Conditions of renting premises from a tenant or shop owner

Renting from a HDB tenant

HDB'stenantsofcommercialpremisesareallowedtosublet upto50%ofthetradingareaorlivingquarters(for
residentialuse).With effectfrom16Oct2013,sublettingislimitedtoonesub-tenant.HDBwill considerallowing
thesublettingif:
tenanthas compliedwithconditionsintheTenancyAgreementduringtheirexistingterm oftenancywith
HDB
thereisnoarrearsduetoHDBbytenant
tenantisnotabankrupt
proposedtradeofthesub-tenantis anallowabletradeandmustbeoperatedwithinthe premises.
Proposed Term
Thetenantmayopttosubletpartofthe premisesateitherthebalancetermorfresh1,2or3yearterm.
For afreshtermtenancy,theproposedrentwouldberevisedtotheprevailing marketrentorremainat
theexistingrent,whicheverishigher.
For abalancetermtenancy,theproposedrentshallremainattheexisting rent.
Sub-tenant's Trade
Forretailshops,bothproposedsubtenantand tenantshouldbesharingtheshopfrontage.
Premises Allocated under Specific Trade Conditions
Forpremisesletoutforspecifictrade oruse,theproposedsubtenant'strade(s)mustcomplywiththe
conditions specifiedduringtenderallocation.Fore.g.ifthepremisesisletonlyfor "Office"use,no
changeofuse/tradewillbeconsidered.
Thetrade ofthesub-tenantmustnotduplicatethetradesthatarealreadyavailablein thesameclusterof
shops
Subletting of living quarters (LQ)
TenantsareallowedtosublettheirLQtoupto8personsfor residentialuse.Witheffectfrom7Nov06,
foreignconstructionworkers (non-Malaysian)arenotallowedtobesub-tenantsofHDBflatsorLQof
our shops.
TenantsarenotallowedtoconverttheirLQintoaworker's dormitory.
TenantswhowishtosublettheirLQforcommercialuseare requiredtosubmitawrittenrequesttoHDB
forapprovalbeforedoingso.Upon approvalfromHDB,theywouldalsoneedtoapplyforURA's
approvalforthe changeofuse.
Admin Fee
$100(excludingGST)forbalanceterm
$200(excludingGST)forfreshtermandChangeofUseofLiving QuarterstoNon-residentialuse).
Application for Subletting
Allapplicationmust besubmittedonlineviaOnlineBusinessLicensingService (OBLS).
Renting from a HDB sold shop owner
HDBsoldshopowners(lessee)maysubletpartortheirwholeshop tosubtenantsfortheoperationofapproved
retail/servicetrades.Thereisno applicationrequiredforthesubletting,howeverfortradesthatinvolveno changeof
usethelesseeistoupdatethedetailsintheMyHDBPage.Fortrades thatinvolveachangeintheuseclass,HDBs
priorconsenthastobeobtained beforeapplyingtotheotherrelevantauthoritiesegURAfor approval.
ThelesseeistopersonallywriteintoHDBwiththedetailsof theproposeduseforourevaluation.HDBisnotable
toliaisedirectlywiththe proposed/existingsubtenantsonmatterspertainingtotheshop premises.
