FROM THE EDITOR
During the Onam festival, celebrated with traditional pomp, the spoilsports were rains and
roads. The scandals and rife, viral in almost all spheres of State administration-
Education, Law and order, Prohibition, Finance, Environment protection etc are
nauseating. Let us hope Dussera and Deepavali will herald a more congenial period
ahead. Let us also not forget the Mangalyaan; it has been exhilarating, making every
Indian proud.
Er Madhava Menon chose the Engineers Day to depart from this world. As mentioned by
his erstwhile colleague Sudhakaran in his moving tribute, he left us all in grief.
Lineage has tried to maintain variety and we thank all readers and contributors for
sustaining our journal. Well strive to rise to your expectations. Feel free to air your honest
opinion.
Gandhi Jayanthi gives us an opportunity to introspect. We have moved far away from the
Mahatmas path in the last 66 years, find ourselves almost diametrically opposite in our
conduct, beliefs and tenets. Dr. Radhakrishnans words on the cover are not empty
rhetoric. Do we still have any right to call ourselves the descendants and heirs of
Gandhiji?

Why I Am an Indian - Khushwant Singh
Why am I an Indian? I did not have any choice: I was born one. If the good Lord had
consulted me on the subject I might have chosen a country more affluent, less crowded,
less censorious in matters of food and drink, unconcerned with personal equations and
free of religious bigotry. Am I proud of being an Indian? I cant really answer this one. I
can scarcely take credit for the achievements of my forefathers. And I have little to be
proud of what we are doing today. On balance, I would say, No, I am not proud of being
an Indian.
Why dont you get out and settle in some other country? Once again, I have very little
choice. All the countries I might like to live in have restricted quotas for emigrants. Most of
them are white and have a prejudice against coloured people. In any case I feel more
relaxed and at home in India.
I dislike many things in my country, mostly the government. I know the government is not
the same things as the country, but it never stops trying to appear in that garb. This is
where I belong and this is where I intend to live and die. Of course I like going abroad.

Living is easier, the wine and food are better, the women more forthcoming its more
fun. However, I soon get tired of all those things and want to get back to my dung-heap
and be among my loud-mouthed, sweaty, smelly countrymen. I am like my kinsmen in
Africa and England and elsewhere. My head tells me its better to live abroad, my belly
tells me it is more fulfilling to be in phoren, but my heart tells me get back to India.
Each time I return home, and drive through the stench of bare-bottomed defecators that
line the road from Santa Cruz airport to the city, I ask myself:
Breathes there the man with soul so dead

Who never to himself hath said
This is my own, my native land?
I can scarcely breathe, but I yell, Yeah, this is my native land. I dont like it, but I love it.
Are you an Indian first and a Punjabi or Sikh second? Or is it the other way around? I
dont like the way these questions are framed and if I am denied my Punjabiness or my
community tradition, I would refuse to call myself Indian. I am Indian, Punjabi and Sikh.
And even so I have a patriotic kinship with one who says I am Indian, Hindu and
Haryanvior I am Indian, Moplah, Mulsim and Malayali. I want to retain my religious and
linguistic identity without making them exclusive in any way.
I am unconvinced that our guaranteed diversity is our strength as a nation. As soon as
you try to obliterate regional language in favour of one national language or religion, in
the name of one Indian credo, you will destroy the unity of the country. Twice was our
Indianness challenged -- in 1962 by the Chinese; in 1965 by the Pakistanis. Then,
despite our many differences of language, religion and faith, we rose as one to defend
our country. In the ultimate analysis, it is the consciousness of frontiers that makes a
nation. We have proved that we are one nation.
What then is this talk about Indianising people who are already Indian? And has anyone
any right to arrogate to himself the right to decide who is and who is not a good Indian?

