Unsa man ang imong gibuhat, kung naa, sa imong balay ining mga orasa?
A6. Wala na ko kahinumdom nag unsa ko anang panahona sa among balay.
Q6. What were you doing, if any, in your house at this time?
A6. I cannot recall what I did at that time in my house.

Q7. Unsa man imong kasagaran nga ginahimo na imong balay niining mga orasaha?
A7. Naa ra ko sulod sa balay nagbantay sa akong mama nga masakiton, usahay maglantaw ug
TV.
Q7. What do you usually do at home at this time of the day?
A7. Im just inside the house watching over my sick mother, or sometimes I watch the TV.

Q8. Tinuod ba nga naay higayon nga nang bato ka sa balay sa amo ni Melania?
A8. Dili na tinuod. Wala gyud na nahitabo.
Q8. Is it true that there was an instance that you threw stones at the house of Melanias
employers?
A8. That is not true. It never happened.

Q9. Tinuod ba nga imong gisulti kini nga mga pulong kaniya: Kawatan ka ug bugas! Layhan
ba ka ani (dungan sa paghulbot sa Samurai/hinagiban/ispada)? ug giwarawara?
A9: Dili gyud.
Q9: Is it true that you said the following to her: You are a thief of rice! Do you want this (hile
pulling out a Samurai/sword)? and brandishing it?
A9: Never.

Q10. Makahinumdom pa ba ka ug mga higayon nga nagka tubaganay kamo?
A10. Wala gyud. Wala koy pakialam anang bayhana.
Q10. Can you still remember instances where you had altercations with her?
A10. Not at all. I have nothing to do with that woman.

Q12. Kabalo ba ka sa mga akusasyon batok kanimo?
A11: Oo, kabalo.
Q11. Are you aware of the charges against you?
A11: Yes, I am aware.

Q12. Unsa kaha ang rason nga gi-kiha-an ka niya?
A12: Kay naa man siyay utang sa akong mama, naa pa siyay tunga sa sakong bugas nga wala
pa mabayari.
Q12. Why do you think she filed these charges against you?
A12: Because she owes my mother the payment of one half sack of rice.

Q13. Aduna pa ba kay idugang sa imong gisaysay?
A13. Wala na.


Q13. Do you have anything more to say?
A13. No more.
