Agreement between _____________________, the Employer or Client

And _________________________________, the Site Supervisor

Article 1: Performance of Duties

1. The Site Supervisor agrees to discharge his duties as described in
Section A with reasonable care and skill at all times during the period
this contract is in effect.

Article 2: Employer Obligations

1. The Employer agrees to fulfill his obligation as stated in Section B and
to pay the incumbent as described in Section C.

Article 3. Assignment and subcontracting

1. Neither the Client nor the Site Supervisor shall assign the whole or any
part of this Agreement without the consent of the other in writing. Such
consent shall not be unreasonably withheld.
2. The Site Supervisor shall not subcontract any part of the services
without the consent of the

Article 4. Consequences of suspension and termination

If the performance of the services has been suspended or has been
terminated:
1. The Client shall pay the Site Supervisor any installments of the fees
due to up to the date of suspension or termination together with a fair
and reasonable proportion of the next following installment
commensurate with the services performed by the Site Supervisor
unless the Agreement has been terminated by the Client because of a
material breach by the Site Supervisor
2. The Client shall pay the Site Supervisor within 28 days of written
demand the consequential costs necessarily incurred as a result of the
suspension or termination.
3. Termination of the Agreement shall be without prejudice to any other
rights and remedies of the parties.


A. Description of Role:

The Site Supervisors main responsibility is to make sure that work is carried
out to the client's standards,
Specification and schedule. In most cases, the specifications are prepared by
architects or
Engineers employed by the client. Site Supervisor shall make sure that the
correct materials and
Workmanship are used and that the client is given quality work and value for
money.
Site Supervisor shall either remain on site all the time or make regular visits.
He needs to be vigilant in his inspections of a large range of technical aspects
of the work. This involves:

becoming familiar with all the relevant drawings and written
instructions, checking them,
and using them as a reference when inspecting the work
making visual inspections
taking measurements and samples on site to make sure that the work
and the materials
meet the specifications and quality standards
being familiar with legal requirements and checking that the work
complies with them.
having a working knowledge of health and safety legislation and bring
any shortfalls
observed to the attention of the person(s) concerned.

The Site Supervisor is not limited to only a inspector but also a
superintendent. This means that he can
advise the contractor about certain aspects of the work, particularly if
something has gone wrong. He can also agree to minor changes. He cannot,
though, give advice that could be interpreted as an instruction, particularly if
this would lead to additional expense.

He shall keep detailed records of various aspects of the work, which he put
together in regular reports for the architect or planner and the client. Records
include details of:
progress and any delays
the number and type of workers employed
weather conditions
visitors to the site
drawings received
deliveries
instructions
details of any significant events including any serious deficiencies in
health or safety performance observed while on site.

The Site Supervisor shall liaise closely with the contractor's staff. He must,
however, maintain his independence, as he is responsible for working in the
best interests of their employer or client.


B. Employer Obligations:
The Employer:
Supply such information to the Site Supervisor at such times as is
reasonably required for the performance of his duties.
