Crude Awakening
On the cover is the artwork of John de Rosier. Readers of the Albany Times Union will recognize his work as he
was the editorial cartoonist there for more than a dozen years. We commissioned Johns piece to underscore
the huge threat posed by Big Oils efforts to make New York State, the City of Albany and the Hudson River in
particular, a global crude oil transportation hub. Twenty-five percent of the crude oil flowing out of the fracking
operations in North Dakota travels through New York, along the rail lines between Buffalo and Albany, along
the shores of Lake Champlain and on barges and the banks of the Hudson River. Though much ink was spilled
by newspapers across the state and thousands of citizens weighed in with concern, there was very little action
by the Legislature or the Governor to stop the current threat or prevent Big Oil from moving the dangerous and
climate altering tar sands of Canada through our state. The Assembly did pass legislation (Scorecard #12) to
require oil companies to assure that they had insurance adequate to cover spills or catastrophic events, but that
common sense measure died in the Senate. As we head into 2015, we need the Governor and the Legislature
to meet the challenges posed as the state becomes part of the oil patch.

A Deep Dive into 2014
This is LPL/Lnvironmental Advocates 43th year o ad-
vocacy or the uture o the state's environment and the
health o its citizens. Just when we think we have seen it
all, along comes the 2014 legislative session and we learn
anew just how diicult progress on achieving our mission
can be.
This year, the state Legislature delivered a true mixed bag
to the environment. There were clear wins, ar-rom-ide-
al outcomes, many bad bills to be blocked and situations
that reminded us o all that can go wrong in the halls o
the Capitol.
Our Changing CIimate
The impacts to our health and the environment that
low rom climate change are great and continue to
mount. And, while the state lacks a comprehensive plan
to address it, we saw some hopeul signals this year that
more lawmakers understand what is at stake and support
action. Both houses passed the 'Climate Risk Reduction
and Resiliency Act' a measure that will aid communities
in planning and accounting or climate change impacts,
which Governor Cuomo has signed into law. It's a great
irst step, and to ollow it up we need a comprehensive
plan that will cut carbon and set New York down the path
to clean energy and away rom dirty ossil uels o the
past.
In the middle o session a bi-partisan group o legislators
rom the Senate and Assembly came together to support
ederal action. In a letter to the U.S. Lnvironmental Pro-
tection Agency head, Gina McCarthy, 30 legislators urged
her to set strong standards or power plant carbon pollu-
tion. They made note that New York has strong standards
or our power plants, and that the Clean Air Act compels
her to act on climate.
Taken together, these developments show that outside o
the acrimony o Congress, support or climate action can
transcend party ideology and opportunity or progress is
available.
FaiIure Gets Another Life
The year began with the Governor acknowledging that
the brownield cleanup program is broken and needs
to be ixed. An Lnvironmental Advocates report ound
that over its lie, the program has cost taxpayers more
than $1.1 billion with only about 130 cleaned up (there
are thousands statewide). Further, powerul real estate
interests have igured out how to game the system, and
taxpayers are unding programs to build extravagant
hotels and malls. Though the cost to the state treasury is
huge, decision-makers ailed to come together to reach an
agreement in the budget, but vows were made to ix the
program by the end o session. However, the Governor
never put orth a proposal and in the vacuum he created,
real estate interests - ocused on their bottom line - con-
vinced lawmakers to simply extend the broken program
another year and hal: a predictable, yet terrible outcome.
Forty is the New Zero
Advocates waged a campaign to engender support or
legislation to eliminate toxic chemicals rom children's
products. As the end o session unolded, there were 40
Senators signed on as co-sponsors, to pass the Senate a
bill needs only 32 votes in support. The bill was passed
by the Assembly in March, yet, as crazy as this sounds, it
never came up or a vote in the Senate.
In that Chamber, the bill was bottled up in committee or
nearly the entire session by Lnvironmental Conservation
Committee Chair Mark Grisanti (R-Bualo). As the bill
sat, chemical industry lobbyists worked the Senate leader-
ship to ensure that it did not come to the loor or a vote
even ater the committee inally approved it.
To add insult to injury, as advocates were pushing the
Senate or a vote on the Child Sae Products Act, Senator
Skelos and Senator Klein decided to call a vote on a bill
to legalize sparklers and irecrackers, which is opposed by
many o the same ireighters and LMS personnel as sup-
port the Child Sae Products Act. These groups oppose
legalizing these products because o the harm they cause
to children. The 'sparklers bill' had only one Senator
signed on as sponsor and yet it moved rom introduction
to passage in both houses in just three days.

