Council President, Paul A. Camuso, called the Thirty Second Regular Meeting of the
Medford City Council to order at 7:00 P.M. at the Howard F. Alden Memorial
Auditorium, Medford City Hall.

NOTICE OF A PUBLIC HEARING

A Public Hearing will be held by the Medford City Council in the Howard F. Alden
Memorial Auditorium, City Hall, 85 George P. Hassett Drive, Medford,
Massachusetts, on Tuesday Evening, October 28, 2014, at 7:00 P.M. on a
petition from Kohls Department Stores Inc, for a Special Permit to amend its
Hours of Operation in accordance with Medford Zoning Ordinance Chapter 94,
sec. 94-145(b) to operate extended hours at its business at the Meadow Glen
Mall, Locust Street, Medford, MA. On said site being located in a I (Industrial)
Zoning District

11:00 PM to 7:00 AM (24 Hours)
per day on up to ten (10) days per-year between Thanksgiving and
Christmas Day to accommodate Black Friday and Christmas season

You are hereby notified that by order of the Medford City Council, a Public Hearing will be
given at the Howard F. Alden Memorial Auditorium, 85 George P. Hassett Drive, City Hall, Medford,
Massachusetts at 7:00 P.M., on TUESDAY, October 28, 2014 on a petition by Lightower Fiber Networks,
80 Central Street, Boxborough, MA 01719 permission to construct, install a fiber optic service to
101 Main Street, Medford (Mass Eye and Ear),
Description of Access; Emerson Street @ the intersection of Main St. @ Utility Pole #6088/1241 in the City
of Medford by installing fiber optic service lateral from pole #6088/1241 on Emerson St. crossing Emerson
St. to service Mass Eye and Ear @ 101 Main Street. The Underground utility work consist of to dig a service
on Emerson St 24 deep from electric pole #6088/1241 westerly on Emerson St., 20 turning northerly 30
crossing Emerson St with an additional 8dig to the back edge of sidewalk to enter the property @ 101 Main
Street where we will dig an additional 40 to enter the building @ 101 Main St. Lightower will place1
schedule 40 pvc conduit encased to 101 Main Street. Lightower will backfill with suitable fill free of large rock
and debris placing caution tape 12 above concrete encased conduit. Lightower will restore roadway and
sidewalk to equal or better condition than before construction begin
Wherefore it prays that after due notice and hearing as provided by law, it may be granted permission to
excavate the public highways and to run and maintain fiber optic cables, together with such sustaining and
protecting fixtures as it may find necessary for the transmission of fiber optic. Said fiber optic cable to be
located substantially in accordance with the plan filed herewith marked 101 Main Street-Lightower, July
2014

Approved Chief Engineer w/ provision that no city owned or private utilities or other structures are
adversely impacted. Lightower shall insure that all sewer, water and drain lines are marked prior to any
excavation Whenever the new concrete encased conduit crosses other utilities, particularly water and
sewer services, Lightower shall ensure that it maintains a 2-ft vertical clearance over said utilities, otherwise
the conduit will need to be raided or the impacted utility lowered to achieve this clearance. In addition to the
2ft vertical clearance, the conduit shall also maintain a minimum of 2 ft horizontal clearance from any water
or sewer services
. Temporary trench patch shall be asphalt base course; it shall match the existing thickness of the existing
pavement but no less than 4-inchs in depth. The applicant shall allow the trench to settle over one winter
and return the following spring, grind 2 inches and pave with asphalt top course. Concrete sidewalk
panels that are disturbed shall be saw cut at the joints and new concrete placed. Asphalt shall be replaced
in-kind

Before beginning work the contractor shall notify Dig Safe and shall obtain applicable permits from the
Engineering Division. The contractor shall utilize City of Medford regulations and standards for restoration as
well as remove all debris related to its work
Underground work will be done and there shall be no disturbance to the City of Medford sidewalk or
roadways

You are hereby notified that by order of the City Council, a Public Hearing will be given at
the Howard F. Alden Memorial Auditorium, 85 George P. Hassett Drive, City Hall, Medford,
Massachusetts at 7:00 P.M., on TUESDAY, October 28, 2014 on a petition of Teleport Communications
America, LLC, subsidiary of At&T Corp, Siena Engineering Group Inc for permission to lay, maintain and
operate underground conduits with cables , including the necessary sustaining and protecting fixtures, under
and across the public or ways hereinafter named.

Fulton Street: from existing utility pole # 143 to the p[property pole #143 to the property of 59 Valley
Street, 1 4 inch pvc conduit, approximately 138 feet in length. The conduit shall be placed at an
approximate depth of 48 inches and in accordance with the requirements of the City of Medford.

Wherefore it prays that after due notice and hearing as provided by law, it may be granted permission to
excavate the public highways and to run and maintain underground cable(s) . Said underground conduits to
be located substantially in accordance with the plan filed herewith marked Proposed Conduits Placement,
Fulton Street, dated July 10, 2014

Dear Mr. President and City Councillors:

I respectfully request and recommend that your Honorable Body appropriate $173,400
from the Sale of Lots and Graves Account to the Cemetery Department Salary Account.
This recommended appropriation is requested in accordance with Page 40 of the Fiscal
2015 budget. The Cemetery Department Salary account is reduced each year in
anticipation of an appropriation from Sales of Lots and Graves.

In addition, I respectfully request and recommend that your Honorable Body appropriate
$159,759 from Perpetual Care to the Cemetery Department Expense budget. This
recommended appropriation is requested in accordance with Page 41 of the Fiscal 2015
budget. The Cemetery Expense budget is reduced each year in anticipation of an
appropriation from Perpetual Care.
