"E!ERA$ PRO(IIO!
Article A. hort Title and cope
ection 6A.06. Title. This Ordinance shall be 7no3n
as the 8Code of "eneral Ordinances of the Province of
Kalinga9.
ection 6A.0/. cope. This Code covers all general
ordinances of Province of Kalinga.
Article 1. Rules of Construction
ection 61.06. %ords and Phrases. %ords and
phrases embodied in this Code but not herein speci:call2
de:ned shall have the same meaning as found in legal
dictionaries as 3ell as in e;isting la3s.
ection 61.0/. Construction Of Codal Provisions.
In construing the provisions of this Code4 the follo3ing
rules of construction shall be observed unless other3ise
inconsistent 3ith the manifest intent of the provisions or
3hen applied the2 3ould lead to absurd or highl2
improbable results.
a, "eneral Rule. All 3ords and phrases shall be
construed and understood according to the
common and approved page of the language< but
technical 3ords and phrases and such other
3ords in this Code 3hich ma2 have ac=uired a
peculiar or appropriate meaning shall be
construed and understood according to such
technical4 peculiar or appropriate meaning.
b, "ender and !umber. Ever2 3ord in this Code
importing the masculine gender shall e;tend to
both male and female. Ever2 3ord importing the
singular number shall e;tend and appl2 to
several persons or things as 3ell< and ever2 3ord
importing plural number shall e;tend4 and appl24
also to one person of thing.
c, Computation of Time. The time 3ithin an act is to
be done as provided in this code4 or in an2 rule or
regulation issued pursuant to the provisions
thereof4 3hen e;pressed in da2s shall be
computed b2 e;cluding the :rst da2 and including
the last da24 e;cept 3hen the last da2 falls on a
unda2 or Holida2. In 3hich case4 the same shall
be e;cluded from the computations and the ne;t
business da2 shall be considered the last da2.
d, Tenses. The use of an2 verb in the present tense
shall include the future 3henever applicable. The
3ords 8shall have been9 shall include past and
future cases. The use of the 3ord 8shall9 in this
Code means the act being re=uired to be done is
mandator24 3hereas 3hen the 3ord 8ma28 is
used4 it means permissive.
e, References. All references to 8Chapters9 8Articles9
or 8ections9 are to chapters4 articles or sections
in this Code unless other3ise speci:ed.
f, Con>icting Provisions of Chapters. If the
provisions of di?erent chapters con>ict 3ith or
contravene each other4 the provisions of each
chapter shall prevail as to speci:c matter and
=uestions involved therein.
g, Con>icting Provision of ections. If the provisions
of di?erent sections in the same chapter con>ict
3ith each other4 the provision of the section
3hich is later in point of se=uence shall prevail.
ection 61.0@. Amendment and Integration of
Additional Provisions. An2 amendment on this Code ma2
be introduced to the chapter4 article or section
concerned. All ordinances or provisions thereof enacted
subse=uent to the date of e?ectivit2 of this Code shall be
complied in such a 3a2 as to bear the corresponding
chapter4 article or section to 3hich such ordinance or
provision pertains. uch ne3 provision shall be
integrated into the corresponding chapter4 article or
section 3henever a ne3 printing or reproduction of this
Code is underta7en upon authoriAation of the
anggunian.
ection 61.0B. Reference to Code. %henever
reference is made to an2 portion of this Code4 such
reference shall appl2 to all amendments and additions
no3 ma2 hereafter be introduced.
ection 61.0C. E?ect of Heading. The Chapter4
Article and ection headings do not in an2 manner a?ect
the scope4 meaning or intent of the provisions contained
in this Code.
ection 61.0D. Relation to Prior Ordinance. The
provisions of this Code 3hich are substantiall2 the same
as that of previous or e;isting ordinances particularl2
3hen dealing 3ith the same subEect matter shall be
construed as 8restatements9 and not as a ne3
enactments.
Article C. )e:nitions
ection 6C.06. 'eaning of Technical Terms. As used
in this Code.
8Amusement9 is a pleasurable diversion and
entertainment. It is s2non2mous to recreation4
rela;ation4 avocation4 pastime or fun.
8Amusement places9 include theaters4 cinemas4 concert
halls4 circuses and other places of amusement 3here
one see7s admission to entertain himself b2 seeing or
vie3ing the sho3 or performance. The2 include those
places 3here one see7s admission to entertain himself
b2 direct participation.
81ars9 include beer gardens or an2 place 3here
into;icating and fermented li=uors or malts are sold4
disposed of4 or given a3a2 for compensation4 even
3ithout foods4 3here the services of hostesses or
3aitresses are emplo2ed and 3here customers are
entertained b2 occasional dancing to music not rendered
b2 a regular dance orchestra or musicians hired for the
purpose< other3ise the place shall be considered and
classi:ed as a dance hall or night club. A 8coc7tail
lounge9 is considered a 8bar9 even if there is no hostess
or 3aitress to entertain customers.
81usiness9 means commercial activit2 customaril2
engaged in as a means of livelihood and t2picall2
involving some independence of Eudgment and po3er of
decision.
8Cabaret or )ance Hall9 includes an2 places or
establishments 3here dancing is permitted to the public
in consideration of an2 admission4 entrance or an2 other
fee paid on4 before or after the dancing4 and 3here
professional hostesses or dancers are emplo2ed.
8Calling9 means oneFs regular business4 trade4
profession4 vocation or emplo2ment 3hich does not
re=uire the passing of an appropriate government board
or bar e;aminations4 such as professional actors4
actresses4 masseurs4 commercial ste3ards and
ste3ardesses and the li7e.
8Capital9 signi:es the actual estate 3hether in mone2 or
propert2 o3ned b2 an individual or corporation< it is a
fund 3ith 3hich it transacts its business4 3hich 3ould be
liable to each creditor4 and 3hich in case of insolvenc2
on to a receiver.
8Capital investment9 is the capital 3hich a person puts
in an2 underta7ings4 or 3hich he contributes to the
common stoc7 of a partnership4 corporation or an2 other