Welcome to the new math o the New York State Senate
and a new chapter in the civics books on how a bill be-
comes (or in this case doesn't) law. In a post-session inter-
view on the Capitol Pressroom, Minority Leader Andrea
Stewart-Cousins (D-Yonkers) acknowledged the need or
democracy within the Chamber and expressed support or
rules that allow bills to receive a vote when they clearly
have support rom a majority o senators. It's a promise
that must be kept.
The Senate Lnvironmental Conservation Committee has
rapidly become a place where the environmental com-
munity's priorities hit a brick wall. Current Senate rules
provide wide discretion to committee chairs on what does
and does not come up on committee agendas or a vote.
The Child Sae Products Act lingered ar too long this
year beore being released, but other priorities were also
held by Senator Grisanti. Among the bills on the Lnvi-
ronmental Scorecard that died in committee were (see
pages 24-28) 1 Fracking Moratorium, Climate Pro-
tection Act, 7 Lnvironmental Justice or All, 17 Reduce
Toxic Mercury in Light Bulbs, 19 Cadmium-Free Toys,
9 Keeping Recyclables Out o Landills, 11 Microbead-
Free Waters Act, and 12 Cover Your Crude. The lat-
ter three were even sponsored by Senator Grisanti and,
though they passed the Assembly, he never brought them
to the committee or a vote. One has to wonder where
good environmental policy needs to come rom i this
committee operates this way.
It is a challenging time in the halls o the New York State
Capitol to advance strong standards to improve public
health and the environment. Advocates spend too much
time swatting away the bad ideas rom one party or an-
other, or beating back deals or special interests.
However, along the way we encounter some shining bea-
cons o hope, people who are committed to sound public
policy, and who deserve to have their eorts recognized.

Lifetime Green Recognition Award: AssembIymember Robert K. Sweeney
New York's air, land, and water have been in good hands during Assemblyman Robert Sweeney's (D-Lindenhurst)
seven year tenure as Lnvironmental Conservation Committee Chair. The Assemblyman has had a strong record o
introducing and also moving good bills through his committee, and guiding them towards ull passage in his house. In
2014 alone, Assemblyman Sweeney shepherded all three environmental Super bills to passage. These bills would keep
toxic chemicals out o children's products, place a moratorium on natural gas drilling, and would help New Yorkers
acing negative impacts rom extreme weather events. Under his leadership, the Assemblyman also helped usher new
laws that placed restrictions on the sale o ivory in New York State, prohibited the use o toxic lame retardants in
children's products such as bedding and car seats, and required recycling or electronic waste. Assemblyman Sweeney's
high score throughout his tenure shows that he truly understands the importance o saeguarding our environment.
We will miss his leadership.
Senate HonorabIe Mentions
Senator Diane Savino (D-Staten Island) - Senator Savino was the lead sponsor o the Community Risk Reduction and
Resiliency act, an environmental Super Bill that would require New York State to include uture climate risk in a broad
range o planning, permit, and unding processes. New York State has seen irsthand the impacts o a changing cli-
mate - ew communities moreso than those Senator Savino represents - and this bill takes an important irst step in
ensuring that uture community planning is done with an eye towards our changing climate. Under Senator Savino's
tuteledge, both houses passed and delivered a Super Bill to the Governor or the irst time since 2011.
Senator Philip Boyle (R-Bayshore) - Senator Boyle played a key role by taking the lead in the Senate on a bipartisan e-
ort encouraging the ederal government to ormally comment on proposed regulations or new power plants. Thanks
to his outreach, more than 30 legislators signed on to a letter urging the Lnvironmental Protection Agency to ol-
low New York's lead in establishing strict carbon standards. Senator Boyle was also the lead sponsor o the Child Sae
Products Act, an eort to reduce known toxic chemicals rom children's products, a Super Bill or the environmental
community.
AssembIy HonorabIe Mentions
Assemblyman Brian Kavanagh (D-Manhattan) - Over the years, Assemblyman Kavanagh has been a consistent cham-
pion o environmental protection. In January 2014, he ounded the New York State Caucus o Lnvironmental Legisla-
tors and, as chair o the nonpartisan caucus, he was the lead in in his house encouraging the ederal government to
ollow New York's lead on cutting carbon-emissions rom dirty power plants. Assemblyman Kavanagh recognizes that
New York has set standards or power plant carbon pollution and has reaped economic, health, and environmental
beneits as a result.
Assemblyman Joseph Saladino (R-Massapequa Park) - While we may be critical o some o his colleagues, Republican
Assemblyman Joseph Saladino stands apart, earning the highest score o his conerence. His score relects his commit-
ment to making the right choices or the people he is elected to represent. Assemblyman Saladino boldly steps up or
his community, which has seen the eects o a changing climate irsthand, and or New York State as a whole.

