Youve heard that in Colorado and
Washington State just south of the bor-
der, voters approved legalization of
marijuana even for recreational (not just
medical) use in 2012.
We in Canada lag behind these US-
neighbours when it comes to sof drugs
like marijuana. Sure, theres been talk
about letting police just issue a ticket to
someone found in possession of a bit of
pot, say 28 or 30 grams. But that would
be a far cry from legalizing possession.
And even that small step, which would
make simple possession a minor infrac-
tion, hasnt been taken.
In fact, simple possession of even a tiny
amount of pot is still not just illegal its
a crime in Canada (some medical excep-
tions apart). A frst ofence can lead to
a maximum fne of $1,000 and a maxi-
mum jail term of six months. Penalties
increase for repeat ofenders.
And there are stifer sentences if youre
charged with possession for the purposes
of trafcking, or with trafcking (basi-
cally, selling the stuf).
Of all the provinces in Canada, British
Columbia famous for its BC Bud
has one of the highest rates of charging
people with possession.
Now, youre not likely to be hit with
the maximum penalties if convicted of
simple possession for the frst time. But
there are still nasty consequences.
For one thing, a conviction results in
a criminal record. Tis may have to be
disclosed on employment applications,
so can hurt your ability to get a job. Also,
you may aferwards not be able to get
into many countries, particularly the
U.S., because of travel restrictions. In
short, a small baggie of the stuf, maybe
just a friendly gif, can end up causing
you a long-lasting hangover.
So whats possession, anyway? Basical-
ly, based on what police fnd (and what
you say), the police must prove that you
had the stuf on you, like in your pockets
or purse, or that it was under your con-
trol (like in your cars glove box) and
that you knew what it was. So you can
be in possession of marijuana even if you
dont own the stuf. Police also have to
prove in court what the substance was,
usually by a test report.
But even if youre caught with some
pot, you have some fundamental rights
to due process in Canada that may help
you avoid conviction.
You have the right to remain silent
so dont blab your way into a confes-
sion. And you have the right to be pro-
tected against unreasonable search and
seizure. So if police come to your house
with a search warrant (basically, a judge-
approved authorization to search your
house) for something else, and they
come across your small stash, the court
may not allow that into evidence it all
depends. Te court may also look closely
at the information used by police to get
a judge to approve the search warrant in
the frst place.
Probably the best thing you can do for
yourself if busted for pot possession (or
worse) is to exercise your right to call a
lawyer at the frst possible opportunity
and follow her advice!

Annual All Breed Championship Dog Show, Obedience
and Rally Obedience trials. Te show will be held at the
Castlegar Community Church Field in Castlegar, August
15, 16 & 17. Tere will be two shows Friday, 8 am and 1
pm, Saturday and Sunday will be one show per day start-
ing at 8 am. Four Obedience and four Rally Obedience

One Fest Is Back Again!
If you havent heard, One Fest is back again. And if you
dont know what this event is about, it could be time to
come fnd out! On Saturday, August 23, you are invited
to Underbelly Farm (just past Lofstedt Farm on the Kaslo
backroad) for a full day of inspiration and community.
Tis will include: informative workshops; fantastic music
from around the Central Kootenay; fresh pizza cooked in
a cob oven; inspiring presentations; a stone soup dinner
and more.
Entry will be $25 to $45 (sliding scale), $15 for ages 13
to16, and free for 12 and under. All proceeds will be in-
vested into community resources (eg. support for local

