AS TO FORM AND LEGALITY

ORDINANCE NO. 12071 C.M.S.
AN ORDINANCE AMENDING SECTION 2.04.020 OF THE OAKLAND MUNICIPAL
CODE TO ESTABLISH CONTRACT APPROVAL LIMITS FOR THE CITY MANAGER
DURING THE ANNUAL, SUMMER BREAK OF THE CITY COUNCIL
WHEREAS, the City Council takes its annual, summer break from August to mid-
September; and
WHEREAS, it is necessary to continue processing and awarding routine contracts for
procurements, services and public works projects during the City Councils annual, summer break;
and
WHEREAS, the City Council wishes to authorize the City Manager to enter into
contracts on its behalf during the summer break; now therefore
The Council of the City of Oakland does ordain as follows:
Section 1.
Municipal Code:
The following paragraph is added to Section 2.04.020 of the Oakland
F. Notwithstanding the provisions of paragraphs A and B of this section,
during the month of August through the first City Council meeting in September,
known as the annual recess of the City Council, as provided for in the City
Council's Rules of Procedures, the City Manager shall be authorized 1) to bind the
City, by written contract or purchase order, involving an expenditure not
exceeding five hundred thousand dollars ($500,000), without previous specific
action by the City Council, for the purchase of supplies or payment for services,
or a combination thereof, to be furnished to the City, subject to the availability of
funds and procedures set forth in this article, including competitive bidding funds
and the procedures set forth in this article, the City Manager is authorized to bind
the City, by written contract, involving an expenditure not exceeding one hundred
and fifty thousand dollars ($150,000) in any one transaction for the procedures for
contracts in excess of $50,000; and 2) subject to the availability of payment for
professional services and consultant services to be furnished to the
City. Professional Services and Consultant Agreements in excess of fourteen
thousand nine hundred ninety nine dollars and ninety nine cents ($14,999.99), and
contracts for the purchase of supplies, bid services or combination thereof in
excess of forty nine thousand nine hundred ninety nine dollars and ninety nine
cents ($49,999.99) shall be subject to the City Council's agenda process and shall
be presented to the City Council for ratification upon return from its annual
recess.