Make in India -ChetanBhagat
India Park. It has swings, nature trails, flowerbeds, sports facilities and walking tracks. Everything is
wonderful, except for one thing: Kids dont come to play there. This is because the park is mostly
used by senior citizens, whom the kids refer to as uncles. Over a hundred uncles use the park for
their morning/evening walks, society meetings and yoga classes. Each uncle also carries a stick, and
uses it on the few kids who happen to venture into the park. If a kid jumps too much, squeals in
delight, climbs up a tree or plays cricket, the uncles whack the kids. After all, the uncles feel, the park
must be kept in order. There is even a microphone system installed that warns kids to behave as
expected, the kids soon abandon the park. They go across town to China Park, where they are made

to feel welcome. There are rules in that park too kids are told to keep the place clean and not hurt
anyone. But apart from that, they are encouraged to have fun. The only few kids who still use India
Park are those who have figured out how to manage the uncles. Whenever they come to play, they
bring treats for the uncles a box of sweets, cold drinks or newspapers. Uncles then leave them
alone for a bit. However, the number of kids doing this is small, as bribing uncles is not what most
good kids do. India Park, hence, is mostly empty and under-utilized.
Then the uncles of India Park start wondering why so few kids come to play there while twenty times
the number go to China Park? Uncles have meetings, sticks kept in their lap, to discuss the solution.
They put up huge signs outside the park saying Kids Welcome. However, nothing seems to change.

In the above story, replace uncles with the Indian Government, kids with Foreign Direct Investors,
fun with legitimate profit and India Park with India. This sums up how we approach the global
investor community. We want them here, but we want to beat them with a stick and shout at them
the moment they start having some fun (or earn a reward, in terms of legitimate profits).
This is why we have a long way to go to achieve the PMs Make in India slogan. The hardest part in
achieving this is not the manufacturing infrastructure we need to set up; it is the control freak
mindset that exists in our power corridors (or rather in any Indian entity with power).
So we say we will never use the retrospective tax laws (which effectively allow the government to
change tax laws for previous years and take more money), but we dont remove the law either. The
uncles say, We will keep the stick, but we will never use it. Well, maybe not today but what if
another uncle comes tomorrow? Are the rules going to depend on the uncles personality? We want
companies across the world to invest here, but the government places so many controls and
permissions that it effectively controls every business. We call it free-market capitalism, but in reality
it is state-controlled capitalism. The only way the uncles will let you do business is if you keep giving
them enough treats. This is how India has been run since Independence, and that is why it is difficult
to change the mindset. The unfortunate part is this uncle-and-stick model keeps the park empty. If
investors dont come, we dont have jobs or growth. Kids can play in other parks. Asian economies,
Eastern Europe and Latin America are all competing for investor dollars and to be manufacturing
hubs. The only way the investors will come is if the rules are clear, simple and not politician-
personality-dependant in spirit, writing and practice.
If we really want Make in India, the government has to let go. Keep business rules, but according to
international standards. Get the government out of business, not just in terms of selling PSUs, but
also having no arbitrary or discretionary control over individual businesses. All this should be
personality-proof. The current FM may be investor friendly. The next one may not. If I have invested
money in India, how can I be sure the new guy wont come behind me with a stick?
All these issues have to be addressed if we want economic and jobs growth which, come to think of
it, is what makes acche din happen. Let go of the sticks uncles; let the kids come and play.

So, How to make full use of our 30%.?
Go for medical check-up even when you feel fit.
Drink more water even if youre not thirsty.
Let go your ego, whenever you can.
Give in even if you are right.
Be humble even if you are very powerful.
Be contented even if you are not rich.
Exercise even if you are very busy.

