Tag, You’re It! Facebook Giveaway – Rules & Regulations

No purchase necessary. A purchase or payment of any kind will not increase your chances of winning.

1. Eligibility: The Tag, You’re It! Facebook Giveaway (the “Giveaway” ) is open to all legal
residents of the fifty (50) United States who are at least eighteen (18) years of age at time of
entry. Employees of ZipZoomfly.com and their parent and affiliate companies as well as the
immediate family (spouse, parents, siblings and children) and household members of each such
employee are not eligible. Subject to all applicable federal, state and local laws and regulations.
Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to
these Official Rules and ZipZoomfly.com’s decisions, which are final and binding in all matters
related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth
herein.

2. Timing: Giveaway begins on January 4th, 2009 at 10:00AM Pacific Standard Time (“PST”) and
ends on January 5th, 2009 at 10:00AM PST (the “Eligibility Period”). ZipZoomfly.com’s computer
is the official time keeping device for the Giveaway.

3. How to Enter: During the Eligibility Period, visit ZipZoomfly.com’s Facebook Page
(http://ow.ly/QOxy), become a fan of ZipZoomfly.com on Facebook and tag yourself to any of the
Tag, You’re It! Facebook Giveaway image located in the Photos Tab. Limit one (1) tag per
person, per Facebook account and per household. Up to 60 images may be uploaded during the
Giveaway period.

4. Drawing: Three (3) potential Giveaway winners will be randomly at end of promotion period
(January 5th 2010). Potential winners will be notified by email within ten (10) days after the
completion of the drawing. Potential winners are required to sign and to return an affidavit of
eligibility, grant of rights and a publicity and liability release within 10 days of notification or prize
will be forfeited and an alternate winner selected. Potential winner must continue to comply with
all terms and conditions of those Official Rules, and winning is contingent upon fulfilling all
requirements. Only three (3) alternate drawings will be held after which the prize will remain
unawarded.

5. Prize: Three (3) OCZ3G18004GK DDR3 Memory valued at $160 each will be given away. Prizes
along with the winners will be posted on ZipZoomfly.com (http://www.zipzoomfly.com) and
ZipZoomfly.com Facebook Page (http://ow.ly/QOxy). Odds of winning depend upon the number
of entries received.

6. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or
inaccurate information, whether caused by entrants, printing errors or by any of the equipment or
programming associated with or utilized in the Giveaway; (2) technical failures of any kind,
including, but not limited to malfunctions, interruptions, or disconnections in phone lines or
network hardware or software; (3) unauthorized human intervention in any part of the entry
process or the Giveaway; (4) technical or human error which may occur in the administration of
the Giveaway or the processing of entries; or (5) any injury or damage to persons or property
which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the
Giveaway or receipt or use or misuse of any prize. If for any reason an entrant’s entry is
confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s
sole remedy is another entry in the Giveaway, provided that if it is not possible to award another
entry due to discontinuance of the Giveaway, or any part of it, for any reason.

 ZipZoomfly.com, at its discretion, may elect to hold a random drawing from among all eligible
entries received up to the date of discontinuance for any or all of the prizes offered herein. No
more than the stated number of prizes will be awarded. In event that production, technical,
seeding, programming or any other reasons cause more than stated number of prizes as set forth
in these Official Rules to be available and/or claimed ZipZoomfly.com reserves the right to award
only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible
prize claims.

7. Ownership: All photos, text, videos and any other content or information (collectively and
severally, “Materials” ) submitted by you to ZipZoomfly.com shall become the sole and exclusive
property of ZipZoomfly.com, and ZipZoomfly.com shall have no obligation to preserve, return or
otherwise make available to you or any others any Materials. ZipZoomfly.com may use,
reproduce, edit, display, transmit, prepare derivative works of, modify, publish, and otherwise
make use of Materials in any and all media, whether now known or hereinafter created
throughout the world and for any purpose without compensation to you of any kind. You also
agree to allow ZipZoomfly.com and its affiliates to use your name, city and state in connection
with the Materials in connection with publication of your entry and for promotional purposes
(except where prohibited), without review, notification or approval.

8. Release: By receipt of any prize, winner agrees to release and hold harmless ZipZoomfly.com
and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies,
and prize suppliers, and each of their respective parent companies and each such company's
officers, directors, employees and agents (collectively, the “Released Parties”) from and against
any claim or cause of action, including, but not limited to, personal injury, death, or damage to or
loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any
prize.

9. General Conditions: ZipZoomfly.com reserves the right to cancel, suspend and/or modify the
Giveaway, or any part of it, if any fraud, technical failures or any other factor beyond
ZipZoomfly.com's reasonable control impairs the integrity or proper functioning of the Giveaway,
as determined by ZipZoomfly.com in its sole discretion. ZipZoomfly.com reserves the right in its
sole discretion to disqualify any individual it finds to be tampering with the entry process or the
operation of the Giveaway or to be acting in violation of these Official Rules or any other
Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to
deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal
and civil law, and, should such an attempt be made, ZipZoomfly.com reserves the right to seek
damages from any such person to the fullest extent permitted by law. ZipZoomfly.com's failure to
enforce any term of these Official Rules shall not constitute a waiver of that provision.
