Geor'e Trussell involve the char'e of simulation of le'al process pursuant to Florida
"tatutes B:6DB<<, t*o char'es involvin' subsection 76) and ei'ht involvin' subsection
7:), and all such alle'ations are founded upon the presumption that the po*er to impanel
the 'rand 8ur$ is not *ithin the retained po*ers of the people, but is e%clusive to the
po*ers of the Florida 'overnment, and all officers involved -no*, or should -no*, that
there is no constitutionall$ dele'ated po*ers to the Florida 'overnment to impanel or
control the Grand &ur$, and the presumptions do not lie for criminal matters pursuant to

b$ habeas corpus or b$ proper court process prior to DeclarantJs arrest and incarceration
e%cept to refuse to file or respond to papers filed for purposes of settlin' the issues
4: That the actions of all officers involved no* demonstrates their erroneous position,

Dictionar$, Fifth 0dition, at pa'e 66<, definin' Infamous crime states in pertinent part:

hard labor, is an infamous crime+
6< That the officers responsible for said arrest, incarceration and restraint of DeclarantJs
libert$ have violated the reLuirements of the Fifth #mendment b$ said arrest and
incarceration *ithout a Grand &ur$ presentment or indictment

6? That the contention b$ the 'overnment officers that the Grand &ur$ is *ithin the e%clusive
po*er and control of the Florida 'overnment is *holl$ unreasonable in that it could not
be the intent of the people *ho ori'inall$ created the 'overnment offices, to create a
+*atch do'+ provision for holdin' criminals responsible for their acts, and then place
such provision *ithin the e%clusive control of the 'overnment officers *ho are capable of
such criminal acts themselves and cannot be relied upon to punish themselves or fello*

prosecutor;s office are prevented from hearin' crimes committed b$ 'overnment officers

inta-e officers *ith a demand for access to the Grand&8ur$ for testif$in' and an
investi'ation are not delivered to the Grand &ur$ and such officers add the additional
crimes of misprision of felon$ and obstruction of 8ustice *ith impunit$ b$ the erroneous
contention that the po*er to impanel and control the Grand &ur$ is *ithin the e%clusive
control of the 'overnment and there is a ne'lect to transmit such crimes to the Grand &ur$
for initiatin' the prosecution of such crimes as a matter of course
6@ That these matters are of 'reat interest and importance to the people of Florida and must
be settled b$ this habeas corpus action as to *here the po*er to impanel and control the
'rand 8ur$ lies, in the 'overnment, in the people, or both, and *hether DeclarantJs 'ood
faith actions in reliance upon Williams# and to act in the capacit$ of a Grand &ur$ foreman

Constitutions, the facts, and the precedents alread$ set b$ prior decisions of this court, or
