Kudarat province expressed
desire for his family to run for
governor of Maguindanao
province--to aim higher.

himself among the Christians,
Ilonggos and Ilocanos in the
provinces of South Cotabato
and Sultan Kudarat.
Pax has been known as a
very helpful official and so ap-
proachable. It has been said
that when he helps, he helps
until the problem is solved.

cial aid for former world box-
ing champion Rolando
Navarette when the latter was
in 50-50 in the hospital
after having been

After leaving the LTO, Pax
ran for mayor of Lutayan town
and served for three straight
terms. He transformed the low-
est-class municipality into one
that is first-class. He did this
by harnessing the potentials of
Lake Buluan.
Knowing from Japanese re-
searches that the lake can sup-
port fish for 50 years without
any feeds, he embarked into a
massive tilapia growing and
breeding. In less than a year,
harvests by the tons invited
container vans coming to
Lutayan everyday to buy tila-
pia. This dramatically trans-
formed Lutayan economically.
During his reign as mayor,
he ruled with a heart to all
Muslims and Christians of the
town. It was only during his
time that the town became or-
ganized and where you see
Christians and Muslims living
together as neighbors.
While he was gradu-

Tacurong for the next two elec-
tions.
During his third term as gov-
ernor, his son Teng also won to
become the province’s con-
gressman after serving well as
Lutayan mayor. In 2007 elec-
tions, Pax ran for congressman
and Teng ran for governor. Both
won.
Stirring the hornet’s nest
In March of 2009, Pax ex-
pressed desire for the
Mangudadatu family to run for
governor of Maguindanao. This
stirred the hornet’s nest.
Since that announcement,
the friendly relations between
the Mangudadatu family and
the Ampatuan clan turned sour.

‘Nuisance’ rule is stupid
SHOCKINGLY, the Comelec

Why Philippine society is chronically chaotic?

The Basic Problem
TO analyze the problem, we
need to find a simple basic
cause. The simple cause is
that there are two distinct
groups of Philippine Society:
the rich and powerful, and,
the other, the very poor and
weak.
Whether it be in Muslim
or Christian, the same classi-
fication exists: Rich and Poor.
The rich is often the origi-
nator of chaos because they
own the power. The poor is
almost nothing and they
cannot afford to start a war
because they own nothing.
The poor are just like gentle
lambs and the rich are just
like wolves guarding the
poor.
Often times, conflict arise
between a rich and powerful
group and another rich and
powerful clan because of
politics, courtship, business,
land, and the coffers in gov-
ernment positions that pro-
vide billions of pesos for the
taking.
They are determined to
fight each other, even to the
point of killing opponents.
The most recent example is
the massacre in Ampatuan,
Maguindanao. It also hap-
pened in not so distant past
in other regions, although in
smaller scale: in the Ilocos,
Visayas, Cordelierra, Central
Luzon, Bicol, etc.
And what do these rich
and powerful do to win their
wars? They exploit and em-
ploy the poor to fight each
other.
How did the rich and
power public officials do that
to foment the conflict be-
tween the rich and poor?
Read Executive Order 546.
This order issued by
Gloria Arroyo authorized the
rich and powerful to employ
poor civilians to arm them to
kill people against each other.
Is it any wonder that the
Maguindanao Massacre
happened? Who then suf-
fer most? Of course, the poor
Muslims who are often dis-
placed and had to evacuate
their homes because of the
war not of their own making.
The Basic Solution
The fundamental solu-
tion is to unite the poor and
weak to fight the rich and
powerful with the numbers
game.
Let the poor know they
are numerous than the rich
and they have that power
under the constitution to

