LEASE AGREEMENT

THIS AGREEMENT OF LEASE made and executed on this the 28th


day of April 2007, BY AND BETWEEN:

Mr. TANOJ KUMAR, S/o Gopal Krishna, aged about 36 years,


residing at No.70/6, Robertson Road, Frazer Town, Bangalore –
560005, here in after referred to as the LESSOR (which expression
shall mean and include his heirs, legal representatives, executors,
administrators and assigns) of the ONE PART.

In favour of Mr. P S Balakrishnan, aged 27 years, S/o Mr. P


Sasikumar, working at TEXT 100 PUBLIC RELATIONS, No 20,
Annaswamy Mudaliyar Road , Ulsoor , Bangalore – 560042, here in
after called the LESSEE (which term shall mean and include his
heirs, legal representatives, executors, administrators and assigns) of
the OTHER PART witness as follows:

Whereas the LESSOR is the sole and absolute owner of the schedule
property bearing Flat No B-2, First Floor, White Oaks Apartments,
1st Cross, D’costa Layout, Cooke Town, Bangalore-560084.

WHEREAS the Lessor has agreed to grant and the lessee has agreed
to accept a lease premises of the first floor above said premises, here
in after referred to as the Schedule Premises subject to the terms and
conditions hereinafter set out.
NOW THIS AGREEMENT WITNESSED

1. That in consideration the lessee here by reserved the terms,


conditions and covenants of the lease herein contained on the
part of parties to be observed and performed the sessor hereby
agrees to grant and the lessee hereby agrees to accept a lease of
the schedule premises

RENT

The rent payable by the lessee for the schedule premises shall be a
sum of Rs.5000 { rupees five thousand only} per month and sum of
Rs.4500/- {rupees three thousand five hundred only} towards
amenities per month payable by the lessee to the Lessor not later than
the 5th day of each month for the calendar month immediately
proceeding such payment.

DURATION

The lease be deemed to have commencing on and from 1st May 2007
and shall be only for period of eleven [11] months

DEPOSIT

The security deposit for the schedule premises is Rs.95, 000/-[rupees


ninety five thousand only] The Lessor herein acknowledges the
receipt(subject to realization) for the same and the amount shall not
carry any interest and the same will be refunded to the lessee, subject
to deduction of arrears rent or any damages, at the time of handing
over the vacant leased premises to Lessor. (ICICI Bank cheque no.
995438 dated 2/05/2007)

TAXES AND ELECTRICITY CHARGES


The Lessor shall bear and pay the taxes, present and future, payable
in respect of the schedule premises to the corporation of the city of
Bangalore, Bangalore Development Authority and any other body of
authorities, the lessee shall bear and pay the charges for electricity
consumed during the period of the lease and any extension thereof,
directly to the concerned authority.

MAINTENANCE

The lessee shall maintain the schedule premises in good and


tenantable condition, reasonable wear and tear excepted, the lessee
shall pay the maintenance charges directly to the apartment
association.

NATURE OF USE

The lessee shall use and permit the Schedule Premises solely for the
residential purposes of lessee’s family.

INSPECTION

The lessee shall permit the Lessor of his behalf to inspect the
schedule premises at all reasonable time provided that the Lessor
shall give notice of such inspection at least twenty four thereto.

ENHANCEMENT

The rent will be enhanced by five percent [5%] after the lease period
i.e. after Eleven [11] months

SUB-LEASE
The lessee shall not be permitted to sub-let of under-let the schedule
premises and any portion thereof to any persons strictly, and shall not
be permitted to allow or to stay other than the lessee.
TERMINATION

A) The Lessor shall be entitled to terminate the lease in case of


default by the lessee in payment of the rent for a period of two
(2) months consecutive months.
B) Before 11 months, if the Lessee vacates the premises, a penalty
amount of equal to remaining month rents will be charged,
same will be deducted from the deposit amount.
C) After 11 months, if the Lessee has to vacate the premises, then
he has to provide 2 months of notice to the Lessor

SCHEDULE

ALL THAT PIECE AND PARCEL OF PREMISES bearing Flat


No,B-2, First Floor, White Oaks Apartment,1st Cross, D’costa
Layout, Cooke Town, Bangalore-560084, consisting of two
bedrooms with attached bathroom, one drawing cum dining one
kitchen etc.

FITTINGS AND FIXTURES

1) Four ceiling fans


2) Wardrobes in two bathrooms
3) Kitchen cabinet shelves (wooden shelves) with exhaust fan
4) Two electrical geysers

LIST OF FIXTURES AND FITTINGS

AT FLAT B-2 FIRST FLOOR, WHITE OAKS APARTMENT, 1st


cross, D’costa Layout, Cooke Town, Bangalore.
False ceiling with electrical fittings, T.V, cabinet, dining table with
six chairs, curtain rods and chandeliers at the hall.
Master bedroom and two sides as portion.

One chandelier in the balcony aluminum shutters.

Second bedrooms, full-length mirrior, one chandelier curtain rods.

Electrical points provided with bulbs

Mr. Balakrishnan shall use and maintain the said fixtures and fittings
tenantable condition at no extra cost of charges subject to normal
wear and tear and damages by the act of God, fire (not caused by any
act of the default on the part of the user) war riot civil commotion,
mob violence or any irresistible force being expected. The users will
carry out all repairs.

This agreement shall be effective from the 28th day of April 2007 for
a period of eleven months.

IN WITNESS thereof the lessor and lessee have signed this


document in the presence of the witnesses on the day of the month
and year fires above written.

WITNESSES

Lessor and lessee have agreed to renew the agreement for the period of 11
month. Effective from 1 st May 2009.

Hereafter the rent payable by the lessee for the schedule premises shall be a
sum of Rs.5000 { rupees five thousand only} per month and sum of
Rs.5500/- {rupees five thousand five hundred only} towards amenities per
month payable by the lessee to the Lessor not later than the 5th day of each
month for the calendar month immediately proceeding such payment.
