Sir,

1.0 Under and subject to the Instructions to Tenderer annexed hereto, the Undersigned does
hereby tender and offer to execute and perform the Works and provisions and supply all
labour materials and plants and everything of every kind respectively named, shown,
described and alluded to in, or to be inferred from the Tender Document, to be executed
and supplied on the part of the Contractor for the Works above described in conformity
with the said Tender Documents for the lump sum named below.
2.0 The Undersigned agrees to be bound by and subject to the Conditions of Contract and
priced Contract Bills and/or Specifications and agrees that if this Tender is accepted, the
prices and rates in the Contract Bills shall be scrutinised and adjusted by the Architect as
to their reasonableness but the lump sum tendered herein below shall remain unaltered.
The said priced Contract Bills after rectification or adjustment as by the Conditions of
Contract provided, shall form the basis for valuation of interim payment certificates and
any variation may from time to time be ordered by the Architect.
3.0 And further, the Undersigned agrees to complete the Works within ___________ weeks
from the date of possession of site or within such extended time as by the Conditions of
Contract provided.
4.0 The total amount of the Tender is the lump sum of Ringgit Malaysia

5.0 Whereas, it is understood that the Employer reserves the right to accept or to refuse this
Tender whether it is lower or higher than any other tender or of the same amount. The
undersigned agrees that this Tender shall remain valid and shall not be withdrawn within
ninety (90) days from the final date fixed for the submission of tenders and agrees that
no other terms, conditions or stipulations shall be imposed by us after the said date.

6.0 The Undersigned agrees, in the event of acceptance of this Tender to deposit as soon as
is practical after receipt of the Letter of Acceptance of Tender but before the
commencement of the Works, the following:
6.1 Insurance Policies for the Works
6.2 Insurance Policy for Public Liability (i.e. Insurance against injury to persons and
damage to property or the Cover Notes together with receipts of premium paid in
respect thereof; and
7.0 The Undersigned hereby also agrees that this Form of Tender together with the Letter of
Acceptance of Tender (if any) shall constitute a binding contract between us
notwithstanding that a formal Contract Agreement has not been executed.
8.0 The Undersigned confirms, after a personal scrutiny, that the documents and drawings
used by the undersigned in compiling this Tender are in order.
9.0 The Undersigned agrees that:
9.1 If this Tender is withdrawn before the expiry of the Tender Validity Period or any
extended period thereof, or
9.2 Tender after the final date fixed for the submission of tenders, or
9.3 In the event that the Tender having been accepted, the Undersigned refuses and
fails to execute the formal Contract Agreement or to deposit the Performance
Bond (if the tenderer opts for Bank Guarantee) as required by the Conditions of
Contract or fails to proceed with the Works,
then, in any of such event, without prejudice to any other rights it may possess, the
Employer reserves the right to forfeit the Tender Deposit (Earnest Money) as the
Employer deems fit.