What is that Basic Solution?
The poor should create
the Jury System, which con-
sists of the Grand Jury and
Trial Jury.
To avoid conflict of inter-
est in employing the jury
system, the membership of
the juries shall be limited to
the common and poor people
in the private sector.
Jury membership shall ex-
clude the rich and powerful
such as powerful public offi-
cials and persons who claim
nobility or royalty.
When the common and
poor people operate the
Grand Jury, they really could
care less whether the object
of their investigation and in-
dictment for criminal acts is
a powerful official because
the employment and liveli-
hood of the common and
poor people with their pri-
vate employers cannot be
sabotaged by a powerful
public official.
When the common and
poor sit as jurors in a Trial
Jury, they can also care less
if they will convict a rich
crime offender because their
livelihood and jobs are not
reachable by a powerful
public official.
When the common and
poor people troop to their
courts five days a week, 52
weeks a year, all around the
country, and sit together in
their halls of justice to con-
front the corrupt rich and
powerful regardless of the
religion, color, education,
gender, or wealth to uphold
the majesty of their laws, that
indeed is unity in action by
the common and poor people.
Is It Doable for the People
to Serve in Juries?
Yes, indeed. The Jury
System has been tried and
tested for use of the poor and
common people in the
United States for over 221
years ago when the Ameri-
can people at that time did
not have yet the kind of edu-
cational facilities that the Fili-
pino People have today.
The Americans had no
cellphones or the email sys-
tem or the Internet WWW.
The American people
were even more legally igno-
rant then than the Filipino
people of today.
So, what is the problem
for the Filipinos to serve in
juries today? They are not
as moron as the Americans

Another Road Scandal
Daang Hari traverses 23 Villar’s subdivisions

ULL information about
all candidates are neces
sary to educate the vot-
ers in order for them to know
intelligently who to vote in the
May 2010 elections.
Much more the information
becomes important when certan
pieces of information pertain to
candidates running for presi-
dent, the highest post in the
land, because it is the perfor-
mance of the president that de-
termines whether the country
will succeed or fail in the next
presidential term of six (6) years.
This time, we have very im-
portant pieces of information
regarding the performance of the
past of one presidential candi-
date, Senator Manny Villar,
who everybody must scrutinize
and decide whether he deserves
the votes.
Remember that once you
cast your vote on May 10, 2010
you cannot take it back. You
will suffer for another six years
if the person you chose would
turn out to be a big mistake.
We should not repeat the
mistakes we committed when
many amongst us supported
Gloria Arroyo during Edsa 2 in
order for her to rise to the presi-
dency in lieu of Joseph
Estrada, who now proved to
be a lesser evil.
We have seen many candi-
dates presenting platforms and
claiming they can do it.
But how many times have
we voted for candidates on the
basis of platforms?
And if we voted on plat-
forms, how many times have
we seen these platforms forgot-
ten?
In the Philippine election
history, it is as rare as looking
for a needle in the sea for us to
see a platform being imple-
mented.
This being the case, will we
still vote on the bases of plat-
forms?
Additionally, we have seen
so many candidates presenting
they are intelligent.
We have voted for bright can-
didates in many times.
But look at what the
intelligents have done?
Most of these bright minds
graduated from elite schools in
the Philippines or Ivy League
schools in the United States of
America like Harvard or
Stanford or Yale or Georgetown
where Gloria was a classmate
of former US President Bill
Clinton.
We have seen and experi-
enced how we suffered under
the long presidency of
Ferdinand Marcos, the No. 1 in
Bar Examination after graduat-
ing from the University of the
Philippines, the same school
where Bar Topnotcher Gibo
Teodoro and Senator Manny
Villar came from.
We have seen how bright
boys and girls at the Malacañang
and their allies have played
around contracts and laws to
result in the loss of money from
the coffers or in big commis-
sions from contracts.
Will we still vote for bright
minds to lead us?
We have also seen experi-
enced men and women like
Estrada, Ramos, Gloria and
Marcos governing our country.
But what have we gotten
from them?
More debts, more rights
abuses and more corruption.
We have also been presented
with candidates who claim them-
selves as rich men and women
that they argued we should vote
for them because of their al-
ready being moneyed they
would no longer steal money.
Yet this argument often flew
in our faces when we elected
them.
They became richer.
We have seen a mechanic
Ramon Magsaysay Sr. as presi-
dent and we all cried when he
died on a plane crash in Cebu.
We have seen Cory Aquino,
a housewife graduate of AB
Mathematics, become presi-
dent and we saw her having not
stolen any centavo and saw her
refusing another term of office
to give way to others.
Almost all of us cried when
she died.
Of all candidates presenting
now to become the next presi-
dent of our country, it is Sena-
tor Villar who is the most im-
passioned.
Villar was even reported to
have spent more than Two Bil-
lion Pesos even before he filed
his certificate of candidacy.
Villar was reported by
Forbes magazine as the No. 9
richest Filipino.
Do you think Villar will not
get back what he spent?
And if Villar has this much
money, why will he still run for
president and not stay rich and
quiet like Lucio Tan, Henry Sy,
John Gokongwei, Andrew Tan,
Jaime Zobel and the rest of the
billionaires?

