9266, AN ACT PROVIDING FOR A MORE RESPONSIVE AND COMPREHENSIVE
REGULATION FOR THE REGISTRATION, LICENSING AND PRACTICE OF
ARCHITECTURE, REPEALING FOR THE PURPOSE REPUBLIC ACT NO. 545, AS
AMENDED, OTHERWISE KNOWN AS AN ACT TO REGULATE THE PRACTICE OF

The %tate recogni9es the importance of architects in nation buil!ing an! !e6elopment#
Hence, it shall !e6elop an! nurture competent, 6irtuous, pro!ucti6e an! 2ell:roun!e!
professional architects 2hose stan!ar!s of practice an! ser6ice shall be e;cellent, <ualitati6e,
2orl!:class an! globall5 competiti6e through in6iolable, honest, effecti6e an! cre!ible licensure
e;aminations an! through regulator5 measures, programs an! acti6ities that foster their
professional gro2th an! !e6elopment#
This 3IRR of the Architecture Act of &''(4 shall be interprete!, construe!, an! carrie!
out in the light of the %tatement of Polic5 foun! in %ection & of Republic Act "o# /&00, as state!
abo6e#
SECTION 0. D(-%+%&%,+ ,- T(1*2#
As use! in this 3IRR of the Architecture Act of &''(4, in R#A# "o# /&00 or other la2s,
the follo2ing terms shall be !efine! as follo2s=

buil!ings in their totalit5 ta1ing into account their en6ironment, in accor!ance 2ith the principles

license! un!er R#A# "o# /&00 2ith a Certificate of Registration an! Professional I!entification

Regulation Commission, an! 2ho is responsible for a!6ocating the fair an! sustainable
!e6elopment, 2elfare an! cultural e;pression of societ5?s habitat in terms of space, forms an!
historical conte;t>

/&00, 2ho is !irectl5 an! professionall5 responsible for the total !esign of the pro@ect for the

structural conceptuali9ation, specif5ing, super6ising an! gi6ing general a!ministration an!
responsible !irection to the erection, enlargement or alterations of buil!ings an! buil!ing
en6ironments an! architectural !esign in engineering structures or an5 part thereof> the scientific,
aesthetic an! or!erl5 coor!ination of all the processes 2hich enter into the pro!uction of a
complete buil!ing or structure performe! through the me!ium of unbiase! preliminar5 stu!ies of
plans, consultations, specifications, conferences, e6aluations, in6estigations, contract !ocuments
an! oral a!6ice an! !irections regar!less of 2hether the persons engage! in such practice are
resi!ents of the Philippines or ha6e their principal office or place of business in this countr5 or
another territor5, an! regar!less of 2hether such persons are performing one or all these !uties,
or 2hether such !uties are performe! in person or as the !irecting hea! of an office or
organi9ation performing them>

ser6ices in connection 2ith site, ph5sical an! planning an! the !esign, construction, enlargement,
conser6ation, reno6ation, remo!eling, restoration or alteration of a buil!ing or group of
buil!ings# %er6ices ma5 inclu!e, but are not limite! to=
(1) planning, architectural !esigning an! structural conceptuali9ation>
(2) consultation, consultanc5, gi6ing oral or 2ritten a!6ice an! !irections, conferences,
e6aluations, in6estigations, <ualit5 sur6e5s, appraisals an! a!@ustments, architectural an!
operational planning, site anal5sis an! other pre:!esign ser6ices>
(3) schematic !esign, !esign !e6elopment, contract !ocuments an! construction phases
inclu!ing professional consultancies>
(4) preparation of preliminar5, technical, economic an! financial feasibilit5 stu!ies of
plans, mo!els an! pro@ect promotional ser6ices>
(5) preparation of architectural plans, specifications, bill of materials, cost estimates,
general con!itions an! bi!!ing !ocuments>
(6) construction an! pro@ect management, gi6ing general management, a!ministration,
super6ision, coor!ination an! responsible !irection or the planning, architectural !esigning,
construction, reconstruction, erection, enlargement or !emolition, reno6ation, repair, or!erl5
remo6al, remo!eling, alteration, preser6ation or restoration of buil!ings or structures or comple;
buil!ings, inclu!ing all their components, sites an! en6irons, inten!e! for pri6ate or public use>