The "AbysmaIs"
This year we have a new name or the bad actors in the Legislature who just don't value the beneits o protecting kids
health, ensuring air clean enough to breathe and water pure enough to drink. We call them Abysmals, and two are
current members o the Assembly.

Leaders set the tone or their members, and with a ailing conerence average score o 34 it should come as no surprise
that !..-B@(4 M-=$@(%&*2 A%2)/%+4 :-*3-/ L)(@ GM>N-2-;*I is a recipient o our Abysmal Award. New York is
home to marvelous natural treasures and the nation's largest city. Because our land, air and water are so critical when
it comes to ensuring a healthy people, it is inconceivable that a legislative leader would score so low and be so out o
touch with the people o this state. But, Leader Kolb does. His score is a 40, well below his conerence, and or that we
give him an Abysmal.
With all the opposition to racking and support or clean water in his district, one would think !..-B@(4B*2 J,/%.>
+)=,-/ O/%-23 GM>E%5 O(*+.I rom the Southern Tier would be at least a mediocre scorer. Unortunately his scores are
consistently the lowest in the whole Legislature. He underperorms even the worst o his underperorming colleagues,
this year earning just 14 points, the lowest o any. And or that we give him an Abysmal.

OiI SIick: KathIeen Marchione
Our coers would be lush i we had a nickel or every time we heard polluters or their allies in the Legislature gripe
that regulations stile economic growth. Complaining is one thing, but being a proponent or the rollback o pub-
lic health protections that provide sae working conditions and ensure a clean environment takes a very special and
backward-thinking commitment. Lnter reshman Senator Kathleen Marchione (R-Halmoon).
Right now in her district, General Llectric is dredging PCBs out o the Hudson River, and each day hundreds o train
cars illed with dangerous crude oil is traveling local rails. So we'd expect her to have a uller appreciation o what
strong saeguards mean since a lack o oversight o this industry's has a direct impact on her constituents' quality o
lie.
But quickly ater her 2012 election, Senator Marchione took up the mantle o 'Protection Cutter in Chie.' In 2013 the
Senate passed her bill (rated three smokestacks) that requires the arbitrary repeal at least 1,000 regulations. Undeterred
by the lack o interest shown by the state Assembly, the Senator and many colleagues o the Majority Coalition - in-
cluding members o Senator Klein's Independent Democratic Conerence (IDC) - pressed ahead with a series o invite-
only 'listening' sessions last summer and all that gathered rom special interests a wish list o all they'd like to see go.
As 2014 unolded, Senator Marchione seemed to gain an important ally in her quest: Governor Cuomo. He put a
little wind in the Senator's sails by suggesting in his State o the State Address that there ought to be a commission to
take up the issue o regulatory reorm. Senator Marchione's response, 'It's time to stop talking and start cutting' was
predictable, but it also helped steel the resolve o those who ought hard or critically important saeguards. And, as
opposition mounted in the Capitol, a chemical spill in West Virginia made national headlines and provided a clear ex-
ample o what an unregulated industry means: toxic chemicals that shutdown a public drinking water supply and put
the health o millions at-risk. Her bill never made it back to the loor or a vote in 2014.
Common sense standards protect health, workers and the environment and are not created on a whim. By legislating-
by-sound-bite, Senator Marchione is placing our health and saety at tremendous risk. Because o her disregard or
public health and holding industry accountable, she earns the 2014 Oil Slick Award.

