LEAVE AND LICENCE AGREEMENT

THIS LEAVE AND LICENCE AGREEMENT is made and enter into at Navi
Mumbai, on this__________ day of _____________. BETWEEN MR./MRS.
__________________________________________ an adult, Indian Inhabitant,
Residing at___________________________________________________________
________________________________, hereinafter for brevitys sake called the
OWNER/LICENSOR (Which expression shall unless repugnant to the context or
meaning thereof shall include his heirs, executors and administrators, Legal
representatives and assigns) of the party of the FIRST PART.
AND
MR./MRS. _________________________________________, an adult, Indian
Inhabitant residing at __________________________________________________
______________________________________ hereinafter for brevitys sake called
the LICENSEE (Which expression shall unless repugnant to the context or meaning
thereof shall include her heirs, executors and administrators, Legal representatives and
assigns) of the party of the SECOND PART.
WHEREAS THE PARTY OF THE FIRST PART is the absolute owner owns and
enjoy the ownership right of ______________________________________________
____________________________ (hereinafter for the sake of brevity it is be referred
to as the SAID FLAT/SHOP PREMISES) and the party of the FIRST PART is
having right, title and interest of the said Flat / Shop premises.
AND WHEREAS THE LICENSEE has approached the Owner and requested him
to allot the said FLAT / SHOP PREMISES on LEAVE AND LICENSEE BASIS for a
period of ________________ commencing from ______________ to
______________ on mutually agreed terms and conditions are as under :
NOW THIS DED WITNESSTH AS FOLLOWS :
1.

THE OWNER / LICENSOR have given the said SHOP premises to the
LICENSEE for business purpose only for _____________ and after
completion of _____________, the LICENSEE shall handover the peaceful
and complete possession on of the said SHOP PREMISES to the Licensor /
Owner.

2.

THE LICENSEE hereby agree to pay the monthly compensation of


Rs. ____________ /- (Rupees in words _______________________________
_____________________) on or before the _______ day of every succeeding
months. As and by way of assurance to the LICENSOR for the due and proper
performance of all its obligations (Whether mentioned herein and / or not)
including vacating the LICENSED PREMISES on the expiry of the Leave and

License Agreement (in addition to the payment of the License fees and all
other amounts as mentioned herein and as may be intimated hereafter) the
LICENSEE has before the License commencement date Deposited with the
LICENSOR a refundable adjustable non-interest bearing Security Deposit of
Rs. ________________/- (Rupees in words __________________________
___________________________only) with the no interest bearing adjustable
Security Deposit shall retained by the LICENSOR until the time this LEAVE
AND LICENSE is valid / till the end of the LICENSED PERIOD and shall be
refundable by the LICENSOR to the LICENSEE, simultaneously against the
LICENSEE handing over the vacant charge of the LICENSED PREMISES
back to the LICENSOR in good and tenantable condition.
3.

THE LICENSEE hereby also agree to pay the electric charges and water
charges, for the said Flat/Shop premises of the Licensor / Owner and if any
damage of loss is caused to the same and/or bills are not paid and any
expenses is incurred in said regard same shall be deducted from the security
deposit by LICENSOR / OWNER and LICENSEE agree to the same.

4.

THIS AGREEMENT is valid from ____________ to __________ on the


expiration of the period, LICENSEE shall be automatically revoked and
LICENSEE will hand over the peaceful possession of the said FLAT/SHOP to
the LICENSOR/OWNER.

5.

THE LICENSEE shall not at any time claim any right of tenancy or subtenancy in respect of the above said FLAT/SHOP PREMISE. The LICENSEE
or his legal heirs representatives shall have occupation of the said
FLAT/SHOP premises only during the stipulated and mentioned period and
thereafter they shall be trespasser to the FLAT / SHOP PREMISES.

6.

THE LICENSEE shall keep the said FLAT / SHOP PREMISES for his own
business purpose only and not for any purpose whatsoever.

7.

THE LICENSEE shall not allow anybody else to use the said FLAT/SHOP
PREMISES and/or any part thereof.

8.

THE LICENSEE shall be liable to use the LICENSEED PREMISES with


due care and diligently and to duly and regularly maintain the LICENSED
PREMISES in just and proper manner. The LICENSEE shall be responsible
for all willful or negligent, etc. caused to the LICENSED PREMISES by
LICENSEE & shall indemnify & keep indemnified the LICENSOR of the
same and every part thereof at their sole risk and costs.

9.

That the LICENSEE shall have not caused any nuisance or annoyance to the
LICENSOR / OWNER of the occupants, tenants or members of the neighbors.

10.

THE LICENSEE shall not make or allow to be made any structural or


permanent addition, verifications or annoyance to the LICENSOR / OWNER
of the occupants, tenants neighbors and alter at ons in the said FLAT/SHOP
premises or any part thereof without obtaining in advance consent in writing
of the LICENSOR / OWNER.

11.

Either of the FIRST PARTY i.e. LICENSOR / OWNER shall be entitled to


the said terminate this Agreement with One month notice to other party.

12.

THE LICNSEE shall observe all the rules and regulations and bye-laws to the
user of the said FLAT/SHOP PREMISE in premises in particulars and the
building in general.

13.

THE LICENSOR / OWNER shall not pay the refund of the above said rent /
compensation if the LICENSEE shall terminate this Agreement.

14.

In the event of the LICENSEE :a.

Committing breach of any the terms and conditions of this Agreement


or

b.

Going into Voluntary or Compulsory liquidations-or

c.

In any way jeopardizing the rights, title and interest of the Licensor /
Owner in respect of the said Flat/Shop premises.

15.

THE LICENSOR/OWNER shall be entitled to terminate this Agreement


forthwith. In such an event, the LICENSEE shall forthwith vacant the said
FLAT/ SHOP PREMISES and deliver vacant possession of the said
FLAT/SHOP PREMISES to the Owner/Licensor.

16.

The parties hereto voluntarily agree to the terms and conditions contained
herewith any each of them fully understands the implication of each every
causes hereinabove contained

AND IN WITNESS WHEREOF the parties hereto have hereunto set and
subscribed their respective hands the day and year first hereinabove written.