There is also a question:
How did Villar become very rich
when he claimed he rose from
being a fish or shrimp vendor?
Is it really possible? How come
that he has even overtaken the
Lopezes who are in the bottom
of Top 20 richest Filipinos?
What did Villar do? Will the
business acumen, assuming he
is good at business, of Villar do
good to our country? Did Villar
conduct his business fair and
square?
Then why was it discovered
that during his time as the Sen-
ate President the C-5 extension
road going through his subdivi-
sions were funded twice for the
price of one?
Villar claimed there were ac-
tually two roads, an argument
that has not seen force or vigor.
Later, Villar was enmeshed
in another road scandal.
This time, it is the Daang
Hari Scandal, pertaining to a long
eight-lane road from Laguna to
Cavite, passing through
Muntinlupa, Las Piñas and
Bacoor in Cavite.
When he was asked by Ted
Failon of ABS-CBN, Villar said
the right-of-way there was not
yet paid.
But his spokesman, Gilbert
Remulla, told Failon that the is-
sued should be the right-of-way
and it was donated for free to
the government.
So who is telling the truth:
Villar or Gilbert Remulla?
Villar also said that he did
not own any subdivisions where
the controversial Daang Hari
road pass through.
But a count by Ted Failon
shows Villar companies own
23—to repeat, Twenty Three—
subdivisions through which the
Daang Hari Road pass through
in a circuitous route instead of a
straight-line road.
Atty. Ernesto Francisco, the
lawyer who prosecutes Villar for
double funding of the C-5 road,
insisted that an investigation
should also be done on how
many times funds were devoted
to Daang Hari Road.

‘Nuisance’ rule is stupid

have no voice or will as to
who should lead them. This
right is indispensable for what
are leaders for when the
people do not follow them?
This is expressed in Ar-
ticle V of the Constitution,
which reads:
“Section 1. Suffrage may
be exercised by all citizens of
the Philippines not otherwise
disqualified by law, who are
at least eighteen years of age,
and who shall have resided in
the Philippines for at least
one year, and in the place
wherein they propose to
vote, for at least six months
immediately preceding the
election. No literacy, prop-
erty, or other substantive re-
quirement shall be imposed
on the exercise of suffrage.
“Section 2. The Congress
shall provide a system for se-
curing the secrecy and sanc-
tity of the ballot as well as a
system for absentee voting by
qualified Filipinos abroad.
“The Congress shall also
design a procedure for the dis-
abled and the illiterates to
vote without the assistance
of other persons. Until then,
they shall be allowed to vote
under existing laws and such
rules as the Commission on
Elections may promulgate to
protect the secrecy of the
ballot.”
To restate, the general rule
is that each person has that
sacred right to run for a pub-
lic office, including the Of-
fice of the President.
The exceptions are those
who do not qualify on resi-
dency requirement and those
disqualified by law.
In other words, as to the
disqualification it is only a
law that can set and not rules
or regulations promulgated
by the Commission on Elec-
tions.
On top of this, there is a
higher law, a Constitutional
provision that provides for
qualifications for the posi-

Witnesses said it took 30
minutes to reach the area from
the highway although it is only
2.5 kilometers from the high-
way checkpoint where the vic-
tims were abducted.
Witnesses saw a heavy-
duty backhoe at the site and
there were three open dump,
which turned out later to be the
mass graves for the massacre
victims and their vehicles.
About 11:00 a.m.
Nevertheless, the claim of
Toto that his wife called him to
tell that she was slapped by
Andal Jr. jibed with the stories
of other witnesses.
The escapees from the con-
voy helped convince the Phil-
ippine Army to send foot sol-
diers to search for the convoy.
About noon
It was also reported that 25-
tions of president and vice-