that would involve the use o horizontal drilling or high-

2. Child Safe Products Act
Identiies chemicals o concern, prioritizes them based
on the likelihood or exposure, and requires disclosure
by children's product manuacturers as to whether
their products contain priority chemicals. Phases out
children's products made with priority chemicals starting
January 1, 2018. Authorizes the Interstate Chemicals
Clearinghouse to collect, manage, and publish the data
collected rom manuacturers. A.328 (Sweeney, et al.)
passed Assembly. Similar bill S.414-A (Boyle, et al.)
died in Senate Finance Committee.
3. Community Risk Reduction and
Resiliency Act
Requires New York State to include uture climate
risk in a broad range o planning, permit, and unding
processes. The legislation also directs the Department
o State to work with the Department o Lnvironmental
Conservation to develop model climate change
adaptation zoning laws or use by municipalities.
A.338-B (Sweeney, et al.)/S.17-B (Savino, et al.)
passed Assembly and Senate. This bill was signed into
law by the Governor on September 22, 2014.

4. NY-Sun Act: Building NYs Solar
Energy Industry
Lstablishes a 10-year, $1.3 billion incentive program
which solidiies New York's solar-energy commitment
to spark private investment and bring more solar power
to New York. A.300-L (Lnglebright, et al.)/S.7739
(Latimer, et al.) passed Assembly, died in Senate Lnergy
and Telecommunications Committee.
5. Clean Purchasing Accountability
Lstablishes protocols or the purchase o services,
commodities, and technologies by state agencies in order
to minimize adverse impacts on environment and public
health. A.04 (Sweeney, et al.) passed Assembly, not
introduced in Senate.
6. Climate Protection Act
Lstablishes an economy-wide limit on climate pollution
rom all sources in New York and requires that the limit
not be greater than statewide emissions or the year
1990. Statewide limit is to be reduced until emissions
are 80 below 1990 levels by 2030. A.327-A (Sweeney,
et al.)/S.7437 (Sanders, et al.) passed Assembly, died in
Senate Lnvironmental Conservation Committee.
7. Environmental Justice For All
Incorporates environmental justice principles into
state agency decision-making. Lstablishes a permanent
Lnvironmental Justice Advisory Group within the
Department o Lnvironmental Conservation and
Lnvironmental Justice Interagency Coordinating
Council to report on the eectiveness o policies. A.339
(Peoples-Stokes, et al.)/S.129-A (Parker, et al.) passed
Assembly, died in Senate Lnvironmental Conservation
Committee.
8. Environmental Justice Zones
Requires the Department o Lnvironmental
Conservation to issue biennial reports listing areas most
adversely aected by existing environmental hazards,
providing a useul tool to address environmental

Senate Lnvironmental Conservation Committee.
9. Keeping Recyclables Out of Landfills
Prohibits disposal o recyclable materials in landills
and incinerators and identiies materials or mandatory
recycling, such as newsprint, glass, metal containers,

