2RELI%INARY
1. These Reguatons may be cted as the V+**&4- L&/.
R-4u*&#+o/,, 2001.
Ctaton
2. In These Reguatons, uness the context otherwse requres-
"Act" means the Vage Land Act, 1999;
"authentcated agreement" means a bndng and wrtten
agreement between the partes to a process of
medaton factated by a medator and sgned by the
partes and the medator;
"commttee" means a vage ad|udcaton commttee
estabshed under secton 53 of the act and ncudes an
ad|udcaton omcer exercsng powers under secton 56
of the Act;
"Counc" means the Vage and Counc estabshed by
secton 60 of the Act;
"Court" has the meanng ascrbed to t by the Act;
"Customary rght of occupancy" has the meanng ascrbed to t
by the Act;
dervatve rght" has the meanng ascrbed to t by the Act;
"Dstrct Land Omcer" means an authorsed omcer apponted
as such under Secton 11 of the Land Act, 1999;
"Dstrct Land Regstry" means the Dstrct Land Regstry
estabshed under the Land Regstraton Ordnance,

"Government" means the Government of Unted Repubc of
Tanzana;
"nforma mortgage" means the mortgage provded for by
paragraph (a) of subsecton (6) of secton 112 of the
Land Act, 1999;
"nterest n the proceedngs" means an nterest, pecunary or
otherwse, that coud conct wth the proper
performance of a persons functons n hearng and
determnng any matter and ncudes an nterest of a
bood reatve or a reatve by marrage;
"|ont management arrangement" means the arrangement for
the |ont management of vage and whch may be
provded for under secton 8 of the Act;
"en by depost of documents" means the depost of any
document referred to n sub-paragraphs (), (), (v)
and (v) of paragraph (b) of subsecton (6) of secton 112
of the Land Act, 1999;
"Loca Government Authorty" has the meanng ascrbed to t
by secton 2 of the Act;
"Occuper" means hoder of customary rght of occupancy;
"Omcer" means the Vage Executve Omcer;
"Ouaed Vauer" has the meanng ascrbed to t by secton 2
of the Land Act, 1999;
"regstered document" means a certcate of customary rght
of occupancy or a dervatve rght as provded for by
Part IV of the Act, appearng n the Frst Schedue of
these Reguatons;
"Regster of Vage Land" means the regster of vage and
mantaned pursuant to secton 21 of the Act;
"Vage Executve Omcer" means a person apponted under
the reevant aws to hod the omce of Vage Executve
Omcer;
"Vage nsttuton" means a vage counc, a commttee of a
vage counc, a vage ad|udcaton commttee, and an
ad|udcaton omcer exercsng powers under secton 56
of the Act.

5. The notce of a hearng nto any matter by a vage nsttuton

under these Reguatons sha be as prescrbed n the Frst Schedue.
". An order requrng the attendance of a person or requrng a
person to produce a document before a vage nsttuton sha be n
the forms prescrbed n the Frst Schedue.

5. (1) A summons ssued by the charman of a commttee or
an ad|udcaton omcer exercsng powers under secton 56 of the Act
to a person to attend a hearng under secton 54 of the Vage Land
Act sha gve the person to whom t s addressed not ess than 14
days notce of the day on whch he or she s to attend the hearng.
(2) A summons to whch ths reguaton refers sha be as
prescrbed n the Frst Schedue.

. An oath whch may be admnstered by the charman of a
commttee or an ad|udcaton omcer exercsng powers under secton
56 of the Act may be as prescrbed n Form No. 5 of the Frst Schedue
to these reguatons.

6. In any hearng hed under the provsons of the Act or these
Reguatons, a vage nsttuton sha compy wth the rues of natura
|ustce n determnng ts procedures and sha-
(a) conduct the hearng n pubc and n an
nforma atmosphere but wth due regard to order,
decorum and farness to a partes and sha make pan
to any representatves appearng for any partes that
the vage nsttuton sha concentrate on the
substance of the matter before t and admnster
substantve |ustce wthout undue regard to
techncates;
(b) excude any member of the vage nsttuton
who has an nterest n the proceedngs, whch nterest
such member of the vage nsttutons sha be under a
duty to decare, and that member sha not st or n any
way be nvoved n a hearng as a member of the vage
nsttuton;
(c) before the hearng determne and announce
the hours of the day when the hearng sha take pace
and n dong so sha have regard to the convenence of
the partes and the norma patterns of work n the area
where the hearng s to take pace;
(d) permt a persons wshng to make
representatons to the vage nsttuton to appear n
person or by a representatve;
(e) aow the person summonsed to state hs or
her case rst and then he questoned on any aspect of
t or be asked to gve further nformaton about t by
any member of the vage nsttuton present at the
hearng or any other person camng an nterest n the