WILL YOUR NOMINEE GET THE MONEY?
Did you think that your nominee is the person, who will get all the money legally from your Life
Insurance Policy and Mutual funds investments? Ha! That is exactly what youd think if you
arent aware of the legal aspects. We assume a lot of things which sounds like theyre obvious,
but are not true from the legal point of view. Today, well concentrate on nominations in
financial products.
For whom are we earning? For whom are we investing? Who, do we want to leave all our wealth
to, in case something happens to us? It might be your children, your spouse, parents, siblings
etc., or just a subset of these. You also might want to exclude some people from your list of

beneficiaries!. So you think you will nominate person X in your Insurance policy, and when you
are dead and gone, all the money goes to person X and he/she becomes the sole owner? Youre
wrong, dude! It doesnt work that way. Lets see how it actually does!
What is a nominee?
According to law, a nominee is a trustee not the owner of the assets. In other words, he is only
a caretaker of your assets. The nominee will only hold your money/asset as a trustee and will be
legally bound to transfer it to the legal heirs. For most investments, a legal heir is entitled to the
deceaseds assets. For instance, Section 39 of the Insurance Act says the appointed nominee will
be paid, though he may not be the legal heir. The nominee, in turn, is supposed to hold the
proceeds in trust and the legal heir can claim the money.
A legal heir will be the one whose is mentioned in the will. However, if a will is not made, then
the legal heirs of the assets are decided according to the succession laws, where the structure is
predefined on who gets how much. For example, if a man during his lifetime executes a will. In
the will, he mentions his wife and children as legal heirs, then after his death, his wife and
children are the legal owners of his assets. It is essential that one needs to execute a will. It is the
ultimate source of truth and replaces the succession law. Nominee can also be one of the legal
heirs.
Important Mention the Full Name, Address, age, relationship to yourself of the nominee. Do
not write the nomination in favour of wife and children as a class. Give their specific names
and particulars existing at that moment. If the nominee is a minor, appoint a person who is a
major as an appointee giving his full name, age, address and relationship to the nominee.
Why is the concept of nominee?
So you might be wondering, if the nominee does not become the sole owner, why does such a
concept of nominee exist at all? Its pretty simple. When you die, you want to make sure that
the Insurance company, Mutual fund or your shares should at least get out of the companies and
go to someone you trust, and who can further help, in process of passing it to your legal heirs.
Otherwise, if a person dies and hasnt nominated anyone, your legal heirs will have to go through

the process of producing all kind of certificates like death certificates, proof of relation etc., not
to mention that the whole process is really cumbersome! (For each legal entity! The insurance
company, the mutual funds, for the shares, for the real estate..) . So, to simplify, if a nominee
exists, these hassles dont happen, since the company is bound to transfer all your money or
assets to the nominee. The company the goes out of scene & then, its between nominee and
legal heirs.

Example of Nomination

Ajay was 58 years old who died recently in an accident. As his children were settled, he wanted
to make sure that his wife is the sole owner of all the monetary assets. This includes his insurance
policy and mutual funds.
So during his lifetime, he nominated his wife as a nominee in his term insurance policy and
mutual funds investments. However, after Ajays death things didnt turn up the way he wanted.
The reason being Ajay did not leave a will. Though his wife was the nominee in all his movable
assets, as per the law, his wife, along with children, were the legal heirs and all of them had equal
right to Ajays assets.
One simple step which could have saved the situation was that Ajay should have made a will
which clearly stated that only his wife was entitled to get all the money and not his children.
IMPLICATIONS OF NOMINATION ARE DIFFERENT FOR EACH CATEGORY!!

Nomination in Life Insurance

A policyholder can appoint multiple nominees and can also specify their shares in the policy
proceeds. Nomination in life insurance has one limitation, as insurance policies are bought to
secure your financial dependents; your first choice of nominee has to be your family members.
In case you want to nominate a non-family member like a friend or third party, you will have to
show/PROVE the insurance company that there is some insurable interest for the person. This
happens because of a Clause called PRINCIPAL OF INSURABLE INTEREST in insurance. Note that
provision of nomination in life insurance is related to Section 39 of the Insurance Act. Note that
as per LIC website Nomination is a right conferred on the holder of a Policy of Life Assurance on
his own life to appoint a person/s to receive policy moneys in the event of the policy becoming a
claim by the assureds death. The Nominee does not get any other benefit except to receive the
policy moneys on the death of the Life Assured. A nomination may be changed or cancelled by
the life assured whenever he likes without the consent of the Nominee. Make sure, you have a
nominee for your policy for easy settlement of the claim, if you do not have any nominee
mentioned in the policy, it can turn out to be a disaster for your dependents to get a claim.

