That Council approves the final legislation provided by the Ohio Department of Transportation (ODOT) regarding
ODOT contracting for resurfacing work on SR 55 and SR 41 during State FY 2015, and for which the City's
estimated share is to be paid in 2014.
BACKGROUND:
In September of 2014, Council approved new consent legislation for the following ODOT resurfacing project, which
is scheduled for the spring of 2015:
Portion of SR 55 from Franklin Street to Staunton Road, including the Public Square.
A section of SR 41 from the Public Square to Cherry Street.
Troy is required to pay 20% of the project cost prior to the project being bid. When the consent legislation was
approved, the estimate for the project was $377,816.40, with Troy's 20% share coming to $75,563.28. As we noted
at that time, ODOT had expanded the scope of the project. Based on the final legislation, the pre-bid estimate for
the project has increased, with Troy's 20% share now estimated at $124,216. We do note that while Troy would be
responsible for any additional costs should the bids be higher, if the final project cost is less, the City receives a
refund based on that lower cost.
Troy's funding for this project was budgeted for 2014 in the amount of $78,300. However, there is a sufficient fund
balance in the Capital Improvement Fund for the payment to ODOT.
As we have noted with prior ODOT projects, the City benefits from having the roadways resurfaced by ODOT and
paying only a portion of the cost.
ODOT has requested approval of the final legislation and receipt of Troy's estimated share by November 19.
REQUESTED ACTION:
It would be appreciated if you would assign to a Committee of Council approving the final legislation for the above
described resurfacing work, including the payment of Troy's estimated share in the amount of $124,216. Because
of the requested return date, consideration of emergency legislation is requested.

The paving of portions of SR 55 and SR 41 is a project that ODOT is preparing to
bid. The project will include paving a portins of SR 55 at the very west edge of
town, and paving the square, including SR 41 to Cherry Street and SR 55 to
Franklin. They will also pave the portion of SR 55 between the N. Market Street
bridge and Staunton Road. This work is to be completed in the spring of 2015.
Under the Urban Paving program, the City is responsible for 20/o of the cost of
this work. Our portion is estimated at $124,216.00.
The City has previously passed Preliminary Legislation to proceed with this
project and is now ready for the Final Legislation to be adopted. They have
included a packet that includes the legislation as well as payment of the funds to
deposit in an escrow account.