Euridical entit2 or association.
8Charges9 refer to pecuniar2 liabilit24 as rents or fees
against propert24 persons or organiAations.
8Corporation9 includes Eoint-stoc7 compan24 partnership4
association4 insurance compan24 or an2 other Euridical
entit24 no matter ho3 created.
8E;cessive9 means that 3hich is characteriAed b2
3hatever is notabl2 greater than 3hat is moderate4
reasonable4 proper4 usual4 necessar2 and Eust.
8Fee9 means charge :;ed b2 la3 or agenc2 for the
services of a public oGcer.
8$ev29 means an imposition or collection of an
assessment4 ta;4 tribute or :ne.
8$icense or Permit9 is a right or permission granted in
accordance 3ith la3 b2 a competent authorit2 to engage
in some business or occupation or to engage in some
transaction.
8'ar7et Premises9 refer to an2 open space in the public
mar7et compound< part of the mar7et lot consisting of
bare ground not covered b2 mar7et buildings usuall2
occupied b2 transient vendors especiall2 during mar7et
da2s.
8'ar7et talls9 refer to an2 allotted space or booth in
the public mar7et buildings 3here merchandise of an2
7ind is sold or o?ered for sale.
8!ight Club or )a2 Club9 includes places fre=uented at
night or da2time4 as the case ma2 be4 3here foods4
3ines and drin7s are served and music is furnished b2
the operator and the patrons are allo3ed to dance 3ith
their o3n partners or 3ith hostesses furnished b2 the
management.
8Occupation9 means oneFs regular business or
emplo2ment4 or an activit2 3hich principall2 ta7es up
oneFs time4 thought and energies. It includes an2 calling4
business4 trade4 profession or vocation.
8Operator9 includes the o3ner4 manager4 administrator4
or an2 other person 3ho operates or is responsible for
the operation of business establishments or
underta7ings.
8Person9 means ever2 ph2sical or moral4 real or Euridical
and legal being4 susceptible of rights and obligations or
of being the subEect of legal relations.
8Privilege9 means a right or immunit2 granted as a
peculiar bene:t4 advantage or favor.
8Profession9 means a calling 3hich re=uires the passing
of an appropriate government board or bar e;amination4
such as the practice of la34 medicine4 public
accountanc24 engineering and the li7e.
8Residents9 refer to natural persons 3ho have their
habitual residence in the province4 cit2 or municipalit2
3here the2 e;ercise their civil rights and ful:ll their civil
obligations and to Euridical persons for 3hich the la3 or
an2 other provisions creating or recogniAing them :;es
their residence in a particular province4 cit2 or
municipalit2< in the absence of such la34 Euridical
persons are residents of the province4 cit2 or
municipalit2 3here their legal representation is
established or 3here the2 e;ercise their principal
functions.
8Revenue9 includes ta;es4 fees and charges that a state
or its political subdivision collects and receives into the
treasur2 for public purposes.
8ervices9 mean the duties4 3or7 or functions performed
or discharged b2 a government oGcer4 or b2 a private
person contracted b2 the government4 as the case ma2
be.
8Ta;9 means an enforced contribution4 usuall2 monetar2
in form4 levied b2 the la3-ma7ing bod2 on persons and
propert2 subEect to its Eurisdiction for the premise of
supporting government needs.
CHAPTER II
$E"I$ATI(E R#$E A!) PROCE)#RE
ARTIC$E A. essions of the anggunian
ection /A.06. $egislative 1od2. The legislative
bod2 of this local government unit shall be 7no3n and
called as 8angguning 1a2an9.
ection /A.0/. Inaugural ession. It shall be dut2 of
the Presiding OGcer of the anggunian to call for an
inaugural session of the said bod2 3ithin :ve da2s after
the election and assumption to oGce of its members.
ection /A.0@. Adoption or Revision of Internal Rules
of Procedures. )uring the inaugural session of the
anggunian4 it shall4 b2 resolution4 :; the da24 place and
time of its regular sessions. %ithin ninet2 da2s
thereafter4 it shall formulate4 adopt or revise its internal
rules of procedure.
The rules of procedure 3hich is also 7no3n as
8anggunian Rules9 shall embod24 among others4 the
follo3ing5
6, The organiAation of the sanggunian and the
election of its oGcers as 3ell as the creation of
standing committees 3hich shall include4 but
shall not be limited to4 the committees on
appropriations4 3omen and famil24 human rights4
2outh and sports development4 environmental
protection4 and cooperatives< the general
Eurisdiction of each committee< and the election
of the chairman and members of each
committee.
/, The order and calendar of business for each
session<
@, The legislative process<
B, The parliamentar2 procedures 3hich include the
conduct of members during sessions<
C, The discipline of members for disorderl2 behavior
and absence 3ithout Eusti:able cause for four
consecutive sessions4 for 3hich the2 ma2 be
censured4 reprimanded4 or e;cluded from the
session4 suspended for not more than si;t2 +D0,
da2s or e;pelled< Provided4 that the concurrence
of at least t3o-thirds vote of all the sanggunian
members5 Provided4 further4 that a member
convicted b2 :nal Eudgment to imprisonment of at
least one 2ear from an2 crime involving moral
turpitude shall be automaticall2 be e;pelled from
the sanggunian< and
D, uch other rules as the anggunian ma2 adopt.
ection /A.0B. Regular ession. The anggunian shall
hold regular session once a 3ee7.
ection /A.0C. pecial ession. %hen public interest
so demands4 special sessions ma2 be called b2 the
'a2or or a maEorit2 of the members of the anggunian<
Provided4 ho3ever4 that a 3ritten notice to the members
shall be served personall2 or left 3ith a responsible
person at the memberFs usual place of residence at least
t3ent2-four +/B, hours before the pecial ession is held.
#nless other3ise concurred in b2 t3o-thirds +/H@, vote of
the members present4 there being a =uorum4 no other
matter ma2 be considered at a special session e;cept
those stated in the notice.
ection /A.0D. Calling the ession to Order. %hen the
appointed time has come to start the regular session the
regular Presiding OGcer4 or in his absence the temporar2