are in effect disqualifications if
the qualifications are not met.
Looking at what is the law
that provides for disqualifica-
tions, there is this Omnibus
Election Code that states in its
Section 69 as amended by Sec-
tion 5 of RA 6646.
Section 69 states: “Nui-
sance candidates. – The Com-
mission may, motu proprio or
upon a verified petition of an
interested party, refuse to give
due course to or cancel a cer-
tificate of candidacy if it is
shown that said certificate has
been filed to put the election
process in mockery or disre-
pute or to cause confusion
among the voters by the
similarity of the names of the
registered candidates or by
other circumstances or acts
which clearly demonstrate that
the candidate has no bona
fide intention to run for the
office for which the certificate
of candidacy has been filed and
thus prevent a faithful de-
termination of the true will
of the electorate.”
The limitations provided by
the Constitution are found in
Sections 2 and 3 of Article VII
of the 1987 Constitution of the
Republic of the Philippines,
which reads:
“Sec. 2. No person may be
elected President unless he is a
natural-born citizen of the Phil-
ippines, a registered voter, able
to read and write, at least forty
years of age on the day of the
election, and a resident of the
Philippines for at least ten
years immediately preceding
such election.
“Sec. 3. There shall be a
Vice-President who shall have
the same qualifications and
term of office and be elected
with and in the same manner as
the President. xxx xxx xxx.”
Other than these, there are
no other limitations available
as to suffrage in the matter of
the exercise of the right to be
year-old Noel Decena of the
Koronadal-based weekly,
Periodico Ini, who was among
those massacred managed to
send a text message to his
brother, Joseph Decena, who
was then in Midsayap.
The message read: “Lab, i-
ampo ko diri kay naa na mi
diri sa Ampatuan. I-pray mo
kami dito. Kritikal amo
sitwasyon diri. (Lab, we’re here
already at Ampatuan. Pray for
us here. Our situation is criti-
cal).”
This means that by this
time, it was possible that the
massacre had not yet occurred.
Just minutes before
Decena’s text message, one of
the two lady lawyers killed
there, Atty. Cynthia Oquendo,
also managed to send a text
message to officemates, telling
they were kidnapped by
Ampatuan, that the armed men
were firing and that they might
be the next victims.
Andal Jr. started the fire
While already at the massa-
cre site, allies-turned-wit-
voted upon for the positions
of President and Vice-Presi-
dent.
Constitutional
qualifications
are all met
Presidential Candidate
Velasquez and Vice-Presiden-
tial Candidate Paglicawan pos-
sess, like jury advocates’ sena-
torial bet Rudy Dianalan rep-
resenting the overseas Filipino
workers, General Lim and Gen-
eral Palparan, all the qualifica-
tions required by the Consti-
tution and they all do not have
the disqualification as to age or
residency.
All of them are natural-born
citizens and at least 40 years
old for the President and Vice-
President and 35 years old for
Senators. All of them are liter-
ates and in fact educated. Presi-
dential Candidate Velasquez is
a graduate of the University of
the Philippines College of Law
in 1971. Vice Presidential Can-
didate Paglicawan is a graduate
of Bachelor of Science in Civil
Engineering from the Univer-
sity of the East. Both of them
have served the government in
appointive capacities.
No evidence their
candidacies will put the
election process in
mockery or disrepute
As to the disqualifications
of the law, it is also very clear
that Presidential Candidate
Velasquez and Vice-Presiden-
tial Candidate Paglicawan, as
well as Senatorial Candidate
Rudy Dianalan, do not possess
the characters or disabilities or
bad records in the past for them
to be classified as ones whose
candidacies will “put the elec-
tion process in mockery or dis-
repute.”
There is also no evidence to
show that the candidacies of
Velasquez, Paglicawan and
Dianalan, as well as Generals
nesses said that Andal Jr. sepa-
rated the women from the men.
Thereafter, the men were
seen begging for their lives.
Armed with the M16 rifle
with mounted M203, wit-
nesses said that Andal Jr.
opened fire at the male group,
killing them instantly.
But his M16 jammed later.
At that point, witnesses said
Andal Jr. took a K3 rifle, a Ko-
rean-made machine gun, to fin-
ish off the job.
It was also said that aside
from Andal Jr., other
Ampatuans also opened fire at
the victims.
The women were said to
have been killed later. The fact
that they were finished off later
gave a possible time for the rape
to have occurred. Actually, fo-
rensic experts reported that
traces of semen were found in
at least five women victims.
In the testimonies of a child
assassin who admitted to have
killed more than 100 persons
all upon the orders of the
Ampatuans, particularly
ARMM Gov. Zaldy, revealed
that Datu Unsay or Andal Jr.
Lim and Palparan, will put the
election process in mockery or
disrepute. As such alone, there
is no justification to consider
them nuisance candidates.
In filling up the standard
form of certificates of candida-
cies, Velasquez and Paglica-
wan—as in the cases of Dia-
nalan, Lim, Palparan all other
candidates—were not asked to
write thereon how they would
conduct their campaigns, were
not asked to write down how
much money do they have for
the campaign, or were not
asked how many supporters
do they have.
The only information that
has relevance may be that one
they wrote that they are “in-
dependents.” But even then,
this fact is not an indication at
all that they would put the elec-
tion process in mockery or dis-
repute.
The Comelec approved the
candidacy of Senator Jamby
Madrigal as an independent,
justifying her past records as
having run and won under the
opposition ticket in the 2004
elections.
Clearly, the Comelec took
judicial notice of Jamby’s past
records. Had it only taken ju-
dicial notice of the past records
of Velasquez, Paglicawan,
Dianalan and Lim, it could have
known that they have no
records of cheating in any elec-
tion, that they have no record
of having been charged with
any election-related crimes.
Velasquez and Paglicawan
are not likely to cause
election in mockery
or disrepute
Actually, it cannot even be
fathomed how one candidate
can put the election process in
mockery or disrepute other
than employing schemes to
defraud the electoral process in
contemptuous manner, like
buying of votes, tampering
with election returns similar to
has the habit of snatching
somebody’s wife in front of the
husband. Those husbands who
resisted were killed instantly.
This child assassin added
that when the Ampatuans were
giving orders, anybody who
asked a question was killed
right away.
This child assassin revealed
that in all the jobs tasked for
him he never asked questions.
A witness who is close to
Andal Jr. said that he system-
atically killed the hostages,
shooting them at close range
with rapid fires.
The killers dumped the
bodies and vehicles into the
mass graves and covered the
site using the backhoe.
The killings and subsequent
burials took just over an hour,
according to the witness inter-
viewed on Al Jazeera, a news
organization based in the
Middle East.
This witness claimed he
was also ordered to kill.
About 3:00 p.m.