(7) the planning, architectural la5:outing an! utili9ation of spaces 2ithin an! surroun!ing
such buil!ings or structures, housing !esign an! communit5 architecture, architectural interiors
an! space planning, architectural !etailing, architectural lighting, acoustics, architectural la5:
outing of mechanical, electrical, electronic, sanitar5, plumbing, communications an! other utilit5

(8) buil!ing programming, buil!ing a!ministration, construction arbitration an!
architectural conser6ation an! restoration>
(9) all 2or1s 2hich relate to the scientific, aesthetic an! or!erl5 coor!ination of all 2or1s
an! branches of the 2or1, s5stems an! processes necessar5 for the pro!uction of a complete
buil!ing or structure, 2hether for public or pri6ate use, in or!er to enhance or safeguar! life,
health an! propert5 an! the promotion an! enrichment of the <ualit5 of life, the architectural
!esign of engineering structures or an5 part thereof> an!
(10) all other 2or1s, pro@ects an! acti6ities 2hich re<uire the professional competence of
an architect, inclu!ing teaching of architectural sub@ects an! architectural computer:ai!e! !esign>

!e6eloping the t5pe, !isposition, arrangement an! proportioning of the structural elements of an
architectural 2or1 gi6ing !ue consi!eration to safet5, cost:effecti6eness, functionalit5 an!
aesthetics>
(6) A1.3%&(.&41)' F%1*! means a sole proprietorship, a partnership or a corporation
registere! 2ith the DTI A"DAOR %EC an! then 2ith the Boar! of Architecture an! PRC>
(7) A4&3,123%8! refers to the author or authors of a set of architectural plans or
specifications 2ho are in charge of their preparation 2hether ma!e b5 them personall5 or un!er
their imme!iate super6ision>
(8) B,)16! refers to the Professional Regulator5 Boar! of Architecture>
(9) C,**%22%,+! means the Professional Regulation Commission>
(10) S(1:%.( A71((*(+&! means a !ul5 notari9e! 2ritten contract or e<ui6alent public
instrument stipulating the scope of ser6ices an! guaranteeing compensation of such ser6ices to
be ren!ere! b5 an architect registere! an! license! un!er R#A# "o# /&00>
.iolation of the %er6ice Agreement is a basis for a ci6il liabilit5 un!er Art# -)&B of the
Ci6il Co!e unless heAshe attempts an!Aor succee!s to interfere or contra6ene the legal an!

national organi9ation of all architects of the Philippines in 2hich all registere! Filipino architects
shall be members 2ithout pre@u!ice to membership in other 6oluntar5 professional associations>
(12) C,+&%+4%+7 P1,-(22%,+)' D(:(',8*(+&! refers to a sustaining an! progressi6e
learning process that maintains, enhances, or increases the 1no2le!ge an! continuing abilit5 of
architects>
(13) DTI! shall mean the Department of Tra!e an! In!ustr5>
(14) SEC! shall mean the %ecurities an! E;change Commission>
(15) A22,.%)&%,+! an5 formal grouping of t2o or more architects or architectural firms
2or1ing in @oint 6enture on a pro@ect basis#

(16) A1.3%&(.&41)' C,*8)+/! means a @uri!ical entit5 that shall be s5non5mous 2ith an
Architectural Partnership *see !efinition of Architectural Partnership+ registere! 2ith the %EC#
(17) A1.3%&(.&41( C,18,1)&%,+! means a group of professionals in architecture an!
allie! professions, incorporate! 2ith Architects for the purpose of !eli6ering professional ser6ice
in architecture an! allie! professions> in case an e;isting Architectural Corporation !oes not
compl5 2ith the )CD composition re<uirement, it shall compl5 an! register again 2ith the %EC
an! the BOA#
(18) A1.3%&(.&41)' D,.4*(+&2! means an architectural !ra2ings, specifications, an!
other outputs of an Architect that onl5 an Architect can sign an! seal consisting, among others, of
6icinit5 maps, site !e6elopment plans, architectural program, perspecti6e !ra2ings, architectural
floor plans, ele6ations, sections, ceiling plans, sche!ules, !etaile! !ra2ings, technical
specifications an! cost estimates, an! other instruments of ser6ice in an5 form#
(19) A1.3%&(.&41)' I+&(1%,12! means a !etaile! planning an! !esign of the
in!oorAenclose! areas of an5 propose! buil!ingAstructure, inclu!ing retrofit or reno6ation 2or1
an! 2hich shall co6er all architectural an! utilit5 aspects, inclu!ing the architectural la5:outing
of all buil!ing engineering s5stems foun! therein#
(20) A1.3%&(.&41)' P)1&+(123%8! means a group of t2o or more Architects !ul5
registere! 2ith the %EC an! then 2ith the Boar! of Architecture#
(21) A1.3%&(.&41)' P')+2! means a t2o *&+:!imensional representations reflecting a
propose! !e6elopmentAre!e6elopment of an enclose!A semi:enclose! or open area sho2ing
features or elements such as columns, 2alls, partitions, ceiling, stairs, !oors, 2in!o2s, floors,
roof, room !esignations, !oor an! 2in!o2 call:outs, the architectural la5out of e<uipment,
furnishings, furniture an! the li1e, specifications callouts, ele6ation references, !ra2ing
references an! the li1e> the architectural plan is the representation of a lateral section for a