Presiding OGcer elected to temporaril2 preside therein4
shall call the session to order4 3ith or 3ithout a =uorum.
hould there be no =uorum after calling the session to
order4 the maEorit2 of the members present4 or the
Presiding OGcer 8motu propio9 ma2 perform an2 of the
follo3ing5
A, adEourn the session from hour to hour<
1, adEourn the session from da2 to da2< or
C,adEourn the session for lac7 of =uorum.
ection /A.0I. Open-)oor Polic2. The session of the
anggunian shall be open to the public unless a closed-
door session is decided or ordered b2 an aGrmative vote
of a maEorit2 of the members present therein4 there
being a =uorum4 in the public interest or for reasons of
decenc24 moralit24 or securit2.
ection /A.0J. Kuorum. Kuorum is a maEorit2 of the
members 3ho have been elected and =uali:ed to
transact oGcial business.
hould a =uestion of =uorum be raised during a
session4 the presiding oGcer ma2 declare a recess until
such time as a =uorum is constituted4 or a maEorit2 of
the members present ma2 adEourn from da2 to da2 and
ma2 compel the immediate attendance of an2 member
absent 3ithout Eusti:able cause b2 designating a
member of the anggunian4 to be assisted b2 a member
of the police force assigned in this place to arrest and
present the absent member at the session.
If there is still no =uorum despite the enforcement
of the above-stated remedial action4 no business shall be
transacted b2 the anggunian. The Presiding OGcer4 on
his o3n volition or recogniAance4 or the members4 thru a
proper motion dul2 approved shall then declare the
session adEourned for lac7 of =uorum.
ection /A.0L. One-ession Per )a2 Polic2. !o t3o
sessions4 3hether regular or special4 ma2 be held in a
single da2.
ection /A.60. Tie (ote. The regular Presiding
OGcer shall vote onl2 to brea7 a tie. The temporar2
Presiding OGcer 3ho ta7es the place of the regular
Presiding OGcer in the latterFs absence4 shall not vote
even in case of a tie but he shall certif2 3ithin ten da2s
from their passage all ordinances and resolutions
enacted or adopted b2 the anggunian 3hich he
presided.
ARTIC$E 1. Ordinances And Resolutions
ection /1.06. Enactment of Ordinances and
Adoption of Resolutions. In considering legislative
measures4 the anggunian shall observe the follo3ing
rules5
6, $egislative actions of a general and permanent
character shall be enacted in the form of ordinances
3hile those 3hich are of temporar2 character shall be
passed in the form of resolutions. 'atters relating to
proprietar2 functions and to private4 concerns shall also
be acted upon b2 resolutions.
/, Proposed ordinances and resolutions shall be in
3riting and shall contain an assigned number4 a title or
caption4 an enacting or ordaining clause4 and the date of
its proposed e?ectivit2. In addition4 ever2 proposed
ordinance shall be accompanied b2 a brief e;planator2
note containing the Eusti:cation for its approval. It shall
be signed b2 the author or authors and submitted to the
ecretar2 3ho shall report the same to the anggunian
at its ne;t session.
@, A resolution shall be enacted in the same manner
prescribed for an ordinance4 e;cept that it need not go
through a third reading for its :nal consideration unless
decided other3ise b2 the maEorit2 of all the members of
the anggunian.
B, !o ordinance or resolution shall be considered on
second reading in an2 regular session unless it has been
reported out b2 the proper committee to 3hich it 3as
referred to or it has been certi:ed as urgent b2 the
'a2or.
C, An2 legislative matter dul2 certi:ed b2 the 'a2or as
urgent 3hether or not it is included in the 8calendar of
business49 ma2 be presented and considered b2 the
bod2 at the same session or meeting 3ithout the need of
suspending the rules.
D, The ecretar2 to the anggunian shall prepare copies
of the proposed ordinance or resolution in the form it
3as passed on second reading4 and shall distribute to
each anggunian members a cop2 thereof4 e;cept that a
measure certi:ed b2 the 'a2or as urgent ma2 be
submitted for :nal voting immediatel2 after the period of
debate or amendment during the second reading.
I, !o ordinance or resolution passed b2 the anggunian
in a regular session or special session dul2 called for the
purpose shall be valid unless approved b2 a maEorit2 of
the members present there being a =uorum. An2
ordinance or resolution authoriAing or directing the
pa2ment of mone2 or creating liabilit24 shall re=uire the
aGrmative vote of a maEorit2 of all the anggunian
members for its passage.
J, #pon the passage of all ordinances or resolutions
directing the pa2ment of mone2 or creating liabilit24 and
at the re=uest of an2 member4 of an2 resolution or
motion4 the anggunian shall record the 8a2es9 and
8na2s9. Each ordinance and resolution shall be stamped
3ith the seal of the angguniang and recorded in a boo7
7ept for the purpose.
ection /1.0/. Approval of Ordinances or
Resolutions. Ever2 ordinance or resolution approving
the annual investment plan and annual investment
program enacted or adopted b2 the anggunan shall be
for3arded to the 'a2or for approval. If the ordinance or
resolution is approved b2 the 'a2or4 he shall aG; his
signature on ever2 page thereof and on the last page
thereof belo3 the 3ord 8Approved9.
%ithin ten da2s after receipt b2 the 'a2or of the
ordinance or resolution4 he shall return the same to the
anggunian 3ith either his approval or his veto. If he
does not return it 3ithin that time4 the ordinance or
resolution shall be deemed approved.
ARTIC$E C. (eto Po3er
ection /C.06. (eto Po3er of the 'a2or. The 'a2or
ma2 veto an2 ordinance or resolution approving the
annual development plan and annual investment
program on the ground that it is ultra vires or it 3ould be
preEudicial to the public 3elfare4 particularl2 stating his
reasons thereof in 3riting.
The 'a2or has the po3er to veto an2 particular
item or items of appropriation ordinance4 or of an
ordinance or resolution directing the pa2ment of mone2
or creating liabilit2. In such a case4 the veto shall not
a?ect the item or items4 3hich is or are not obEected to.
The vetoed item or items shall not ta7e e?ect unless the