the Hello Garci scandal, em-
ploying terrorism to win votes
or disenfranchise voters, and
whatever other dirty tricks.
We have a common ground.
Election processes cannot be
said to have been made a mock-
ery or placed in disrepute if
there is no cause that would
prevent the conduct of honest
and clean elections.
Some indicators of clean and
honest elections are when it can
be said that the winners are in
truth the winners, that not one
vote was not counted, that the
results reflect the true will of
the voters, and that the people
do not doubt the results—un-
like the extreme shame that was
caused by Hello Garci scandal
in the 2004 elections and by
the Maguindanao 12-0 votes
for administration senatorial
candidates in 2007, which all
rooted from money.
If we have these as pre-
mises, it cannot now be imag-
ined how candidates who are
independents can manipulate
electoral processes to put it in
shame; how these kinds of can-
didates who have no excess
money to pay for buying votes
to put the election in disrepute;
or how these kinds of candi-
dates can terrorize to put the
electoral process in contempt
to the whole world.
Candidates Velasquez and
Paglicawan have credibility and
integrity to say they cannot be
a potential cause for making the
electoral process a mockery or
bring it to disrepute.
This is because their re-
sources are just enough for
their national campaign and
they do not have excess funds
to budget for buying votes;
they have no money to hire as
many watchers or as many
political campaigners as can be
done as disguised ways of buy-
ing votes; they do not have
money to hire goons to terror-
ize voters like the Ampatuans
Jazeera witness, Andal Jr. re-
ceived a call warning them of
approaching Army soldiers.
With this, the killers hur-
riedly fled the scene just be-
fore Army soldiers arrived,
leaving two dozens of unbur-
ied victims, their vehicles and
the backhoe used to dig the
graves and burry the victims.
It was said that while the
Army troops were still about
one kilometer from the crime
scene, they heard the backhoe’s
engine roar and saw the engine
smoke.
When they reached the site,
not one killer was found.
On their way to the massa-
cre site, the Army soldiers in-
tercepted two men armed with
an M16 rifle and a Gauge 12
shotgun. This was according to
lead investigator PNP Chief
Supt Felecisimo Khu Jr.
But jurisdiction issues
made the Army decide to turn
over the two armed men to gov-
ernment authorities who sub-
sequently released them.
The two, identified as
Esmail Canapia and Takpan
Dilon, later admitted to have

