Will of Richard Davenport # 1231

Note: The East ½ of Lot 7, Con 1, in Sophiasburgh was willed


to Richard’s 3 daughters only after the death of his wife,
Christiana. According to the abstracts of Sophiasburgh (FHL
film 198182 Abstract Index Books), this property was
transferred to Peter Van Horn by Nicholas Lazier and others
on 11 Nov 1840, and registered 9 April 1842, so I am
thinking that Christina (or Christian as it is spelled in
Richards will) died about 1840.

Will:
Folio 85:
To the Register of the County of Prince Edward in the
Midland District.

A memorial of a will Dated the Fifteenth Day of February in


the year of our Lord One Thousand Eight Hundred and
Twenty Seven, made by Richard Davenport of the Township
of Sophiasburgh yeoman, which Will is in the words following
viz: In the name of God Amen, I Richard Davenport of the
Township of Sophiasburgh in the Midland District and
Province of Upper Canada Yeoman, cosidering [sic] the
uncertainty of this mortal life and being of Soud [sic] mind
and memory Do make and Publish this my last will and
testament in manner and form following that is to Say First it
is my Will and I do order that all my just debts Shall be paid
out of my Personal property by my Executors so soon as
convenient after my Decease; I do will and Devise to my Son
William Davenport and his heirs and assigns the farm he now
lives on with the appurtenances being the (blank) half of Lot
number Eight in the First Concession of the Township of
Sophiasburgh west of Green Point. I do also Give and Devise
to my son Richard Davenport and his heirs and assigns the
farm I now live on with the appurtenances being the East
half of Lot number five in the Said First Concession of the
Township of Sophiasburgh to be his so soon as he attains the
age of Twenty one years Except the East lower half of my
Dwelling house which I order that my beloved wife Christian
Davenport Shall have the use of during her widowhood, after
which the Same Shall revert to my said Son Richard. I also
order that my Said wife Shall have the use and control of my
last mentioned farm with all the farming utensils until my
said Son Richard arrives of age towards their maintenance. I
also order that my Said Son Richard Shall have so much of
my Stock and other personal property as to be agreed to
what my Son William has already had. I also order that my
Said wife Shall have the use and control of my out Farm,
being the East half of Lot number Seven in the Said first
Concession of Sophiasburgh until my Son

Folio 86:
Richard arrives of age after which time the Said farm to go
into the care of my Executors and the Proceeds thereof to be
applied to the support and maintenance of my Said wife
during her natural life and after the Decease of my Said wife
I will and Devise my last mentioned farm to my three
Daughters namely Catherine Lazier, Mary Vanhorn and Sarah
Vanhorn and their Respective heirs and assigns to be Equally
Divided Between my Said three Daughters. I also give and
Devise to my sons John Davenport and Richard Davenport
and their heirs and assigns my land in the Township of
Rawdon, being Lot number Twenty Five in the ninth
concession to be equally divided Between them. I also Give
and bequeath to my beloved wife Two feather Beds and
Bedding, Two cows and four sheep, one wool wheel and one
flour wheel and Reel, one Dining Table, one Stand and Six
chairs, and one Looking Glass. I also Give and bequeath to
my Son John one feather Bed and Bedding. It is further my
will that my Son Richard Shall have the residue of my Stock
Should there be any remaining after Paying my Debts and
the Legacies herein mentioned and Should my said Son
Richard Die before he arrives of age or has lawful Issue then
it is my will that the property hereby willed and devised to
him Should be equally divided between my son William and
my three Daughters before mentioned but Should he marry
before he arrives of age and have no children, he shall be at
liberty to will his widow the personal property hereby
Bequeathed to him…and lastly I appoint my beloved wife
Christian Davenport, Executrix and my Two Sons in Law
Nicholas Lazier and John Vanhorn Executors of this my last
will and Testament--- Which will is witnessed by James Cotter
of Sophiasburgh Esquire and William Brown and Nicholas
Lazier of the same place, yeoman, and this memorial thereof
is required by William Davenport, one of the Devisees in Said
Will mentioned to be Registered pursuant to Law.
I Testimony whereof the Said William Davenport has hereto
set his hand and Seal the Twenty Seventh day of August in
the year of our Lord One Thousand Eight hundred and
Twenty Seven in the Presence of

The Execution of this memorial as will as the Will to which it
Relates was duly proved by the oath of Nicholas Lazier of
Sophiasburgh, yeoman, one of the subscribing witnesses to
the same on the Tenth day of September 1827 before me,