(Grisanti, et al.) passed Assembly, died in Senate
Lnvironmental Conservation Committee.
10. Safer Sofas
Prohibits the sale o new residential urniture containing
ineective and toxic chemical lame retardants
beginning July 1, 2014 and requires New York to
develop an open lame lammability standard which will
be periodically reviewed. A.337 (Sweeney, et al.) passed
Assembly, not introduced in Senate.
11. Microbead-Free Waters Act
Prohibits the manuacture and sale o personal cosmetic
products containing microbeads ater January 1, 201,
with certain exceptions. A.8744-A (Sweeney, et al.)
passed Assembly, not introduced in Senate.
12. Cover Your Crude
Requires all petroleum bulk storage acilities that store
Bakken and/or Bitumen (Tar Sands) crude oil to provide
inancial security suicient to meet all responsibilities
or the cleanup and decontamination costs associated
with the release o such oil or the duration o the
acility's operations in New York State. A.992 (Fahy,
et al.)/S.7718 (Grisanti, et al.) passed Assembly, died in
Senate Lnvironmental Conservation Committee.

13. Energy Star State Grants
Requires organizations receiving unds or capital
improvements rom the New York State Dormitory
Authority and/or the Urban Development Corporation
to purchase Lnergy Star equipment and appliances when
available. A.33-A (Hevesi, et al.)/S.1187-A (Maziarz,
et al.) died in Assembly Ways and Means Committee,
passed Senate.
14. Energy Star Appliance Tax Break
Provides a sales tax exemption or certain energy
eicient appliances beginning on April 1, 2014 and
continuing or ive years. Only applies to the Lnergy Star
rated appliances listed in the legislation and purchased

16. Private Well Water Quality Testing
Stipulates that sales contracts or properties serviced by
private drinking water wells include requirements to test
wells or various contaminants, and that test results be
shared with appropriate agencies. A.1040 (Jaee, et al.)
passed Assembly, not introduced in Senate.
17. Reduce Toxic Mercury in Light Bulbs
Bans the sale o several common types o general
purpose luorescent light bulbs i they exceed the
maximum mercury levels listed in the law and authorizes
the Department o Lnvironmental Conservation
to establish regulations or mercury content
standards in all light bulbs. A.2048-A (Kavanagh, et
al.)/S.743 (Sanders) passed Assembly, died in Senate
Lnvironmental Conservation Committee.
18. TRIS-Free Babies
Prohibits sale o products intended or use by inants
and children, including toys, car seats, and baby products
containing the lame retardant chemical TDCPP
(TRIS [1,3-dichloro-2-propyl] phosphate) beginning
December 1, 2013. A.4741 (Sweeney, et al.)/S.3703-B
(Grisanti, et al.) passed Assembly and Senate. This bill
was signed into law by the Governor on September 18,
2014.

19. Cadmium-Free Toys
Prohibits sale o novelty products (including jewelry,
toys, and ornaments) containing more than 0.0073 (73
parts per million) cadmium ater June 1, 2013. A.4822
(Sweeney, et al.)/S.729 (Avella, et al.) passed Assembly,
died in Senate Lnvironmental Conservation Committee.
20. Pesticide-Free Summer Camps
Prohibits pesticide use on playgrounds, tur, and
athletic or playing ields at children's overnight camps
and day camps except when an emergency application
is warranted. A.4841-D (Paulin, et al.)/S.3288-D
(Carlucci, et al.) passed Assembly, died in Senate Health
Committee.
21. Reduce Food Climate Pollution
The Commissioners o Lducation and Agriculture and
Markets are directed to develop guidelines by which
school districts and institutions o higher education
can voluntarily implement programs to donate excess,
unused, edible ood to local voluntary assistance
programs. A.3218 (Ortiz, et al.)/S.2332 (Klein, et al.)
died in Assembly Lducation Committee, passed Senate.
22. Drug Disposal Demonstration
Program
Directs the Department of Environmental
Conservation to work with the State Police to establish
a one-year demonstration program for the safe disposal
of prescription drugs. A. -A (Sweeney, et al.)/
S. 9 -A (Grisanti, et al.) passed Assembly and Senate.