in Maguindanao.
To the contrary, it cannot
be understood why the Com-
mission on Elections have re-
quired since time immemorial
that the candidates for na-
tional positions should be
able to have the capacity to
mount a national campaign
and for this requirement to
be complied with it has gone
by the parochial thinking that
one must have a political
party or money if he or she is
an independent.
It has been proven since
time immemorial that those
who give shame to the elec-
toral processes are those who
have political parties and ma-
chineries, those who have
money to buy votes and hire
guns and goons to ensure vic-
tories, or those who have ex-
cess funds to pay for opera-
tors of dagdag-bawas.
Yet the Comelec has not
learned.
Instead, it has been per-
petuating these fraudulent
acts by requiring money and
party from candidates, sub-
tly labeled as “capacity to
mount a campaign.”
These acts have
undisputedly brought not
only the election process in
total disrepute but most im-
portantly the country in dis-
respect in the eyes of the in-
ternational community.
These acts undisputedly have
promoted corruption in the
country to the point of no
return.
It seems that the Comelec
has not learned that no
amount of money can buy
honor for our country and
people after this has been lost
by cheating, the biggest of
which is the Hello Garci
scandal and the 12-0 scam in
Maguindanao province,
which all rooted from money.

that happened recently.
Krista and her aunt Suzette
were being accused by Kapuso
star Bianca King as the one who
took her belongings out of a tent
while on a location shoot of a
movie.
The main cast members
were provided with one tent
each. Bianca’s tent become
overcrowded so she decided to
transfer to another tent occu-
pied by Krista, her co-villain-
ess in the movie “Wapakman.”
It was also learned that she
asked for the approval of their
producer, Wilson Tieng, to
transfer to the said tent and was
complacent enough because
they have the same manager,
Mr. Arnold Vegafria.
She explained in an inter-
view that “after a few minutes,

Bianca did not tell anybody
about the incident until it was
published on the web, she just
cried quietly and kept things
for herself just for the sake of
the last day of shooting of the
film that is an official entry to
the upcoming Metro Manila
Film Festival. Bianca also knew
that the issue would affect the
shooting of the movie.
The movie served as their
first time together. They were
together before in a TV show
as guests and in fact, she al-
ready experienced sharing with
Krista a tent when they were
in a “racket” out of town. That
is why she was shocked by the
incident.
However, Bianca wanted
the issue to be closed. Their
manager called for a meeting
where Bianca and Krista
threshed out the issue.

‘Nuisance’ rule is stupid

moting corruption and disre-
pute of electoral processes in-
stead of clean and honest elec-
tions, which goal can logically
be best achieved if the candi-
dates who will be allowed to
run are only those who are
poor.
To the contrary, there is no
law that sets a standard or yard-
stick as to how effective the
campaign should be. And if it
is so, independent candidates
like Velasquez, Paglicawan,
Dianalan, Lim and Palparan can
indeed mount a national or in-
ternational campaign by utiliz-
ing free services of
FACEBOOK, FRIENDSTER,
TWITTER, GOOGLE, YA-
HOO, NING, YOUTUBE,
MULTIPLY and many other
Internet sites?
Has not the Comelec taken

ered six others along with three
vehicles, crushed by the back-
hoe before being buried: the

which they filed for.