With New Surveillance Nurses
Six months into the new Surveillance Nurse program
within Interior Health, remote telephone checks are hav-
ing a positive infuence and helping independent seniors
stay at home longer.
Te focus is on stable long-term Home Health clients.
Surveillance Nurses phone them to see how they are do-
ing at least once every three months and more if required.
Clients may also call the nurse when they have questions
or need assistance. Te programs goal is to identify any
issues as soon as possible, to help ensure these independ-
ent clients continue to do well living at home. Te regular
calls ensure we are being proactive and supporting clients
so they continue to be lower needs for as long as possible,
said Whitby. For example they may need encouragement
to increase their activity level, to socialize more, or to quit
smoking. Or they may beneft from other support services.
Surveillance Nurses are currently located in Williams
Lake; Kamloops; Vernon; Kelowna; Penticton; Cranbrook
and Castlegar. Tey support approximately 280 clients.
As the program grows, they will continue to expand their
reach across the health authority.
Terapeutic Riding Camps
2014 Equine Empowerment Camps are being ofered for
West Kootenay area youth from ages fve to 19 at the Pass
Creek Regional Exhibition grounds near Castlegar. Tese
camps are free of charge and sponsored by Columba Basin
Trust, Arrow Lakes Terapeutic Riding Association and
Pass Creek Regional Exhibition Society.
Camp participants will receive two 1.5 hour lessons per
camp, which will be tailored to each individual and in-
clude working with horses, whether that means riding,
grooming or simply learning about the horse. We aim to
create a safe and comfortable environment for each indi-
vidual participant. Camp dates are Tursday, August 21 to
Saturday, August 23 and Friday, September 26 to Sunday,
September 28.

that maybe interested in attending this very special thera-

Jumbo Update Summer 2014
From a recent interview with my government con-
tact person, the Senior Manager of Major Projects in
the Mountain Resort Branch of the Ministry of Forests,
Lands and Natural Resource Operations, I learned:
We discussed the moving of the environmental as-
sessments of newly proposed major ski resorts from the
Environmental Assessment Of ce (EAO) into the All
Seasons Resort Policy (ASRP) which includes the Can-
adian Alpine Ski Policy (CASP). Te move is thought by
all to be good as the EAO primarily assesses mineral and
energy applications. Te proper analyzers are now mak-
ing sure ASRP and CASP are equally, or better, able to
make the appropriate assessments. It is entirely likely that
government will create proper legislation and use the ori-
ginal Order in Council date of January 2015 to make the
change. All established Ski Resort applications will stay
with the EAO.
Te of ce of the Mountain Resort branch recently re-
ceived four applications to begin work in the Jumbo
Valley by Glacier Resorts Ltd. (the parent corporation
of the proposed Jumbo Glacier Resort development): 1.
New road construction 2. Cutting trees (MOF) 3. Cross-
ing Jumbo Creek with the road (MOE) 4. Building a day
lodge in Jumbo Valley at the proposed village site.
Tese applications took my contact person and the
Joint Resources Forum (JRF) team to meetings with the
Ktunaxa (Kootenay) First Nation as the Jumbo Glacier
Resort development proposal is within their land claim.
Te JRF was there to guide the Ktunaxa to allow the four
applications to move forward.
RE: Judicial Reviews: Te Ktunaxas Judicial Review
challenged the granting of the Master development Agree-
ment to GRL which allowed development to begin. Te
judge decided that development would not impinge on
the sacredness of QatMuk. Te Ktunaxa plan to appeal.
Kathryn Teneese, Ktunaxa Nation Council Chair, said in
a press release, Our beliefs are what make us Ktunaxa and
being told that our sacred relationship regarding QatMuk,
and its need for protection from development, are not im-
portant enough to stop this development of our sacred
place, should concern any British Columbian who cherish-
es the freedom to practice their religion without interfer-
ence, and who respects constitutionally protected rights.
Te West Kootenay Eco-Societys Judicial Review chal-
lenges the legality of creating a municipality with no resi-
dences, the Jumbo Glacier Mountain Resort Municipality.
We are building the strongest possible case in order to
move forward to win, said David Reid, Executive Direc-
tor of the West Kootenay Eco-Society. Since the original
Jumbo Alpine Glacier Resort frst came to public atten-
tion in 1990, we have been through eight governments
including the present one.
