I- INTRODUCTION
A. Background of the Research

Gender equality entails a society where men and women enjoy the same and equal
political, civil and economic opportunities, rights and obligations in every aspect of life. It is
gender equality which eradicates the discrimination in the society between different genders
in different aspects of life leading to accessible opportunities. Gender sensitivity between
men and women exists when both sexes, regardless of their social orientation, are able to
share mutual respect to each other, are equal in the distribution of power and influence and
enjoy equal access and treatment. Gender sensitivity entails awareness and receptiveness to
the demands and rights of each gender.

A significant aspect of promoting gender equality and sensitivity is the empowerment
of both men and women by our government institutions through laws which do not only
recognize the equality of different genders but also respond to the uniqueness of each.
Gender sensitivity and equality are essential for the realization of human rights for all.
Several methods to make sure that men and women are empowered are to give them equal
footing in the eyes of law, having laws that will enable them to decide and handle their socio-
civic life independently. Not only in providing laws, a method also to make sure that both
men and women are in equal footing is to have proper implementation of these laws to carry
out equality and sensitivity.

The concept of the integration of gender sensitivity in our laws has been developed as
a way to reduce gender-related barriers to personal and economic development created by
our culture. Gender sensitivity of laws help to generate respect for the individual regardless
of sex in our society because laws in general shape and form social behavior and attitude.
This is based on the Social Behavioral Theory.

B. Statements of the Research Problem

(1) Whether or not Philippine Laws recognize the equality between men and women.
(2) Whether or not Philippine laws are gender-sensitive and responsive to the
uniqueness of each gender.
(3) Whether or not these gender-sensitive laws are enforced and applied.

In this research, we used and analyzed the existing laws and current jurisprudences to support
our research. We also conducted Focus Group Discussion and interviewed several prominent
people in the gender-empowerment-awareness-related campaigns and members of the legal bar
as well as judiciary.