(24) C,6( ,- E&3%.)' C,+64.&! means a !ocument 2hich forms part of the Architects?
"ational Co!e 2hich contains the norms an! principles go6erning the practice of the profession
of architecture in the highest stan!ar!s of ethical con!uct#
(25) C,+24'&%+7 A1.3%&(.&! a registere! an! license! Architect, 2ho is aca!emicall5 an!
professionall5 <ualifie!, an! 2ith e;ceptional or recogni9e! e;pertise or speciali9ation in an5
branch of architecture> the Consulting Architect assumes no ci6il liabilit5 un!er Art# -)&B of the
Ci6il Co!e unless heAshe attempts an!Aor succee!s to interfere or contra6ene the legal an!

PROFESSIONAL REGULATOR" BOARD OF ARCHITECTURE$ ORGANI@ATION,
POWERS, AND FUNCTIONS
SECTION 4. C1()&%,+ )+6 C,*8,2%&%,+ ,- &3( P1,-(22%,+)' R(74')&,1/ B,)16
There is hereb5 create! a Professional Regulator5 Boar! of Architecture, hereinafter
referre! to as the Boar!, a collegial bo!5 un!er the super6ision an! a!ministrati6e control of the
Professional Regulation Commission, hereinafter referre! to as the Commission, is compose! of
a chairman an! t2o *&+ members appointe! b5 the Presi!ent of the Philippines from a list of
three *B+ recommen!ees chosen from a list of fi6e *C+ nominees for each position submitte! to
the Commission b5 the integrate! an! the accre!ite! professional organi9ation of architects# The
Boar! shall be organi9e! not later than si; *0+ months from the effecti6it5 of the Architecture Act
of &''(#
SECTION 5. A4)'%-%.)&%,+2 ,- M(*=(12 ,- &3( P1,-(22%,+)' R(74')&,1/ B,)16
Each Member shall, at the time of hisAher appointment, possess the follo2ing
<ualifications=
(1) be a citi9en an! a resi!ent of the Philippines>
*b+ be a hol!er of a !egree in Bachelor of %cience in Architecture conferre! b5 a school,
college or uni6ersit5 in the Philippines or abroa! that is recogni9e! an!Aor accre!ite! b5 the
Commission on Higher E!ucation *CHED+>
(3) be an architect 2ith a 6ali! Certificate of Registration an! Professional
I!entification Car! an! acti6e practitioner of architecture for at least ten *-'+ 5ears on the !ate of
hisAher appointment>
(4) not be a member of the facult5 of an5 school, college, uni6ersit5 or re6ie2
institution 2here a regular course or re6ie2 course in architecture is taught, nor ha6e pecuniar5
interest in such institution# "o former member of the facult5 of an5 school, institute, uni6ersit5
or re6ie2 center 2here architecture is taught can become a member of the Boar! unless heAshe
ha! officiall5 resigne! from such an institution an! has completel5 stoppe! teaching, a!6ising or
re6ie2ing acti6ities for at least fi6e *C+ 5ears prior to the nomination>
(5) has ne6er been con6icte! of an5 crime in6ol6ing moral turpitu!e> an!
(6) not be an electi6e officer of the Integrate! an! Accre!ite! Professional Organi9ation
of Architects an! other Professional Organi9ation of Architects#
SECTION 6. T(1* ,- O--%.(
The members of the Boar! shall hol! office for a term of three *B+ 5ears after
appointment or until their successors shall ha6e been appointe! an! !ul5 <ualifie!# An5 6acanc5