wan, Dianalan, Lim and Palpa-
ran expressly declare they have
that genuine or bona fide inten-
tion not only to run for but to
win the offices for which they
run for, what contrary evidence
the Comelec could have pre-
sented?
Is it not that the Comelec
has the burden of proof to
show otherwise?
Actually, by looking alone
at the certificates of candida-
cies, the Comelec has no fac-
tual basis to say one candidate
has no bona fide intention to
run.
This is so because there is
no question there in the certifi-
cate that asks a candidate to
declare his intention.
To the contrary, there is an
oath of allegiance that requires
the candidate to pledge loyalty
to the flag and country and to
defend the laws and the consti-
tution of the Philippines.
Bona fide intention
to run for President
and Vice-President
To the contrary, Velasquez
and Paglicawan, as well as
Dianalan, do not have only a
bona fide intention to run for
President, Vice-President and
Senator, respectively.
In fact, they have the
NOBLE intention to run for
these positions.
The intention of the two is
to realize their platform of
changing the fiscal-judge system
of justice into one where it is
the people who decide who
should be charged in court, tried,
and convicted or acquitted.
These two candidates have
no formal political organiza-
tions but they have enough
supporters from the Philip-
pines and the Filipinos in the
rest of the world who advocate
the people’s justice system
called Jury Systems.
Velasquez, Paglicawan and
Dianalan are resolved in the idea
that everything begins from the

decade and no one among them

judge system has completely
failed to work in that area. No
less than the Department of
Justice announced that the
prosecutors in Maguindanao
province have been afraid to
prosecute the Ampatuans such
that prosecutors of the DOJ
are the ones tasked to perform
preliminary investigations and
inquest proceedings.
Velasquez, Paglicawan and
Dianalan firmly believe that
there is no other solution to the
problem of the country but to
make rule of law reign.
And for them, there is no
other way to compel all citi-
zens to adhere to the rule of
law but faithful implementa-
tion of laws.
To ensure faithful imple-
mentation of laws, the two
firmly believe that there is no
other way but to ensure that
no crime goes unpunished.
And if the country is as-
sured that no crime goes un-
punished it brings natural de-
terrence to potential crime-do-
ers, including the corrupt, the
greedy, the arrogant and those
who think themselves as lords.
Only when what reigns is
the force of law—not the law
of force—that the Philippines
can be assured of peace and
prosperity. And there is the
reign of the force of law when
all laws against corruption,
against all forms of discrimina-
tions, against all forms of crimes
are assured of implementation
no matter who gets hurt.
So that should Velasquez,
Paglicawan and Dianalan be
elected, they will work—come
hell or high water—for the sub-
mission to the people in a plebi-
scite of a question whether to
make it as a fundamental hu-
ippines as the world’s worst
place for the journalist, accord-
ing to Committee to Protect
Journalists (CPJ).
The weapons used and
the manner of killing
According to the investiga-
tors, at least six different M16
rifles were used in shooting but
not necessarily used to kill.
Khu said that this is based

And when this dream of the
two is realized, they believe
that the plenty of laws the
country has now will all be
implemented. And when all
these laws are assured of imple-
mentation, progress and peace
for the country follows as a
natural consequence.
No other candidate for
President or Vice-President or
Senator has this simple but
substantive platform of gov-
ernment.
And with this fact of the
nobility of their platform, can
it still be said that Velasquez,
Paglicawan and Dianalan have
no bona fide intention to run
for the positions to which they
filed their certificates of candi-
dacies?
It is submitted their good
intention is overflowing.
Now, intention can be mani-
fested by the acts.
And on the part of Velas-
quez, Paglicawan and Dianalan,
they are in fact supported by
tens of thousands of overseas
Filipinos who learned the
beauty of Jury Systems in
America, Europe, Australia and
the rest of the world, including
those members of Worldwide
Filipino Alliance (WFA),
Partidong Pandaigdigang Pili-
pino (PPP), Overseas Filipino
Council International (OFCI),
Philippine Jury International,
PhilJury, Juryism Campaign
NetBook, and many others.
Their intention to run for
these offices are seen by their
rabid campaign to educate the
Filipinos that the lasting solu-
tion to rebellions in the Philip-
pines is the jury system, be-
cause it assures full implemen-
tation of laws to stop discrimi-
nations and abuses by the rich
against the poor and by some
Christians against the Muslims.
Under the jury systems
that Velasquez, Paglicawan and
Dianalan vowed to implement,
there will be a Grand Jury com-
posed of a group of people cho-
sen by raffle from the voters’
list to exercise the powers to
say who should be charged in
court, to jail by contempt wit-
nesses until they agree to tes-
tify, to jail by contempt the law
enforcers until they agree to
investigate, and to order bat-
talions of army to augment the
police in arresting suspects as
powerful as the Ampatuans.
The faces and names of the
members of the Grand Jury
shall be kept secret to give no
opportunity for the crime do-
ers to threaten or buy the
“people’s fiscal.”
Under the jury systems
that they are fighting for, there
will be a Trial Jury whose
members shall be chosen by
raffle from the voters’ list and
will be tasked with the duty to
try and decide on the factual
issues in every trial. They shall
be guided by the judge as the
presiding officer and as the one
who will give them instructions
as to what law applies on their
findings of facts.
To promote their candida-
cies, Velasquez, Paglicawan and
Dianalan have actually started
their campaign for their plat-

