22 The undersigned represents DR. WILEY DRAKE and MARKHAM ROBINSON,

23 Plaintiffs and APPELLANTS in this matter, and no other party. On December 8, 2009, The

24 Ninth Circuit Court of Appeals entered an order with the District Court, instructing the

25 APPELLANTS to notify the Appellate Court, in writing, of the disposition of a post-

26 judgment motion within five days of the District Court’s ruling on the motion. The order

27 also instructed the APPELLANTS to notify the Appellate Court if they intended to

28

1 prosecute their appeal and to file an amended notice of appeal if they intended to appeal the
2 District Court’s ruling on the post-judgment motion.
3 Pursuant to the Appellate Court’s order, APPELLANTS hereby give notice that, on
4 December 4, 2009, the District Court denied the post-judgment motion. The motion was an
5 “Amended Motion for Reconsideration,” which was filed by Plaintiffs’ attorney ORLY
6 TAITZ. APPELLANTS will not be appealing the District Court’s denial of the post-
7 judgment motion.
8 APPELLANTS also hereby give notice that they intend to prosecute the appeal, the
9 notice of appeal for which they have previously filed. The District Court’s denial of
10 TAITZ’s post-judgment motion does not affect APPELLANTS’ previously filed Notice of
11 Appeal.