occurring 2ithin the term of a member shall be fille! for the une;pire! portion of the term onl5#
Each member of the Boar! ma5 be reappointe! for one full term of three *B+ 5ears# Of the
members of the Boar! first appointe! un!er R#A# "o# /&00, one *-+ member shall be appointe!
an! hol! office as chairman for three *B+ 5ears, one *-+ member for t2o *&+ 5ears, an! one *-+
member for one *-+ 5ear# Each member of the Boar! shall <ualif5 b5 ta1ing the proper oath prior

accre!ite! professional organi9ation shall ha6e the responsibilit5 of !e6eloping a continuing
professional !e6elopment program for architects# Other entities or organi9ations ma5 become
CPD pro6i!ers upon accre!itation b5 the Boar!#
A program of Continuing Professional De6elopment *CPD+ shall be maintaine! through
an o6erall CPD program for architects !e6elope! b5 the nite! Architects of the Philippines, Inc#
%uch a program shall be formulate! b5 the Continuing Professional E!ucation *CPE+ Council for
Architects base! on the e;isting gui!elines of the Professional Regulation Commission 2ith

permit from the Boar! sub@ect to appro6al of the Commission, to practice hisAher profession in
connection 2ith the pro@ect to 2hich heAshe 2as commissione!= Pro6i!e!, That a foreign
national or foreign firm, 2hose name or compan5 name, 2ith the title architect, architectural
consultant, !esign consultant, consultant or !esigner appears on architectural plans,
specifications an! other relate! construction !ocuments, for securing buil!ing permits, licenses
an! go6ernment authorit5 clearances for actual buil!ing pro@ect construction in the Philippines
an! a!6ertisements an! billboar!s for mar1eting purposes, shall be !eeme! practicing
architecture in the Philippines, 2hether the contract for professional ser6ices is consummate! in

(4) Agencies, organi9ations or in!i6i!uals 2hether public or pri6ate, 2ho secure the
ser6ices of a foreign professional authori9e! b5 la2 to practice in the Philippines for reasons
aforementione!, shall be responsible for securing a special permit from the Professional

FINAL PROVISIONS

The Architecture profession shall be integrate! into one *-+ national organi9ation 2hich
shall be accre!ite! b5 the Boar!, sub@ect to the appro6al b5 the Commission, as the integrate!
an! accre!ite! professional organi9ation of architects= Pro6i!e!, ho2e6er, That such an
organi9ation shall be registere! 2ith the %ecurities an! E;change Commission, as a non:profit,
non:stoc1 corporation to be go6erne! b5 b5:la2s pro6i!ing for a !emocratic election of its
officials# An architect !ul5 registere! 2ith the Boar! shall automaticall5 become a member of the
integrate! an! accre!ite! professional organi9ation of architects an! shall recei6e the benefits
an! pri6ileges pro6i!e! for in R#A# /&00 upon pa5ment of the re<uire! fees an! !ues#
Membership in the integrate! an! accre!ite! professional organi9ation of architects shall not be a
bar to membership in other associations of architects#
Pursuant to Boar! Resolution "o# B, %eries of &''(, the nite! Architects of the
Philippines, Inc# is the e;isting integrate! an! accre!ite! professional organi9ation of registere!
architects, !ul5 accre!ite! b5 the Boar! sub@ect to appro6al b5 the Commission an! registere!
2ith the %ecurities an! E;change Commission *%EC+ as a non:profit, non:stoc1 corporation
go6erne! b5 B5la2s pro6i!ing for a !emocratic election of its officials
-#a# An architect !ul5 registere! 2ith the PRC shall automaticall5 become a member of
the AP an! shall recei6e the benefits an! pri6ileges pro6i!e! for an! !escribe! in its b5:la2s
upon pa5ment of re<uire! fees an! !ues# The AP shall 1eep an up!ate! official registr5 of its
bonafi!e members in!icating membership an! annual !ues official receipt number#
-#b# Bona fi!e members of the AP practicing the architectural profession shall be
re<uire! to pro6i!e their official IAPOA membership number an! receipt number together 2ith
their PRC registration number an! professional ta; receipt *PTR+ on official !ocuments prepare!
b5 them for purposes of obtaining go6ernmental regulator5 permits an! licenses#
-#c# The functions, !uties an! responsibilities of the AP as the IAPOA shall be the
follo2ing=
1) "ominations to the 6acanc5 of positions to the BOA>
2) Responsibilit5 of preparing a program of CPD>
c+ En!orsement of the practice of foreign nationals to be issue! temporar5Aspecial
permit>
4) Recommen!ation of compliance 2ith liabilit5 insurance un!er a temporar5Aspecial