and whch s the sub|ect of the hearng;
(f) after the person summoned has put hs or her
case, aow any person camng an nterest n the and
to put hs or her case and be questoned on t by any
member of the vage nsttuton present at the hearng
and the person summonsed;
(g) aow any person to make representatons both
n person or n wrtng or n person and n wrtng;
(h) where the vage nsttuton ntends to ca
evdence on any matter or ssue, nform a the partes
to the hearng of that fact and aow them to comment
on and ask questons about that evdence;
() where the vage nsttuton vsts and nspects
the and whch s the sub|ect of hearng, aow a
persons camng an nterest n the and to pont out
features of the and and make other ponts about the
and and ther nterests n the and;
(|) ether by the charman of the vage nsttuton
or any omcer apponted for the purpose by the
charman, keep notes of the proceedngs at the hearng
ncudng notes of any vsts made to any and n the
course of the hearng;
(k) may accept as evdence about the boundares
of the and the sub|ect of the hearng-
() a statement about the boundares by any
person acknowedged n the communty
as beng trustworthy and knowedgeabe
about and maters n the vage;
() smpe or customary forms of surveyng
or demarcatng boundares usng natura
features and trees or budngs and other
promnent ob|ects;
() human actvtes on or about the and
such as the use of footpaths, catte tras,
waterng ponts, and the pacng of
boundary marks on the and;
(v) maps, pans and dagrams, whether
drawn to scae or not, whch show by
reference to any of the matters referred
to n subparagraphs () or () of
paragraph (k) the boundares of the and;
() pay partcuar regard to the nterests n the
and the sub|ect of the hearng of women, chdren and
dsabed persons and ensure that a such nterests are

(m) n decdng whether to exercse ts dscreton to

any partes to the hearng to reconce any dherences
they may have about ther respectve nterests n the

(n) have regard to the desrabty, at any tme
durng or after a hearng has ended of makng a
premnary ndng on any matter and where t does so,
t sha nvte the partes to comment on that ndng
ether n person or n wrng;
(o) try to reach a consensus on a decsons but f
that s not possbe, then a ma|orty decson may be
reached wth the reasons for both the ma|orty decson
and the mnorty poston beng recorded;
(p) n decdng whether any ssue has been
provde before the vage nsttuton, determne
whether the facts have been proved on the baance of
probabtes, that s, whether t s more key than not
that any fact has been proved;
(q) prepare a report whch sha ncude-
() the names of the members of the vage
nsttuton who hed the hearng;
() the date of the hearng;
() the names of the partes;
(v) a summary of the evdence of the partes
and a wtnesses;
(v) the ndngs on a aspects of the case
and cams together wth the reasons for
those ndngs;
(v) the recommendatons on a aspects of
the case and cams together wth
reasons for those recommendatons;
(r) sgn the report prepared n accordance wth
the provsons of paragraph (q).
2ART III
CO%2ENSATION
(. The foowng may cam compensaton n respect of vage
and whch s transferred to genera or reserved and under secton 4

of the Act or whch s decared to be hazard under secton 6 of the Act
and from whch the vage counc determnes that vagers sha be
requred to vacate that hazard and or part thereof-
(a) a vage counc on behaf of the vagers n
respect of the oss of communa and, assets and
benets derved from that communa and;
(b) any vager occupyng transferred and or
hazard and under a customary rght of occupancy
whether that customary rght of occupancy s regstered
or not.
9. The bass for assessment of the vaue of any and and
unexhausted mprovement for purposes of compensaton, under the
Act sha be the market vaue of such and.

10. The market vaue of any and unexhausted mprovement sha
be arrved at by use of comparatve method evdenced by actua
recent, saes of smar propertes or by use of ncome approach or
repacement cost method where the property s of speca nature and
not saeabe.

11. Every assessment of the vaue of and and unexhausted
mprovement for the purposes of the Act sha be prepared by
quaed vauer.