Nomination in Mutual funds

In case of mutual funds, you can nominate up to three people, who can be registered at the time
of purchasing the units. While filling in the application form, there is a provision to fill in the
nomination details. Even a minor can be a nominee, provided the guardian is specified in the
nomination form. You can also change nomination later by filling up a form which is available on
the mutual fund company website. Nomination in mutual funds is at folio level and all units in the
folio will be transferred to the nominee(s). If an investor makes a further investment in the same
folio,the nomination is applicable to the new units also. A non-resident Indian can be a nominee,
subject to the exchange control regulations in force
from time to time.

Nomination in Shares

Quiz for you. Now you know what a nominee means and who actually gets the money. So if there
is a husband H, with wife W and nephew N, and he has nominated his nephew N to be the
nominee of his shares in demat account, who will have the legal right to own the shares after
husbands death? If you answer is wife, you are wrong in this case! In case of stocks, it does not
work the usual way, if a will does not exist.
In the verdict, Justice Roshan Dalvi struck down a petition filed by Harsha Nitin Kokate, who was
seeking permission to sell some shares held by her late husband. The Court noted that as she was
not the nominee, she had no ownership rights over the shares. Ms Kokates lawyer had argued
that as she was the heir of her husband who had died intestate (without a will), she should have
ownership rights of the shares, and be able to do anything with them as she wished. In this case,
Ms Kokates husband had nominated his nephew in favour of the shares. Justice Dalvi however
noted that under the provisions of the Companies Act and the Depositories Act, Acts which
govern the transfer of shares, the role of a nominee was different.A reading of Section 109(A) of
the Companies Act and 9.11 of the Depositories Act makes it abundantly clear that the intent of
the nomination is to vest the property in the shares which includes the ownership rights
thereunder in the nominee upon nomination validly made as per the procedure prescribed, as
has been done in this case.
It means that if you have not written a will, anyone who has been nominated by you for your
shares will be the ultimate owner of those stocks, the succession laws on inheritance will not be
applicable but in case, you have made a will, that will be the source of truth.

Nomination in PPF
Let me give you some shock first. If you have Rs 10 lakh in your public provident fund (PPF)
account and you have not nominated anyone for your PPF account, your legal heirs will get

maximum of Rs 1 lakh only! Yes, its so important to have a nominee, now you get it. You can
nominate one or more persons as nominee in PPF. Form F can be used to change or cancel a
nomination for PPF. Also note that you cannot nominate anyone if you open an account for a
minor.
Nomination in Saving/Current/FD/RD Account in Banks

FDs also come with nomination facility. While opening a new account, there is a column for
nomination in the same form and you should fill it. You can nominate two persons with first and
second option. Note that in case you have not done any nomination till now, you should request
Form No DA-1 from your Bank which is used to assign a nominee in future. (Examples of ICICI
Bank , HDFC Bank , Canara Bank) . In the same way to change/cancel the nomination you need to
fill up Form no DA-2.

As per a famous case, the Bench of Justices Aftab Alam and R M Lodha in an order said that the
money lying deposited in the account of the original depositor should be distributed among the
claimants in accordance with the Succession Act of the respective community and the nominee
cannot claim any absolute right over it.
Section 45ZA(2)(Banking Regulation Act) merely put the nominee in the shoes of the depositor
after his death and clothes him with the exclusive right to receive the money lying in the account.
It gives him all the rights of the depositors so far as the depositorss account is concerned. But it
by no stretch of imagination makes the nominee the owner of the money lying.