anggunian overrides the veto in the manner provided in
the succeeding paragraph< other3ise4 the item or items
in the appropriation ordinance of the previous 2ear
corresponding to those vetoed shall be deemed re-
enacted.
The anggunian ma2 override the veto of the 'a2or
b2 t3o-thirds vote of all its members4 thereb24 ma7ing
the ordinance or resolution e?ective even 3ithout the
approval of the 'a2or.
The 'a2or ma2 veto an ordinance or resolution onl2
once.
ARTIC$E ). E?ectivit2 and Posting of Ordinances and
Resolutions
ection /).06. E?ectivit2. #nless other3ise
stated in the ordinance or resolution4 the same shall ta7e
e?ect after the lapse of ten da2s from date of its posting.
ection /).0/. Posting. A cop2 of the
ordinance enacted or resolution adopted b2 the
anggunian shall be posted in a bulletin board at the
municipal hall and in at least t3o conspicuous places
such as5 public mar7et4 church or chapel. The ecretar2
to the anggunian shall cause the posting of an
ordinance or resolution not later than :ve da2s after its
approval.
ection /).0@. Enforcement of )isapproved of
Invalidated Ordinance4 Resolution or E;ecutive Order.
An2 attempt to enforce4 promulgate or e;ecute an2
ordinance4 resolution or e;ecutive order after the
disapproval thereof b2 the 'a2or or after it has been
invalidated b2 the anggunian Panlala3igan4 shall be
suGcient ground for the suspension or dismissal of the
oGcer ma7ing such attempt.
ARTIC$E E. Enactment of an Ordinance Pertaining to
Closure of RoadsHtreets4 Alle2s4 Par7 PlaAa or =uare
ection /E.06. Temporar2 Closure. The
anggunian4 thru an ordinance4 ma2 authoriAe the
temporar2 closure of an2 road4 street4 alle24 par74 plaAa
or public s=uare4 or portion thereof4 3ithin the territorial
Eurisdiction of this municipalit2 on the occasion of an2
event that ta7es place in accordance 3ith e;isting la3s4
rules and regulations or time-honored traditions.
Provided4 that temporar2 closure of such public
properties shall be subEect to the follo3ing rules and
regulations5
6, )uring :esta celebrations4 a road4 street4 alle24
par74 plaAa or public s=uare ma2 be closed for certain
activities related to the celebration4 for a period not
e;ceeding three da2s or for a longer period as ma2 be
determined b2 the anggunian but not more than seven
da2s.
/, )uring agricultural or industrial fairs or e;positions4
a road4 street4 alle24 par74 plaAa or public s=uare ma2 be
closed for a period not e;ceeding one 3ee7 or for a
longer period as ma2 be determined b2 the anggunian
to be necessar2 and reasonable but not more that one
month.
@, %hen certain public 3or7 proEects or activities are
being underta7en such as la2ing of 3ater pipes4 gas4
electric or telephone 3ires or cables and the li7e4 an2
road4 street4 alle24 par74 or public s=uare ma2 be
temporaril2 closed for such periods as the anggunian
ma2 determine4 3henever re=uired for the safet24
securit24 health or 3elfare of the public or 3hen such
closure is necessar2 to facilitate the completion of the
3or7s4 and restore the road4 street4 alle2 par7 or public
s=uare to its former condition.
B, )uring actual emergenc2 a road4 street4 alle24 par74
plaAa or public s=uare ma2 be temporaril2 closed for the
entire duration of such emergenc2. In case such actual
emergenc2 is over4 the 'a2or shall order its re-opening
for public use.
C, The duration of the temporar2 closure shall be
speci:ed b2 the anggunian in the Ordinance.
D, !o road4 street4 alle24 par7 or public s=uare shall be
closed for games or activities such as bas7etball4
volle2ball4 races4 santacruAan4 religious processions and
the li7e not connected 3hatsoever 3ith an2 event
oGciall2 sponsored4 recogniAed or approved b2 the
anggunian.
I, The anggunian4 thru an Ordinance4 ma2
temporaril2 close and regulate the use of an2 local
street4 road4 thoroughfare4 or an2 other public place
3here shopping malls4 unda2 mar7ets4 >ea or night
mar7ets4 or shopping areas ma2 be established and
3here goods4 merchandise4 foodstu?s4 commodities4 or
articles of commerce ma2 be sold and dispensed to the
general public.
ection /E.0/. Permanent Closure. The
anggunian4 thru an Ordinance ma2 order the
permanent closure of an2 road4 street4 alle24 par7 or
public s=uare subEect to the follo3ing rules and
regulations5
6, The Ordinance authoriAing the permanent closure of
such public properties must be approved b2 at least t3o-
thirds of all the members of the anggunian.
/, The road4 street4 alle24 par7 or public s=uare to be
permanentl2 closed is o3ned b2 this municipalit2.
@, A notice of the proposed permanent closure of such
properties shall be served to all persons 3ho ma2 be
adversel2 a?ected b2 the closure at least ten da2s
before the enactment of the aforesaid ordinance.
B, !o such 3a2 or place or an2 part thereof shall be
permanentl2 closed 3ithout ma7ing provision for the
maintenance of public safet2 therein. A propert2 thus
permanentl2 3ithdra3n from public use ma2 be used or
conve2ed for an2 purpose for 3hich other real propert2
belonging to local government unit concerned ma2 be
la3full2 used or conve2ed5 Provided4 ho3ever4 that no
freedom par7 shall be closed permanentl2 3ithout
provision for its transfer or relocation to a ne3 site.
C, Public hearings shall :rst be conducted before an2
ordinance authoriAing permanent closure or roads4 alle24
par7s4 or s=uare is enacted.
!otices of such public hearings and copies of the
proposed Ordinance shall be posted for a minimum of
three consecutive 3ee7s in a least three conspicuous
places in the vicinit2 of the road or par7 to be closed.
D, !o permanent closure of an2 road4 street4 alle24
par7 or public s=uare shall be e?ected unless there
e;ists a good reason or suGcient Eusti:cation therefore4
such as4 but not limited to4 change in land uses4 urban
rene3al4 establishment of infrastructures or for such
compelling reasons as public 3elfare ma2 re=uire.
I, All persons adversel2 a?ected b2 the permanent
closure of such road4 street4 alle24 par7 or public s=uare
shall be properl2 indemni:ed.
ection /E.0@. Procedures for Indemni:cation.

