GENERAL CONDITIONS FOR ALL UNITS
The consent is given by the Board in consideration of the particulars in the application. Any change
or alteration or deviation made in actual practice from the particulars furnished in the application
will also be the ground liable for review/variation/ revocation of the consent order under sec 27 of
the Act of Water (Prevention & Control of Pollution) Act.1974 and section 21 of Air (Prevention &
Control of Pollution)Act.1981 and to make such variations as deemed fit for the purpose of the
Acts.
The industry would immediately submit revised application for consent to operate to this Board in
the event of any change in the quantity and quality of raw material / and products / manufacturing
process or quantity /quality of the effulent rate of emission /air pollution control
equipment/system etc.
The applicant shall not change or alter either the quality or quantity of the rate of discharge or
temperature of the route of discharge without the previous written premission of the Board.
The applicant shall comply with and carry out the directive/orders issued by the Board in this
consent order and at all subsequent times without any negligence on his part in case of non
compliance of any order/directive issued at any time and or violation of the terms and conditions of
this consent order the applicant shall be liable for legal action as per the prvision of the Law/Act.
The applicant shall make a application for grant of fresh consent at least 90 days before the date of
expiray of this consent order.
The assuance of this consent does not convey any property right in either real or personal property
or any exclusive previleges nor does it aurthorize any injury to private property or any invasion of
personal rights nor any infringement of Central/ State law or regulation.
This consent does not aurthorize or approve the construction of any physical structure or facilities
of the under taking of any natural water course.
The applicant shall display this consent granted to him in a permanent piace for personal or public
and inspecting offers of this Board.
An inspection book shall be opened and made avilable to Boards Offers during the visit to the
factory.
The applicant shall furnish to the visiting officer of the Board any information regarding the
construction installation or operation of the plant or of effulent treatment system / air pollution
control system / stack monitoring system any other particulars as may be pertinent to preventing
and controlling pollution of Water /Air.
Meters must be affixed at the entrance of the water supply connection so that such meters are
easly accessible for inspection and maintenance and for other purposes of the Act provided that
theplace where it is affixed shall in no case to be at a point before which water has been taped by
the consumer for utilization for any purposes whatsoever.
Sepreate meters which necessary pipe line for assessing the quantity of water used for each
purposes mentioned below.
a) Industrial cooling spraying in mine pit or boiler feed.
b) Domestic purpose
c) Process
The applicant shall display suitalbe caution board at the lace where the effluent is entring into any
water body or any other place to be indicated by the Board indicatingtherein that the area into
which the effluent are being discharge is not fit for the domestic use/bathing
Storm water shall not be allowed to mix with the trade and / or domestic effluent on the
upstream of the terminal manholes where the flow measuring devices will be installed.
The applicant shall maintained good house keeping both within the factory and the permises. All
pipes valves sewers and drains shall be leak proof. Floor washing shall be admitted into the
effluent collection system only and shall not be allowed to find their way instorm drain or open
areas.
The applicant shall all times maintained in good working order and operate as efficiently as possible
all treatment and control facilities or system s installed or used by him to achive with the term (s)
and conditions of the consent.
Care should be taken to keep the anaerobic lagoons.If any biologically active and not utilized as
mere stagnation ponds. The anaerobic lagoons shoud be fed with the required nutrients for
effective digestion. Lagoons should be constructed with sides and bottom made imprevious.
The utiliztion of treated effluent in the factory's own land. If any should be completed and there
shoud be no possibility of the effluent gaining access into any drainage channel or other water
courses either directly or by overflow.
The effluent desposal no land if any should be done without creating any nuisance to the
surroundings or inundation of the lands at any time.
If at any time the disposal of treated effluent on land becomes incomplete or unsatisfactory or
creat any problem or becomes a matter of dispute. The industry must adopt alternate satisfactory
treatment and disposal measures.
The sludge from treatment units shall be dried in sludge drying beds and the drained liquid shall be
taken to equalization tank.
The effluent treatment units and disposal measures shall become operative at the time of
commencement of production.
The applicant shall provide port holes for sampling the emissions and access plateform for carrying
out stack sampling and provide electrical outlet points and other arrangements for chimneys
/stacks and other sources of emissions so as to collect samples of emission by the Board of the
applicant at any time in accordance with the provision of the Act or Rules made therein.
The applicant shall provide all facilities and tender required assistance to the Board stoff for
collection of sample stack monitoring / inspection.
The applicant shall not change or alter either the quality or quantity of the rate of emission or
install , replace or alter the air pollution control equipment or change the ra material or
manufacturing process resulting in any change in quality and /or quantity of emission without the
previous written permission of the Board.
No control equipments or chimney shall be ultered or replaced or as the case may be erected or
reerected except with the previous approval of the Board.
The liquuid effluent arising out of the operation of the air pollution control equipments shall be
treated in the manner and to ion of standards prescribed by the Board in accordance with the
provision of water (Prevension & Control of Pollution)Act 1974 (as ammended)
The stack monitoring system impecyed by the applicant shall be opend or inspection to this Board
at any time.
There shall not be any figitive or episodal discharge form the permises.