OBITUARY
Er K.Madhavamenon passes away
Er.K.Madhava Menon, Retired Executive Engineer (KSEB) passed away at a private hospital in
Kozhikode on 15.09.14.He was 72 and is survived by his wife, a daughter and a son.
Our good old friend, Menon was a strong and active member of the KSEB Engineers Association. He
held positions of unit Secretary, unit Chairman and State organizing Secretary during different periods.
He served at Shornur, Balussery, Kunnamangalam and Kozhikode in the Distribution wing and at 220kV
Nallalam Sub-station during his career in KSEB. A good organizer and effective motivator, Menon was
popular in the professional fraternity.
His body was cremated on 16
th
at Kozhikode. KSEB Senior Engineers, Kozhikode mourns the demise of
Er. Madhava Menon. MAY HIS SOUL REST IN PEACE. V.Ramachandran
I am very sad to learn the demise of our good friend, Er Madhava Menon. Pray God almighty to rest the
departed soul in Peace. PR Vaidyanathan
I am really sad to hear about his demise. I had no opportunity to work with him. But I had on many
occasions associated with him in the activities of the Engineers Association. Menon used to attend
almost all meetings and he used to shock the members with his unconventional suggestions, novel
ideas and jokes.
I remember an occasion when Er TG Ravi, the cine artist cracked a joke about Menons entry to the
Hostel of Government Engineering College, Thrissur, (-50years ago?-Ed) carrying an easy chair with
him. Listeners could not stop their laughter for minutes
Let me conclude my words remembering his loud HA, HA, HA. mksudhakaran
I am very much saddened to hear about the passing away of Er Madhava Menon. He was a friend of
mine through the activities of the Engineers Association. He was very friendly and polite. May his soul

of ice water over their heads and
pledging support (both through the
challenge itself and financially) to
the cause.
At the heart of every challenge is
the true cause: raising awareness
and financial support to help
fight Amyotrophic Lateral Sclerosis

(ALS) (or Lou Gehrig's Disease), which is a degenerative and fatal disease affecting an
estimated 30,000 people at a time in the US alone. So far, the Ice Bucket Challenge has raised
over $100 million in donations to help people with ALS and to fund further research and public
policy.
The Performance
Lift and tip the ice water over your head. Brace yourself for the cold. This can be self-executed
or you can have someone else do the honors. Keep in mind to stay safe while doing this--
whipping a bucket of ice water onto someones vulnerable head from a roof top or any other
extreme distance could actually result in head trauma--not what the folks at ALSA were hoping
to achieve.
The original point of the challenge was to get people to either do the challenge or donate.
However, if you can pledge financial support, it's a good idea to do both. Many people out there
are now doing the ice challenge and donation, instead of picking one, and every contribution
goes a long way.
Tips
Do some research. Head to ALSA.org before you take the challenge to get a better
understanding of how devastating this disease is for those afflicted and their families. Knowing
more about the cause will fuel your resolve to keep the challenge going.

An authors experience:
One of the most viral philanthropic social-media campaigns in history has reached our family
too. We were about to board an international flight when both of my children were called out by

their friends on Face book to accept the Ice Bucket Challenge for amyotrophic lateral sclerosis
(ALS), the deadly neurological condition commonly known as Lou Gehrigs disease.
My kids are no strangers to ALS. Our neighbor has it, and my daughter is a student at Boston
College, the alma mater of Pete Frates, the young man whose fight inspired the challenge. But I
dont recall talking about ALS as a family before, and I doubt either of my kids had ever
discussed it with their friends. Like most other rare diseases, ALS doesnt often find itself in the
spotlight.
At 30,000 ft., we talked for the first time about the devastation ALS brings and what is being
done about it. We watched countless videos of friends who had stepped up to the Ice Bucket
Challenge. And within hours of landing, they too had dumped icy waterand uploaded the proof.
We watched together in amazement as, within days, everyone from George W. Bush to Taylor
Swift got soaked in the name of charity.
So fun! So creative! So effective. Why didnt the Multiple Myeloma Research Foundation
(MMRF), the cancer-research organization I started when I was diagnosed with the disease,
think up something like this? my kids asked. I had no answer, only the wish that we had.
So far, the social-media craze has raised a whopping $94.3 million for the ALS Association since
the end of July. Thats up from $2.7 million in the same period last year. And thats just one of
many ALS-focused organizations to have seen such a windfall.
As brilliantly simple as the Ice Bucket Challenge is, its phenomenal success is making many of
us think hard about new ways to raise awareness and dollars.
The efficiency of the campaign, for one, is awe-inspiring. The only overhead the ALS
Association incurred was the cost and staff time of drafting and then sending a single email to
60,000 people in its database. The campaign also demonstrated the power of one or two people
who care passionately about a cause. After all, the Ice Bucket Challenge wasnt started by the
ALS Association or a PR agency but by young people who wanted to support their friend with
ALS.
For me, the biggest takeaway of all is the need to engage a younger generation of potential donors. A recent
report showed that in 2012, 75% of 20-to-35-year-olds had donated to philanthropies the year before, and another
70% were more than willing to ask their friends and relatives to do the same. Millennial enthusiasm can make
things go viral, sometimes massively so. The results speak for themselves (Time)
A prophecy:
The philanthropic blockbuster, which has been ubiquitous on Facebook and lured in hundreds of
celebrities, has sparked millions of donations to ALS research and raised awareness of the disease. But
after a month in the spotlight, the ALS Ice Bucket Challenge isfinallystarting to show signs of cooling

