    ResolutionoftheBoardofWaterCommissioners

    RegardingtheMemorandumofUnderstanding
    FortheFormationoftheGreatLakesWaterAuthority

    September17,2014

    WHEREAS ThisIndependentBoardofWaterCommissioners(BOWC)wascreatedbyastipulated
    orderthatwassignedbytheMayoroftheCityofDetroit,theWayneCountyExecutive,theMacomb
    CountyPublicWorksCommissioner,andtheOaklandCountyWaterResourcesCommissioneron
    February11,2011;and

    WHEREAS ThecurrentBOWChasspentatremendousamountoftimelearningaboutthesystemsandhasworked
    cooperativelywiththeDetroitWaterandSewerageDepartment(DWSD)managementtoimprove
    operationsattheDWSDsincebeingseatedinAprilof2011;and

    WHEREAS InMarchof2013,theBoardofWaterCommissionersapprovedamotiontosupportthefinalRootCause
    CommitteesreportofthesamedayinwhichtheRootCauseCommitteerecommendedthe
    establishmentofaregionalauthoritytooperateandmanagetheDetroitWaterandSewerage
    department.Thatplancalledfortheestablishmentoftwonewauthorities,oneofwhichwassuburban
    controlledtomanageratesandrevenuesandtheothercontrolledbytheCityofDetroittomanage
    operations,withanannual$50millionleasepaymenttotheCityofDetroit;and

    WHEREAS OnMarch27,2013,JudgeCoxfoundthatDWSDhadachievedsubstantialcompliancewiththeClean
    WaterActand,therefore,dismissedthethirtysixyearlitigationmatter,UnitedStatesvCityofDetroit,
    etal(CaseNo.7771100);and

    WHEREAS DiscussionsconcerningtheestablishmentofaregionalauthorityhavecontinuedduringDetroits
    bankruptcylitigation,culminatinginthehistoricactionofthefilingofaMemorandumofUnderstanding
    RegardingtheFormationoftheGreatLakesWaterAuthority(MOU)signedbytheEmergency
    ManageroftheCityofDetroit,theMayoroftheCityofDetroit,theWayneCountyExecutive,the
    OaklandCountyExecutive,theMacombCountyExecutive,andtheGovernoroftheStateofMichigan,

    NOWTHEREFOREBEIT:

    RESOLVED ThattheBoardofWaterCommissionershasreviewedtheMOUandcontinuestobelievethatthe
    formationofaregionalauthorityisthebestoptiontoprotectthefutureofpeopleofsoutheastern
    MichiganservedbytheDetroitWaterandSewerageDepartment,tosupportlongtermcompliance
    efforts,andtoprotectandgrowourcustomerbase;andbeitFurther

    RESOLVED ThattheBOWCiscommittedtoworkingwithitsregionalpartnerstotakethenecessarystepsto
    implementthevisionoftheGreatLakesWaterAuthoritywhilecontinuingtooperatetheDWSDatan
    optimallevelduringtheinterimtimeframe;andbeitFinally

    RESOLVED ThatacopyofthisresolutionbetransmittedtotheMayoroftheCityofDetroit,theDetroitCityCouncil,
    theMacombCountyExecutive,theMacombCountyPublicWorksCommissioner,theOaklandCounty
    Executive,theOaklandCountyWaterResourcesCommissioner,theWayneCountyExecutive,andthe
    GovernoroftheStateofMichigan.