23. Green Residential Building Grants
Lxtends the green residential building grant program.
Lnacted in 2008, the program provides unding to
support the construction o new residential buildings, or
substantial renovations to existing structures, that meet
green building standards. A.777 (Paulin, et al.)/S.3977
(Maziarz, et al.) died in Assembly Lnergy Committee,
passed Senate.
24. Curbing Light Pollution
Requires the Oice o General Services (OGS), in
consultation with the New York State Lnergy Research
Development Authority (NYSLRDA), to develop
cost eective outdoor lighting eiciency standards.
Requires the installation o new or replacement
permanent outdoor lighting by state agencies and
public corporations to meet certain eiciency standards.

25. Mercury-Free Wheel Weights
Prohibits the sale and distribution o rotational
balancing products and wheel weights containing
mercury and also applies to mercury added devices
used to balance any rotating device. Prohibits any
registered motorist rom using a wheel weight or
rotational balancing device containing added mercury
ater April 1, 2013. Ater April 1, 201, the sale o new
vehicles intentionally manuactured with mercury
balancing devices is prohibited. A.9143-A (Rosenthal, et
al.)/S.907-A (Grisanti, et al.) passed Assembly, died in
Senate Rules Committee.
26. Clean Energy Property Tax
Exemption
Lxtends the local option to oer real property tax
exemptions or qualiied solar, wind and arm waste
energy systems through 2023. A.944-A (Paulin, et
al.)/S.702-A (Maziarz, et al.) passed Assembly and
Senate. This bill was signed into law by the Governor on
September 4, 2014.
27. Preventing Aquatic Invasive Species
This bill makes it illegal to launch a watercrat without
taking reasonable precautions to prevent spreading
invasive species, and directs DLC to issue regulations
to implement the bill. Violators will be subject to
ines and penalties. This bill sunsets on June 1, 2019.

Assembly and Senate. This bill was signed into law by
the Governor on September 2, 2014.
28. Solar City
Lxtends New York City's solar tax abatement program
through January 1, 2017. A.980 (Rosenthal, et al.)/
S.744-A (Lanza, et al.) passed Assembly and Senate.

September 23, 2014.
29. Illicit Ivory
Prohibits the purchase and sale o ivory articles and
rhinoceros horn with certain exceptions. Increases the
civil and criminal penalties or the illegal sales o these
articles. A.10143 (Sweeney, et al.)/S.7890 (Lanza, et al.)
passed Assembly and Senate. This bill was signed into
law by the Governor on August 12, 2014.
30. Farm Pond Dam Exemption
Transers state oversight or dams located on arms
rom the New York State Department o Lnvironmental
Conservation (DLC) Bureau o Flood Protection and
Dam Saety to the Department o Agriculture and
Markets and exempts such dams rom proper oversight
and regulation. A.1487 (Gunther, et al.)/S.221 (Young,
et al.) died in Assembly Agriculture Committee, passed
Senate.
31. Water Withdrawal Reporting
Loophole
Amends the water withdrawal law to exempt all
agricultural water withdrawal reports rom the state's
reedom o inormation law. A.9009 (Magee)/S.222
(Ritchie, et al.) died in Assembly Agriculture Committee,
passed Senate.

32. Oversized ATVs, Part II
Amends New York State's Vehicle and Traic Law
to include vehicles up to 1,300 pounds and which can
carry up to 3,000 pounds under the deinition o ATV.

died in Assembly Ways and Means Committee, passed
Senate.
33. Redefining Renewable Fuels
Lxpands the existing biouel production tax credit
to include cellulosic ethanol, densiied biouel and
renewable uel oil. Also raises the credit cap rom $2.3
million to $10 million per year and allows the credit to
be claimed or ten years. A.9323-A (Russell)/S.433-B
(Young, et al.) passed Assembly, died in Senate Finance
Committee.
34. Cuomos Clean Water Raid
Gives the Lnvironmental Facilities Corporation (LFC)
power to invest in entities with a lower investment
rating, which would allow the LFC to raid the Clean
Water State Revolving Fund to give monies to the New
York State Thruway Authority or construction costs
o the 'New New York Bridge.' A.9789-A (Sweeney)/
S.983-A (Grisanti) died in Assembly Rules Committee,
passed Senate.