12. Every assessment of the vaue of and and unexhausted
mprovement for the purposes of payment of compensaton by
government or Loca Government Authorty sha be vered by the
Chef Vauer of the Government or hs representatve.

15. Compensaton for oss of any nterest n and sha ncude
vaue of unexhausted mprovement dsturbance aowance, transport
aowance, accommodaton aowance and oss of prots.

1". The market rent for the budng sha be assessed and
mutped by thrty sx (36) months n order to arrve at the
accommodaton aowance payabe.

15. The net monthy prot of the busness carred out on the and
sha be assessed (evdenced by audted accounts where necessary

vaue of the and by average percentage rate of nterest ohered by
Commerca Banks on xed deposts for tweve (12) months at the

tweve (12) tons of uggage by ra or road (whchever s cheaper)
wthn twenty (20) kometres from the pont of dspacement.

19. (1) The nterest upon any compensaton sha be pad by
the Government or the oca government authorty ony where there s
no prompt payment of compensaton made.
(2) For the purpose of computng nterest payabe upon
compensaton "prompt payment of compensaton" means payment of
compensaton wthn sx months after the sub|ect and has been
acqured or revoked.
(3) Where amount of compensaton remans unpad for sx
months after acquston or revocaton, nterest at the average
percentages rate of nterest ohered by commerca banks on xed
depost sha be recoverabe unt such compensaton s pad.

20. In cases to whch sectons 4 and 6 of the Act appes, the
Commssoner sha serve a notce n the form set out n the Frst
Schedue on the vage counc and on a persons occupyng and
under a customary rght of occupancy or a dervatve rght wthn the
area of and covered by a notce of proposa to transfer vage and or,
as the case may be, a notce to decare and as hazard and nvtng
the vage counc and a such persons as are referred to n ths
reguaton to submt cams for compensaton.

21. A cam for compensaton sha be submtted on a form set out
n Part III of the Frst Schedue to these Reguatons wthn not ess
than sxty days of the recept of the notce referred to n reguaton
20.

22. The Authorsed Omcer sha, at the request of the Omcer of the
vage whose and s the sub|ect of a notce under secton 4 of the Act
to transfer vage and or a notce under 6 of the Act to decare vage
and to be hazard and, provde assstance to that vage and to
persons occupyng and the sub|ect of those notces to prepare and
submt cams for compensaton.

25. (1) The Commssoner sha, wthn not more than nnety
days from the date on whch the cams of compensaton are
submtted, determne whether to accept or re|ect those cams or any
of them.
(2) Where the Commssoner accepts any cam for
compensaton submtted under reguaton 21, he sha report that fact
to the Mnster.
(3) Wthn twenty one days of the recept of the report by
the Mnster the Commssoner sha to arrange for compensaton to
be provded to the camant.

2". (1) Where the Commssoner determnes not to accept a
cam for compensaton, the cam, may, f the camant and the
Commssoner so agree, he referred to a person apponted by the
Medaton on

(2) Where the medator s abe to ahect an agreement
between the partes, he sha report the agreement to the Mnster,
and the Commssoner sha, wthn twenty one days of the recept of
the report from the medator, arrange for compensaton to be
provded to the camant.
(3) Where the medator s unabe, wthn nnety days of
negotaton between the partes, to assst the partes or reach on
agreement on a cam for compensaton or where the partes or one of
them are unwng to refer the cam to a medator, the cam sha be
referred to the competent Court.
25. Compensaton under secton 4 and 6 of the Act and reguaton
13 may take the form of a or any of the foowng-
(a) and of comparabe quaty, extent and
productve potenta to the and ost;
(b) a budng of comparabe quaty, extent and
use wth comparabe to the budng ost;
(c) pants and seedngs;
(d) access to communa assets;
(e) a sum of money equa n vaue to the
unexhausted mprovements on the and transferred or
decared to be hazard and or to compensate for the
reducton n amount of and ether through the oss of or
damage to the and whch can be used for productve
purposes or to pay for the costs of dsturbance brought
about by the transfer of the and or the decaraton of
the and as hazard and;
(f) reguar suppes of gran and other basc
foodstuhs for a speced tme;
(g) such other forms of compensaton as may be
agreed between the camant and the Commssoner.