Kannur
The Kannur Unit meeting on 09 September was the Onam special; and the highlight naturally
was the sumptuous feast with all trappings of the festival - complete with a menu that would
have floored any gourmet.
Secretary Er.Ravindran regretted the attendance was slightly disappointing, considering the
organizers efforts. He wished everyone a Happy Onam. President Er.Balakrishnan as usual
referred to national topics - this time the tragedy in Kashmir. Members joined him in paying silent
tribute to the unfortunate people who lost their lives in the floods. He exhorted the members to
take up charitable activities with gusto as in the past.
The forum unit provided a venue to Er Raghavan (Tel: 9446368302) who has written a book in

This young mathematician burned a lot of midnight oil and used a whole bundle of papers to
secure the answer.
After a week, Edison asked him if he had made any calculations and what was the result.
The assistant said, "Yes. It will take some more time to get the answer."
"How long?" Edison asked. "Another week or so."
Picking up pieces of paper with graphs a calculations, Edison then said, "The whole thing can be
done in a minute."
The bright boy asked in disbelief, "How?" Edison calmly filled the bulb with water, and said,
"Now pour the water in a measuring cup and measure."

Finding Happiness
Once a group of 500 people were attending a seminar. Suddenly the speaker stopped and decided to do
a group activity. He started giving each person a balloon. Each person was then asked to write their
name on it using a marker pen. Then all the balloons were collected and put in another room.
The people were then let into that room and asked to find the balloon which had their name written on it
within 5 minutes. Everyone was frantically searching for their name, colliding with each other, pushing
around others and there was utter chaos.
At the end of 5 minutes no one could find their own balloon.
Then, the speaker asked each person to randomly collect a balloon and give it to the person whose
name was written on it. Within minutes everyone had their own balloon.
The speaker then began, "This is happening in our lives. Everyone is frantically looking for happiness all
around, not knowing where it is.

Mangalyaan enters orbit; India Creates History - by Sanjoy Majumder

From early in the morning, there was an atmosphere of excitement and tension at the Indian Space
agencys mission tracking centre in Bangaluru.
Scientists, many of them women and several of them young, were seated in front of the computer
monitors tracking the progress of Mangalyaan.
Giant screens above their heads fed a steady stream of data, graphics and sequence of operations.
The first whoops broke out when Mangalyaan successfully fired up its liquid engine, the first in a
series of critical moves to make sure that the spacecraft was able to get into the planets gravitational
pull.
Then there was an agonizing 20 minutes when Mangalyaan disappeared behind Mars and beyond
contact.
But there was no mistaking the moment, when the scientists all rose as one, cheered, clapped,
hugged each other and exchanged high-fives confirmation that Mangalyaan was now on an
elliptical orbit around Mars.
After PM Modis congratulations, they poured out into the open and bright sunlight, beaming as they
took the adulation.
