INTRODUCTION:
K. M. Nanavati vs. State of Maharashtra was a 1959 Indian court case where
Kawas Manekshaw Nanavati, a Naval Commander, was tried for the murder of
Prem Ahuja, his wife's lover. The incident received unprecedented media
coverage and inspired several books and movies. Nanavati was initially declared
not guilty by a jury, but the verdict was dismissed by the Bombay High Court
and the case was retired as a bench trial. The case was the last to be heard as a
jury trial in India, as the government abolished jury trials as a result of the case.
CONCLUSION:
This case was a high profile case of crime of passion was K.M.Nanavati was
tried for murder of PremAhuja, his wife lover. Case went to court dew to all the
media attention it received to Nanavati he was declared as not guilty by the jury
of 8-1. But later on case went to Bombay high courts were Nanavati was
declared as culpable homicide and sentenced to life imprisonment. As it was the
last case to be heard as a jury trial in India, the government abolished jury trial as
a result of this case.
In the case of Nanavatithere were several hurdals the person who was fighting
the case of nanavati was Ram jethmalani, a prominent lawyer who was famous
for manipulating the case and bring the judgment in his side. As the jury is of 1-8
members can be easily manipulated in India which makes the judgment biased.
Sooner this system of jury was abolished a good step was taken by the
government of India. This system was not at all working in the favor of innocent
people powerful and rich people were taking the advantage of this system as they
knew that whatever or how big the crime they will do still their lawyer will save
him by anyhow. The whole system of jury became corrupt people became more
lenient by this system.
So abolishing this act was a good decision.