6O Compliment to Public Interest. $ocal oGcials
and emplo2ees shall al3a2s uphold the public interest
over and above personal interest. All government
recourses and po3ers of their respective oGces must be
emplo2ed and used eGcientl24 e?ectivel24 honestl2 and
economicall24 particularl2 to avoid 3astage in public
funds and revenues.
/O Professionalism. $ocal oGcials and
emplo2ees shall perform and discharge their duties 3ith
the highest degree of e;cellence4 professionalism4
intelligence and s7ill. The2 shall endeavor to discourage
3rong perception of their roles as dispensers or peddlers
of undue patronage.

@O Pustness and incerit2. $ocal oGcials and
emplo2ees shall remain true to the people at all times.

underprivileged. The2 shall at all times respect the rights

times. %hen a con>ict of interest arises4 he shall resign
from his position in an2 private business enterprises
3ithin thirt2 da2s from his assumption of oGce andHor
divest himself of his shareholdings or interest 3ithin
si;t2 da2s from such assumption.
The same rule shall appl2 3here the local oGcial or
emplo2ee is a partner in partnership.
This re=uirement of divestment shall not appl2 to
those 3ho serve the government in a honorar2 capacit2
nor to laborers and casual or temporar2 3or7ers.
ARTIC$E ". Penalties
ection @".06. Fines< uspension or Removal<
or Imprisonment. In prescribing penalties for o?enders4

assemblies shall :rst obtain a permit from the

purpose4 a 3ritten application in a prescribed
form shall be submitted to the oGce of the
'a2or. The application shall set forth the name
and address of the applicant4 organiAer or
sponsor of the activit24 description of the
activit24 the place 3here the same 3ill be
conducted and such other pertinent
information or data as ma2 be re=uired.

person desiring to install an2 signboard or billboard shall

necessar2 plans and descriptions of the signboard or

and regulations for the proper implementation of this
Article.

8Astra2 Animal9 N means an animal 3hich is set loose or
not under the complete control of its o3ner4 or the one
in charge4 or in the possession thereof4 or found roaming
around4 in public or private places 3hether fettered or
not.
8Public Place9 N includes national4 provincial4 municipal
or baranga2 roads4 par7s4 plaAas4 and such other places
open to the public.
8Private place9 N includes privatel2-o3ned streets4 2ards4
rice:elds4 farmlands and lots o3ned b2 an individual
other than the o3ner of the animal.
ection D".0@. Impounding of Astra2 Animals.
Animals caught astra2 shall be impounded in a corral or
place dul2 designated for such purpose. Impounded
animals shall be released to its o3ner onl2 upon
pa2ment of the corresponding poundage fees imposed
under e;isting ta; ordinances of this municipalit2.
ection D".0B. Administrative Provisions.
6, !ot later than the follo3ing da2 after the animal is
impounded4 a notice of such impounding shall be
posted in at least three conspicuous places
including the public mar7et for a period of Five da2s
3ithin 3hich the o3ner of the animal is re=uired to
claim and establish o3nership thereof.
/, If no person shall claim o3nership of the animal
after the e;piration of Five +C, da2s from date of its
impounding4 it shall be sold to public auction under

a, The Treasurer shall post a notice for the
public auction in at lest three conspicuous

the animal shall be sold to the highest

ection IC. 0@. Rules and Regulations. An2 police
oGcer ma24 in the e;ercise of reasonable Eudgment4
decide that the presence of an2 person in an2 public
place is causing or is li7el2 to cause an2 of the conditions
enumerated in ection IC. 06 hereof and he ma24 if he
deems it necessar2 for the preservation of the public
peace and safet24 order that person to leave that place.
An2 person 3ho shall refuse to leave that public place
after being ordered to do so b2 a police oGcer shall be
apprehended and prosecuted for violation of this Article.