5) Monitoring compliance an! en!orsing toAor filing a complaint 2ith the Boar! an!Aor
Commission for 6iolation of the R#A# "o# /&00, this IRR, Co!e of Ethics, %tan!ar!s of
Professional Practice an! other policies of the Boar! an! of the Commission an! 2ith other
agencies for 6iolation of other rele6ant la2s, regulations an! the li1e> an!
6) %ome other functions, !uties an! responsibilit5 as ma5 be prescribe! b5 the BOA
from time to time#

shall be effecti6e fifteen *-C+ !a5s follo2ing their publication in the Official 8a9ette or in t2o
*&+ ma@or !ail5 ne2spapers of general circulation#
SECTION 42. A881,81%)&%,+2
The Chairperson of the Professional Regulation Commission shall imme!iatel5 inclu!e in
the Commission?s programs the implementation of R#A# "o# /&00, the fun!ing of 2hich shall be
inclu!e! in the annual 8eneral Appropriations Act#
The amount necessar5 to carr5 out the initial implementation of R#A# "o# /&00 shall be
charge! against the current 5ear?s appropriations of the Professional Regulation Commission#
Thereafter, such sums as ma5 be necessar5 for the continue! implementation of R#A# "o# /&00
shall be inclu!e! in the succee!ing 8eneral Appropriations Act *8AA+#
SECTION 40. A.& N,& A--(.&%+7 O&3(1 P1,-(22%,+)'2
R#A# "o# /&00 shall not be construe! to affect or pre6ent the practice of an5 other legall5
recogni9e! profession#
SECTION 44. E+-,1.(*(+& ,- &3( A.&
It shall be the primar5 !ut5 of the Commission an! the Boar! to effecti6el5 enforce the
pro6isions of R#A# "o# /&00 an! this 3IRR of the Architecture Act of &''(4# All !ul5 constitute!
la2 enforcement agencies an! officers of national, pro6incial, cit5 or municipal go6ernment or of
an5 political sub!i6ision thereof, shall, upon the call or re<uest of the Commission or the Boar!,
ren!er assistance in enforcing the pro6isions of R#A# "o# /&00 an! this 3IRR of the Architecture
Act of &''(4, an! to prosecute an5 person 6iolating the pro6isions of the same#
The %ecretar5 of Hustice or his !ul5 !esignate! representati6e shall act as legal a!6iser to
the Commission an! the Boar! an! shall ren!er legal assistance as ma5 be necessar5 in carr5ing
out the pro6isions of R#A# "o# /&00 an! this 3IRR of the Architecture Act of &''(4#
An5 person ma5 bring before the Commission, Boar! or the aforementione! officers of
the la2, cases of illegal practice or 6iolations of R#A# "o# /&00 an! this 3IRR of the Architecture
Act of &''(4 committe! b5 an5 person or part5#
SECTION 45. S(8)1)=%'%&/ C')42(
If, for an5 reason, an5 section or pro6ision of the herein 3IRR4 or application of such
rules an! regulations or pro6ision to an5 person or circumstances is !eclare! unconstitutional or
in6ali!, the remain!er of this 3IRR of the Architecture Act of &''(4, or application of such
pro6isions to other persons or circumstances, shall not be affecte! b5 such !eclaration#
SECTION 46. R(8()'%+7 C')42(
An5 pro6isions of the rules, regulations, co!es, or!ers, resolutions, measures, an! other
policies or parts thereof issue! an! promulgate! pursuant to R#A# "o# C(C *as amen!e! b5 R#A#