3OINT %ANAGE%ENT OF VILLAGE LAND
2. A proposa for the |ont management of vage and between
two vages or a vage and a dstrct counc or an urban authorty
may be made by the Commssoner to the vage councs and dstrct
counc or urban authorty or by a vage counc to another vage
counc or to any oca authorty or by any oca authorty to a vage
counc wth whch t s proposed to estabsh such a |ont
management arrangement.

29. The vage councs and oca authortes whch vote n favour

50. Where the |ont commttee has reached agreement on a draft
|ont management arrangement, t sha be referred to the vage
assemby and the counc of the oca authorty for those bodes to
consder and vote on the arrangement.

propose changes n the draft |ont management arrangement and any
such proposed changes sha be referred to the |ont commttee for ts

the arrangement s agreed on the terms of the arrangement and has

REGISTER OF VILLAGE LAND
5. The Regster sha be dvded nto the foowng Parts:
(a) Part A: the Certcate of Vage Land;
(b) Part B: the Tte Regster; and
(c) Part C: the Pubc Charges Regster.

56. (1) A Certcate of Vage Land sha be n the form
prescrbed n the Frst Schedue and sha be kept n a separate foder
n the Regster.
(2) The ony entres that may be made on a Certcate of
Vage Land are:
(a) ateratons requred to be made by the
Commssoner to record changes n the
boundares of the vage and;
(b) entres to record parces of and that have

(1) sha be on the form speced n the Frst Schedue to these
Reguatons.

Mnster sha take nto account:-
(a) a such nformaton and gudance as s

and forestry actvtes n dherent areas and agro-
economc zones of Tanzana n order to foster emcent
and ehectve agrcutura deveopment and sustanabe

(b) the need to promote and measure the

6. (1) Unt such tme as orders have been made and
pubshed under reguaton 74, no vage counc may grant or agree
to grant or agree to a dsposton of a customary rght of occupancy or
create or agree to the creaton of a dervatve rght n vage and or
out of a customary rght of occupancy whch exceeds twenty hectares
or whch woud resut n a vager occupyng and n excess of twenty
hectares or the maxmum amount of and hed by a vager n that
vage whchever s the esser amount wthout the consent of the
Dstrct Counc or the Commssoner as s provde for by hs
reguaton.
(2) Where the appcaton s made to the vage counc for
an amount of and whether by way of a customary rght of occupancy
or by way of a dervatve rght or consent to the grant of a dervatve
rght whch s between twenty-one and fty hectares n extent, the
vage counc sha forward that appcaton to the dstrct counc
havng |ursdcton n the dstrct where the vage s stuate together
wth ts recommendaton on that appcaton and sha not grant that
appcaton uness and unt the Dstrct Counc sha sgnfy n wrtng
to the vage counc that t consents to that appcaton.
(3) Where an appcaton s made to the vage counc for
an amount of and whether by way of a customary rght of occupancy
or by way of a dervatve rght or consent to the grant of a dervatve
rght whch s greater than fty hectares n extent, the vage counc
sha forward that appcaton to the Commssoner together wth ts
recommendaton on that appcaton and sha not grant that
appcaton uness and unt the Commssoner sha sgnfy n wrtng
to the vage counc that he consents to that appcaton.

(a) be guded by the prncpes of ob|ectvty,
farness and |ustce, gvng consderaton to, among
other thngs, the rghts and obgatons of the partes,
the customary and statutory aws and tradtona
practces on and, due regard beng had to

surroundng the matter ncudng any prevous deangs
or dsputes between the partes;
(b) conduct the medaton n such a manner as t
consders approprate, takng nto account the wshes of
the partes, the crcumstances of the case and the
desrabty of reachng a speedy settement of the
dspute;
(c) meet or communcate wth the partes
together or separatey;
(d) at any stage of the proceedngs make
proposas, ether oray or n wrtng and wth or wthout
reasons for the settement of any dspute between the
partes;
(e) as a resut of medcaton, when t appears that
there are eements of an agreement or settement
whch may be acceptabe to the partes, formuate the
terms of the agreement or settement and expan the
terms to the partes and after recevng those
comments from the partes, reformuate those terms
takng nto account those comments.
(2) Where an agreement or settement has been reached
between the partes, the commttee or counc as the case may be
sha draw up a wrtten agreement whch, once t has been sgned by