Article A. Public 'ar7ets
ection JA. 06.0 )e:nitions. As used in this Article-

as the public suppl2 and sale of electricit24 3ater and

a public mar7et 3hen it is dedicated to the service of the
general public and is operated under government control
and supervision as a public utilit24 3hether it be o3ned
b2 the government or b2 an2 instrumentalit2 thereof4 or
b2 an2 private individual +".R. !o. $ N /6/I,. Public
mar7et refer also to an2 place4 building or structure of
an2 7ind designated as much such b2 the anggunian
+$ocal legislative bod2, e;cept public streets4 plaAas4 and
the li7e.
8'ar7et Premises9 N refers to an open space in the
mar7et compound part of the mar7et lot consisting of
bare ground4 not covered b2 mar7et buildings4 usuall2
occupied b2 transient vendors speciall2 during mar7et
da2s.
8'ar7et tall9 N refers to an2 allotted space or booth in
the public mar7et 3here merchandise of an2 7ind is sold
or o?ered for sale.
8'ar7et section9 N refers to a subdivision of the mar7et
housing one class or group of allied goods4 commodities
or merchandise.
ection JA. 0/. 'ar7et Charges or fees. There shall
be collected from lessees of mar7et stall4 occupants of
mar7ets premises or transient vendors a mar7et rental
fee or entrance fee4 at such rates as ma2 be prescribed
b2 the anggunian in a ta; ordinance dul2 enacted that
purpose.
ection JA. 0@. AdEudication of (acant 'ar7et talls.
The adEudication of vacant or ne3l2 constructed mar7et
stalls shall be in accordance 3ith the provision of a dul2
enacted ordinance and the rules and regulations on this
matter promulgated b2 the angguniang 1a2an.
ection JA. 0B. $eases Period. The contract of lease
for a mar7et stall shall not be less than one 2ear4 but not
more than :ve 2ears4 rene3able upon its e;piration4
unless b2 the anggunian in a ne3 ordinance amending
this section.
ection JA.0C. Application for leases. The
application for lease of mar7et stalls shall be
accomplished under oath in a prescribed form and
submitted to the Chairman4 mar7et Committee4 b2 the
applicant4 either in person or thru his attorne2.
ection JA. 0D. Creation of a 'ar7et Committee.
There shall be created b2 the anggunian a permanent
'ar7et Committee 3hich shall conduct the dra3ing of
lots and opening of bids in connection 3ith the
adEudication of vacant or ne3l2 constructed stalls in the
public mar7et.
ection JA. 0I. Preference of Filipino CitiAens over
Alien Applicants. Applicant 3ho are Filipino shall have
preference in the lease of public mar7et stalls. If on the
last da2 set for :ling the applications4 there is no
application from a Filipino citiAen4 the posting of the
notice of vacanc2 prescribed in this chapter shall be
repeated for another ten da2s. If after the e;piration of
that period4 there is still no Filipino applicant4 then the
stall a?ected ma2 be leased to an2 alien applicant 3ho
:led his application :rst. If4 there are several alien
applicants the adEudication of the stall shall be made
thru dra3ing of lots to be conducted b2 the 'ar7et
Committee.
In case there is onl2 one Filipino applicant4 the stall
applied for shall be adEudicated to him. If there are
several Filipino applicants for the same stall4 the
adEudication of the stall shall be made thru dra3ing of
lots to be conducted b2 the mar7et committee on the
date and hour speci:ed in the notice. The result of the
dra3ing of lots shall be reported immediatel2 b2 the
committee to the 'a2or for appropriated action.
ection JA. 0J. (acanc2 of talls. If for an2 reason a
stall holder or leases discontinues or is re=uired to
discontinue his business before his leases contract
e;pires4 such stall shall be considered vacant and its
occupanc2 thereafter shall be disposed of in the manner
herein prescribed.
ection JA. 0L. Partnership 3ith tall Holder. An2
mar7et stall holder 3ho enters into a business
partnership 3ith an2 part2 after he ac=uired the right to
lease such stall have no authorit2 to transfer to his
partner the right to occup2 the stall. In case of death or
an2 legal disabilit2 of such stall holder to continue in his
business4 the surviving partner ma2 be authoriAed to
continue occup2ing the stall for period of not e;ceeding
si;t2 da2s 3ithin 3hich to 3ind up the business of the
partnership. If the survivor is =uali:ed to occup2 a stall
under the provisions hereof4 and the spouse4 parent4 son
daughter or relative 3ithin the third degree b2
consanguinit2 or be given the preference to continue
occup2ing the stall concerned if he applies for it.
ection JA.60. $essee to Personall2 Administer His
tall
An2 person 3ho has been a3arded the right lease a
mar7et stall administer and be present personall2 at his
stall or stalls. He ma2 emplo2 helpers 3ho must be
citiAens of the Philippines4 including but not limited to
his spouse4 parents and children 3ho are actuall2 living
3ith him and 3ho are not dis=uali:ed under he provision
hereof. The person to be emplo2ed as helpers hall4
under no circumstances4 be person 3ith 3hom the stall
older has an2 commercial relation or transaction.

ection JA. 66. )ummies< ub-$ease of talls.
In an2 case here the person registered to be the holder
or lessee of a stall r stalls4 booths4 in the public mar7et4
is found to be in realit2 not the person 3ho is actuall2
occup2ing said stall or stalls4 booth or booths4 the lease
of such stall or stalls4 booth or booths4 shall be canceled4
if upon investigation such stallholder shall be found to
have sub-leased his stall or stalls4 booth or booths4 to
another person or to have connived 3ith such person so
that the latter ma24 for an2 reason4 be able to occup2
the said stall or stalls4 booth or booths.
ection J.A6/. Rules and Regulations.
6, The peddling or sale outside the public mar7et
site or premises of foodstu?s4 3hich easil2

prohibited.
/, !o person shall utiliAe the public mar7et or an2
part thereof for residential purpose.