In case of such episodal discharge emission the industry shall take immediate action to bring down
the emission within the limits prescribed by the Board in conditions / stop the operation of the
plant report of such accidental discharge /emission shall be brought to the notic of the Board
within 24 Hrs of occurance.
The applicant shall keep the premises of the industrial plant and air pollution control equpments
clean and make all hoods, pipe ,volves, stacks /chimney leak proff . The air pollution control
equipments location, inspections chambers, sampling ports holes shall be made easily accessable at
all time.
Any upset condition in of the plant /plants of the factory which is likely to result increased effluent
discharge/ emissions of air pollutants and /or result in violation of the standards mentions above
shall be reported to the Headquarters and Regional Office of the Board by fax / speed post with in
24 Hrs of its occurance.
The industry has to insure that minimum three varities of trees or planted at the density of not less
than 1000 trees per acre. The trees may be planted along boundenses of the industry or industrila
permises. The plantation is stipulated over and above the bulk plantation of trees in that area.
The solid waste such as swipping wastege pakage, impty container residuce, sludge including that
form air pollution control equipments collected within the permises of the industrial plants shall be
disposed of scientifically to the satisfaction of the Board so as no to cause figitive emission dust
problems through leaching etc of any kind.
The solid waste arrising in the permises shall be properly classified and disposed off to the
satisfaction of the Board by
Landfill in case of innert material care being taken to insure that the material does not give rise to
leachate which may percolate into ground water or carried away with storm run/off
Controlled incineration whereever possible in case of combusitible organic material.
Composting in case of Bio-degradable material
Any toxic material shall be detoxicated if possible otherwise be shied in steel drums and burined in
protected areas after obtainign approval of this Board in writing. The detoxication or sealing and
burying shall be carriedout in the presence of Boards aurthorized persons only letter of
aurthorization shall be obtained for handling and disposal of hazardous wastes.
If due to any technological improvement or otherwise this Board is of opnion that all are any of the
conditions refered to above requires variation (including the change of any control equipments
either in hole or in part). This Boards shall after giving the applicant an apportunity of being heard,
very all or any of such condition and their upon the applicant shall be bound to comply with the
conditions so varied.
The applicant, his/ hers/ legal representative of assignees shall have no claim whatsoever to the
condition of renewal of this consent after the expiry period of this consent.
The Board reserves the right to review impose additional conditions or condion , revoke chage or
after the terms and codition of this consent.
Not with standing any thing contained in this conditioal letter of consent , The Board hereby
reserve to it the right power under section 27 (2) of the Water (Prevention & Control of Pollution
)Act 1974 to review any and / or all the conditon imposed herein above and to make such
variations as deemed fit for the purpose of the Act by the Board.
The conditions imposed as abve shall continue to be in force untill revoke under section 27 of the
Water (Prevention & Control of Pollution )Act 1974 section 21 A of Air (Prevention & Control of
Pollution ) Act 1981.
In case the consent fee is revised upward during this period, the industry shall pay the diffrential
fees to the Board (for the remaining years) to keep the consent order inforce if they fail to pay
amount within the period stipulated by the Board the consent order revocked without prior notic.
The industry shall comply to all the conditons stipulated under charter on Coprate Responsibility
for Environemntal Protection (CREP) guideline in a time bound manners as envisaged therein (if
applicable)
The industry shall comply to the condition stipulate in CTE order issued by Odisha State Pollution
Control Board and conditions stipulated in Environmental Clearance issued by MoEF Government
of India.
The industry shall abide by E(p)Act, 1986 & Rules framed their under.
The Boards reserve the right to revoke /refuse consent to operate at any time during period for
which consent is granted in case any violation if observed and to modify /stipulate additional
condition as deemed appropraite
GENERAL CONDITINS FOR UNITS WITH INVESTMENT OF MORE THAN Rs.50 CRORES. AND 17
CATEGORIES OF HIGHLY POLLUTING INDUSTRIES (RED A)
The applicant shall analyse the emissions every months for the paramenters indicated in table B &
C as mentioned in this order and shall furinshed the report thereof to the Board by the 10 of the
succeeding month.
The applicant shall provide and maintained at his own cost three ambient air quality monitoring
stations for monitoring Suspended Particulate Matter, Sulphur Di-oxide, Oxides for Nitrogen, Hydro
Carbon, Carbon Monoxide & Monitor the same ones in day / week / fortnight/ month. The data
collected shall be maintained in a register and a monthly extract be furnish to the Board.
The applicant shall provide and maintained at his own cost a meteorological station to collect the
data on wind velocity, direction , temeperature, humidity, rainfall etc. and the daily reading shall be
recorded and the extreact sent to the Board in a month.
The applicant shall forward the following information to the Mamber Secratory State Pollution
Control Board Odisha Bhubaneshwar regularly.a. Report of analysis of stack monitoring, ambient
air quality monitoring , meteorological data as required every month.
b. Progress of planting of trees quarterly.
The applicant shall install mechanical composite sampling equipments and Continuous flow
measuring / recording devices on the efluent drains of trade as well as domestic effluent. a record
of daily discharge shall be maintained.
The following information shall be farwarded to the Member Secratory on or before 10th of every
month. a . Performance/ progress of the treatment plant. b . Monthly statement of daily discharge
of domestic and / or trade effluent.
