Minutes of 4 th
meeting of State Committee for the Slaughter House held on 25.7.2014 at 12:00 noon under the chairmanship of the ACS,ULB in his office Room No. 622, New Civil Secretariat, Sector 17, Chandigarh.
1. List of the participants is placed at Annexure A.
2. At the outset, the Chairman welcomed the new convenor of the committee Sh. K.C. Sharma Retd. District and Sessions Judge. The Chief Engineer, Urban Local Bodies also welcomed the Chairman, convenor and all the participants in the meeting. He stated that minutes of 3 rd meeting of State Committee for the Slaughter Houses were circulated on 20.1.2014 to all the members of the committee and no comments were received. Sh. Naresh Kadian, Member stated that no action has been taken on the decisions taken in the 3 rd
meeting of the State Committee for the Slaughter Houses by any of the departments. The chairman reviewed the progress of the decisions taken in the last meeting and directed the representatives of the departments to explain their action taken reports in this regard: i) Joint Director, Animal Husbandry Department informed that SPCAs have already been formed in all the districts of Haryana, but they are not functioning properly due to non co-operation of district administration and lack of funds. A proposal for making budget provision has already been submitted to the State Govt.
ii) Chairman directed the representative of Animal Husbandry Department that SPCAs may be re-constituted as per provisions of the law and made fully functional on or before 31.8.2014 & under intimation to the committee. The detailed guidelines should be issued to the SPCAs for proper implementation of the provisions in the Prevention of Cruelty to Animals (Slaughter House) Rules, 2001 and PCA Act 1960. Further, Animal Husbandry Department should constitute infirmaries by 15 th
August, 2014 and fix the uniform rates throughout the state for different animals. iii) The Inspector General Police (Crime), Haryana stated that FIRs are being lodged against the operators of the illegal slaughter houses and list of such persons will be sent to the committee within a week.
iv) Sh. S.C. Mann, Senior Scientific Advisor, Haryana State Pollution Control Board informed that only 4 legal slaughter houses are functioning in the state as per provided list of the slaughter houses in the state. He further stated that Rs. 5.00 crore is available with the HSPCB for installation of ETPs for slaughter houses. ULB department can take these funds after submitting the DPRs for such ETPs.
v) The ULB department was directed to prepare the DPRs after appointing the consultant for this purpose by adopting the proper procedure and submit the same to the HSPCB at the earliest.
3. During the review of the progress reports received from the districts, it was observed that progress reports from the Municipalities and Deputy Commissioners are not being received regularly and Deputy Commissioners are not taking meetings of District Committees of Slaughter Houses as constituted under their chairmanships. It was decided that the DO letter incorporating detailed instructions from worthy ACSULB may be written to all the Deputy Commissioners in the state for compliance of the
provisions of the PCA Act-1960 and conducting the regular meetings of the SPCAs and sending report regularly.
4. After detailed discussions the following decisions were taken:
i) Sh. Kadian suggested that training of the district level concerned officers may be got conducted, so that they become well aware about the rules and regulations of slaughter houses. The suggestion was agreed to by the committee and it was decided that Deputy Commissioners may be directed to conduct the training programmes at the earliest. Shri Kadian will provide a training module & location of such training centres within a week.
ii) CCTV cameras should be installed at Toll Barriers and at front gate and inside the slaughter houses. Excise and Taxation Department, Commissioners, Municipal Corporations and Deputy Commissioners be asked to install the CCTV cameras at Toll Barriers and at front gate and inside the slaughter houses at the earliest.
5. Animal Husbandry Department was requested to examine for reconstitution for Animal Welfare Board as per rules.
6. Mr. Kadian suggested that in the Hindi version of Meat Food Products Order, 1973 issued by the MOFPI, GOI vide its extra ordinary gazette notification dated 28.3.1973 under section 2 (iv), the Hindi meaning of the animals Bovines has been wrongly written as Gaay which may be got corrected/clarified. On this the Animal Husbandary Department was directed to take up the matter at an appropriate level to get the Hindi meaning of Bovines corrected from the concerned Department in GOI.
7. Mr Kadian requested that the State Committee should recommend the case to the Government of Haryana to declare the cow progeny as state animals of Haryana in domestic animal category, for which the committee agreed.
8. All the concerned departments were directed to update their information on about ATRs within a week and in future they should ensure submission of the monthly reports to the convenor i.e. Sh. K.C. Sharma, (Retd. District & Sessions Judge), so as to enable him to submit the same into the Honble Supreme Court of India, in compliance of its order dated 30.01.2014.
9. The committee decided to direct all the concerned departments to make compliance of the latest order of the Honble Supreme Court of India dated 06.03.2014, in Writ Petition (civil) No. 309 of 2003 tiled as Laxmi Narain Modi vs. Union of India & others, the relevant portion of which is reproduced below:
Learned counsel for the State of Bihar, Punjab, Tripura and Haryana sought three weeks time to file their respective affidavit. Time sought for is granted. They should indicate in their respective affidavit the entire details of the unlicensed and unauthorized slaughter houses, if any, functioning in the states and the action taken against them. Details regarding cases filed against them and the stage of those cases etc., shall be mentioned. ..The newly formed committee with the district Judge as convenor should file their report on or before 5.4.2014.