form more than two months
before filing their certificates of
candidacies. Early on, they
have collaborated with the set-
ting up of a website dedicated
to the cause of jury idea, and
this website is http://
philjury.ning.com.
They have also joined many
yahoogroups and googlegroups
to promote the educational
campaign on what is a jury sys-
tem, why it is the best justice
system in the world and why
Filipinos are prepared to adopt
the system because the Ameri-
cans of 221 years ago when the
jury system was founded in the
USA cannot be more intelligent
than the Filipinos of today.
Velasquez, Paglicawan and
Dianalan have been setting up
websites for their campaign.
This is another clear proof that
they have that intention to go
for their bid to become Presi-
dent and Vice-President. Among
these websites are http://jury-
party.ning.com, http://jury-
party.multiply.com and http://
www.facebook.com/pages/
Jury-Party-of-the-Philippines.
To reiterate what has been
argued above, there is no law
that sets a minimum standard
as to how effective the national
campaign should be. And yet,
with Facebook alone,
Velasquez, Paglicawan and
Dianalan can mount a na-
tional—and even interna-
tional—campaign to prosecute
their bids to the highest posi-
tions of the land. How much
more if they would go full blast
with all other available
websites?
With this nobility and do-
ability of their platforms
coupled with the fact that they
have actually prosecuted acts
for the furtherance of their
campaigns and the hard and
brutal fact that they can actu-
ally mount a national campaign,
it cannot now be said that
Velasquez, Paglicawan and
Dianalan have no bona fide or
good faith intention to run for
President, Vice-President and
Senator.
Still have rooms for
practicality for purpose
of holding elections
As against these substan-
tive and fundamental rights of
Velasquez, Paglicawan and
Dianalan and their supporters
who have vowed to vote and
campaign for them, coupled
with the fact that they can ac-
tually mount a national and in-
ternational campaign, there is
no place to deny their right of
suffrage by reason alone of un-
founded fears about the practi-
cal problems that may arise by
reason of the fact that the
Comelec would conduct elec-
tions under automated system.
It is submitted that the
Comelec’s practical consider-
ations on automated poll sys-
tems can still accommodate
Velasquez, Paglicawan and
Dianalan a room for one more.
That is if only to give mean-
ing to the noble platform of
government they carry, to
honor their genuine intention
to run and campaign for the
office they are bidding for, and
to give a chance for the realiza-
tion of the dreams of the over-
a-million advocates for the es-
tablishment of a jury system
in the Philippines.

pino athletes came up with a
laudable performance in ma-
jor playing fields where new
records were set, something
that he said augurs well in
an ambitious buildup for the
2010 Asian Games.
As Team Philippines
heads back home, the ath-
letes is bringing forth 38 gold
medals at the close of this
11-nation, 10-day games.
“Overall, it is still a good
performance,” said chairman
Angping, several days be-
fore the curtains fall in
Vientiane. “There were close
calls and claims that we
should have been awarded
more gold medals but that’s
all part of the game,” he
added.
The Philippines finished
fifth with a 38-35-51 (gold-sil-
ver-bronze) output while
Malaysia had 40-40-59 for
fourth.
Thailand completed its
domination with 86-83-97,
edging Vietnam (83-75-57) for
the overall championship in
the biennial event. Indone-
sia was a distant third with
43-53-74.
Of the 22 sports repre-
sented here, the Philippines
won gold medals in 14 while
eight were either medal-less

chances on the horizon for