purchaser in the mar7et premises.
B, It shall be unla3ful for an2 person to resist4
obstruct4 anno2 or impede an2 mar7et emplo2ee
or personnel in the performance of his duties<
nor shall parent allo3 their children to pla2 in or
around their stalls or booths in the mar7et
premises.
C, It shall be unla3ful for an2 person to drin74 serve
or dispense li=uor4 or an2 into;icating drin7s or
beverages4 3ithin the premises of public mar7et
at an2 time of the da2.
D, !o merchandise or article shall be sold4 o?ered
for sale or e;posed for sale in the public mar7et
unless the same 3as legall2 ac=uired b2 the
vendor or stallholder and that ta;es of an2 7ind
due thereon had been paid.
I, It shall be unla3ful for an2 lessee to remove4
construct or alter the original structure of an2
stall4 electrical 3iring4 or 3ater connection
3ithout prior permit from the mar7et
administrator or person in charge of the public
mar7et.
J, The municipal government shall not be
responsible to the occupants of stall for an2
loss or damage cause b2 :re. Theft4 robber24
8force maEored9 or an2 other cause. All article
or merchandise left in the public mar7et during
closure time shall be at the ris7 of the stall
holder or o3ner thereof.
L, All articles abandoned in an2 public mar7et
building in violation of an2 provisions of this
Article or an2 regulation or rule on the
management of the mar7et shall be deemed a
nuisance. It shall be the dut2 of the 'ar7et
administrator or his subordinate to ta7e
custod2 thereof. In case the articles are
claimed 3ithin t3ent2-four hours thereafter4
the2 shall be returned to their original o3ners
upon pa2ment of actual e;penses incurred in
their safe-7eeping4 unless the2 have so
deteriorated as to constitute a menace to
public health4 in 3hich case the2 shall be
disposed of in the manner directed b2 the
'ar7et administrator 3ho ma2 also in his
discretion4 cause the criminal prosecution of
the guilt2 part24 or merel2 3arm him against
future violation. In case 3here the articles
have not deteriorated and are not claimed
3ithin the time herein :;ed4 said articles shall
be sold at public auction4 and the proceed
thereof shall be disposed in accordance 3ith
la3.
ection JA. 6@. Applicabilit2 Clause. E;isting
la3s4 ordinances4 rules and regulations pertaining to the
administration of the public mar7et are hereb2 adopted
as part of this article.
ection JA. 6B. Penalt2. An2 person 3ho
violates an2 provisions of this Article shall be punished
b2 a :ne of not more than T3o Thousand Five Hundred
Pesos or imprisonment of not more than si; months4 or
both :ne and imprisonment4 at the discretion of the
Court.
Article 1. laughterhouse
ection J1. 06. Permit to laughterhouse. 1efore
an2 animal is laughtered for public consumption4 a
permit therefore shall be secured from the 'unicipal
Health OGcer of dul2 authoriAed representative 3ho 3ill
determine 3hether the animal or fo3l is :r for human
consumption4 upon pa2ment to the 'unicipal Treasurer
of the corresponding permit fee prescribed under
e;isting ta; ordinances.
ection J1. 0/. Prohibition. Permit to slaughter
shall not be granted nor the corresponding fee collected
on animals condemned b2 the 'unicipal Health OGcer.
ection J1. 0@. Administrative Provisions
6, The slaughter of an2 7ind of animal intended
for sale shall be done onl2 in the municipal
slaughterhouse designated as such b2 the
anggunian. The slaughter of animals
intended for home consumption ma2 be done
else3here4 e;cept large cattle 3hich shall be
slaughtered onl2 in the municipal
slaughterhouse. The animal slaughtered for
home consumption shall not be sold of o?ered
for sale.
/, 1efore issuing the permit for slaughter of large
cattle4 the 'unicipal Treasurer shall re=uire for
branded cattle4 the production of the
certi:cates of o3nership if the o3ner is the
applicant4 or the original certi:cate of
o3nership and certi:cate of transfer sho3ing
the title in the name of the of the person
appl2ing for the permit if he is not the original
o3ner. If the applicant is not the original
o3ner4 and there is no certi:cate of transfer
made in his favor4 one such certi:cate shall be
issued and the corresponding fee be collected
therefore. For unbranded cattle that have not
2et reached the age of branding4 the 'unicipal
Treasurer shall re=uire such evidence as ma2
be satisfactor2 to him regarding the o3nership
of the animals for 3hich permit to slaughter
has been re=uested. For unbranded cattle of
the re=uired age4 the necessar2 certi:cate of
o3nership andHor transfer shall be issued4 and
the corresponding fees collected therefore
before the slaughter permit is granted.
@, 1efore an2 animal is slaughtered for public
consumption4 a permit therefore shall be
secured from the 'unicipal Health OGcer or his
dul2 authoriAed representativeH The permit
shall bear the date and month of issue and the
stamp of the 'unicipal Health OGcer4 as 3ell
as the page of the boo7 in 3hich said permit
number is entered and 3herein the name of
the permit tee the 7ind and se; of the animal
to be slaughtered appears.
ection J1. 0B. Penalt2. An2 person 3ho
violates an2 provisions of this Article shall be punished

Pesos or imprisonment of not more than si; months4 or
both :ne and imprisonment4 at the discretion of the

Article C. Public Cemeter2
ection C. 06. $ease of 1urial $ot.There shall be
collected a rental fee for ever2 burial lot consisting of
:ve s=uare meters +/;/.C s=. m., in the amount
prescribed b2 the anggunian in a ta; ordinance
enacted for that purpose. The lease period for ever2
burial lot shall be :ve 2ears4 rene3able upon its
e;piration at the option of the lessee.
ection JC. 0/. ale of 1urial $ot. hould
the anggunian decide to set aside portions of the
public cemeter2 for sale4 the conditions of the sale and
the amount thereof shall be stipulated in another
ordinance.
ection JC. 0-@. Administrative Provisions.
6,. Permit to Construct. An2 construction of
3hatever 7ind or nature in the public cemeter24 3hether
for permanent or temporar2 use4 shall onl2 be allo3ed
after the approval of a permit issued b2 the 'a2or upon
the recommendation of the 'unicipal Health OGcer.
/,. Rene3al of $ease. In cases of lessee intends to
rene3 the lease after its termination4 he must inform the
'unicipal Treasurer 3ithin thirt2 da2s before the e;pir2
date of the lease4 and shall pa2 the corresponding rental
fees therefore. It shall also be the dut2 of the 'unicipal
Treasurer to prepare and submit to the 'a2or a list of the
leases that are to e;pire :ve da2s prior to the e;piration
date. The 'unicipal Treasurer shall send a reminder to
the lessee of the e;piration of his lease4 t3o 3ee7s prior
to the e;piration date of the lease.
@,. Register. The 'unicipal Treasurer shall 7eep a
register of account of the public cemeter24 together 3ith
such additional information as ma2 be re=uired b2 the

competitions4 special means or matched set to or
encounters4 pinta7asi4 and ordinar2 coc7:ghts inside a
dul2 licensed coc7pit.
8Pit 'anager9 refers to a person 3ho professionall24
regularl2 and habituall2 manages a coc7pit and
coc7:ghts therein. He ma2 or ma2 not be the o3ner of
the coc7pit himself.
8"a?er9 + 'ananari, refers to a person 3ho is
7no3ledgeable in the techni=ue of arming :ghting coc7s
3ith ga? or grafts on either or both legs of the coc7s.

8Referee9 + entenciador , refers to a person 3ho
3atches and oversees the progress of the coc7:ght and
decides its result b2 announcing the 3inner or declaring
a dra3 or no contest game.
81et 'anager9 + Kasador , refers to a person 3ho
calls and ta7es care of bets from o3ner of both
gamecoc7s and those of other bettors before he orders
enactment of the coc7:ght and thereafter distribute
3inning bets after deducting a certain commission.

operator of a motor vehicle.
8High3a2s9 shall mean ever2 public thoroughfare4
public boulevard4 drive3a24 Avenue Par7. Alle2 and
galleon4 but shall not include road3a2 upon grounds
o3ned b2 private persons4 college4 universities or other
similar institutions.
8Par7ing9 or 8Par7ed9 shall mean that a motor
vehicle has been brought to a stop on the shoulder or
proper edge of a high3a24 and remains inactive in that
place or close thereto for appreciable period of time. A

passenger or to ta7e in 3aiting reasonable dispatch shall

Article 1. Overta7ing and Passing a (ehicle< Turning
at Intersections
ection 601. 06 Overta7ing a (ehicle. The
driver of an2 motor vehicle overta7ing another vehicle
proceeding in the same direction shall pass at a safe
distance to the left thereof4 and shall not again drive to
the right side of the high3a2 until safet2 clear of such
overta7en vehicle4 e;cept that4 on a high3a2 thin a
business or residential district4 having t3o or more
vehicle ma2 overta7e and pass another vehicle on the
right thing in this Article shall be construed to prohibit a
driver overta7ing and passing upon the right of other

The driver of a vehicle about to be overta7en b2
another vehicle approaching from the rear shall give 3a2

business or residential district shall 2ield the right of

ambulance 3hen such vehicle is being operated on
oGcial business and the driver thereof sounds audible

Emergenc2 (ehicles. #pon the approach of an2 police or

In the event that an2 accident should occur as a result of
the operation of a motor vehicle upon high3a24 the
driver of that vehicle shall stop immediatel24 and4 if
re=uested b2 an2 person present shall sho3 his driverFs
license4 give his true name and address and also the
true name and address of the o3ner of the motor
vehicle.
!o driver of a motor vehicle concerned in a
vehicular accident shall leave the scene of the accident

identif2ing mar7s of the cattle.
/, The transfer of large cattle4 regardless of age4 the
use of brand4 shall li7e3ise be registered 3ith the
OGce of the 'unicipal Treasurer. The entr2 in the
registr2 boo7 shall set forth among others4 the
name and residence of the o3ners and
purchaser4 the consideration or purchase price of
the animal in cases of sale or transfer< and the

mar7s of the large cattle. These data shall also
be stated in the Certi:cate of O3nership issued
to the o3ner thereof.

light materials inside a resort compound being rented for
N a Nfee to patrons4 guests or customers.
ection 66". 0@. Rules and Regulations.
6, Operator of resorts shall 7eep a registr2 or record of
its guests4 patrons or customers renting its cottages
for at least one da24 or fraction thereof4 3hich shall
be open for inspection b2 the 'a2or or his dul2
authoriAed representative and the local Chief of the
Philippine !ational Police. The registr2 or record
shall contain the follo3ing5 name and residence of
the guests< patrons or customers< number of the
Communit2 Ta; Certi:cate or Alien Certi:cate of
registration if an alien< date and place of issue<
number of Id card and such other data as ma2 be
re=uired later b2 the authorities concerned.

operate 3ithout emplo2ing an embalmer dul2
licensed b2 the department of Health.

Establishments.
a, !o permit shall be issued to operators of
hotels4 motels4 appartelles4 lodging houses4
boarding houses4 taverns or inns and other
similar establishments 3ithout the
recommendation of the Chief of the Fire
)epartment and the 'unicipal Health OGcer or
their dul2 authoriAed representatives. The said
oGcials shall include in their recommendations
a statements that the2 have inspected the
place and found it to have complied 3ith the
rules and regulations being implemented b2
their respective oGces.

record of its =uests4 patrons4 lodgers4
customers4 or boarders4 as the case ma2 be4
3hich shall representative. The registr2 or
record shall contain the follo3ing5 name and
permanent residence of the guests4 communit2

Article A. "eneral Penal Provision
ection 6/A. 06 Penalt2. An2 violation of the
provisions of this code not herein other3ise covered a
speci:c penalt24 or of the rules and regulations
promulgated under the authorit2 of this code4 shall be
punished a :ne of not e;ceeding T3o Thousand Five
Hundred Pesos or imprisonment of not e;ceeding si;
months4 or both :ne and imprisonment4 at the discretion
of the Court.
