PRESSSTATEMENT

10THCABINETMEETINGHELDON27THNOVEMBER,2014
H.E.thePresidenttodaychairedthe10 thCabinetMeeting,2014atState
House, Nairobi. During this meeting, Cabinet approved the following
Policyissues.

1. AMoratoriumOnInterCountryAdoptionOfKenyanChildren
Cabinet approved An indefinite Moratorium on InterCountry
AdoptionofKenyanChildrenbyforeigners,andalsorevokedall
licences to conduct intercountry adoptions in Kenya with
immediateeffect.
ThedecisionhasbeeninformedbyKenyascurrentrankingbythe
GlobalReportonTraffickinginPersons2014,(UNODC)thatcited
Kenya as a source, transit, and destination country in human
trafficking.ThecountryisalsorankedatTier2WatchListfornon
compliance with minimum standards for elimination of human
trafficking, based on the 2014 US State Department report on
traffickinginpersons.
Inarrivingatthisdecision,Cabinetnotedthat,currentlyKenyan
laws did not define child sale, child procuring, child trade and
childlaunderingaspartofchildtrafficking.Thishasineffectput
Kenyan children at very high risk as it creates a loophole for
fraudulent,vestedinterests,masquerading throughownershipof
children homes, adoption agencies and legal firms representing
children,andadopters,toengageintheunscrupulousbusinessof
HumanTraffickingundertheguiseofcharity.

2. Reform Policy for Aligning the Roads SubSector with the


ConstitutionandtoAchievetheKenyaVision2030Objectives
Cabinetapprovedanewpolicyaimedatreformingandaligningthe
Roads Subsector with the Constitution of Kenya 2010, and
actualizing Vision 2030. The Policy will address the future
Development andManagementoftheRoadsSubsector,through
consolidation of gains from the previous Roads SubSector
reforms. It aims to further ensure a smooth functioning of the
roadssubsectorforasustainableeconomicgrowth.
Intheproposed policy, anew structureis recommended for the
sector where the Ministry will provide the regulatory framework,
coordinateoversightsupervision,andliaisewithotherAgencies.
The policy creates three autonomous statutory road authorities
namely:

Kenya NationalHighwaysAuthority(KENHA)whichwillbe
responsibleforthedevelopmentandmanagementofnational
highwaysandurbanroads.
The Kenya National Rural Roads Authority (KenRRA) with
the responsibility of development and management of
nationalruralroads.
Establishment of the Kenya Roads Fund Board through
amendmentoftheKenyaRoadsBoardAct,1999.

3. ImplementationoftheUwezoFund
CabinetwasbriefedonthestatusofimplementationoftheUwezo
fund,whereitwasinformedofthehighdemandfor thefacility,
withKshs.6Billionalreadydistributedthroughoutconstituencies
countrywide. Due to the high number of applicants, the
Governmentwascontemplatingallocatingadditionalfundsinthe

nextFinancialYeartobeabletoaccommodatethehugenumberof
interestedpeople.

4. Implementationofthe30%PublicProcurementReservations
and Preferences for Youth, Women and Persons with
DisabilitiesfortheFinancialYear2013/2014
Cabinet was briefed on the progress achieved in regard to
implementationofthe30%PublicProcurementreservedforyouth,
womenandpersonswithdisabilitieswhichstartedin2013.
So far over 50,000 enterprises owned by the target groups have
been registered, with 4,701 having been awarded government
contractsamountingtoKshs.6,488,932,179intheFinancialYear
2013/2014.
Othermilestonesachievedinclude:

Institutionalization of the Access to Government and


ProcurementOpportunities(AGPO)programmebysettingup

ofasecretariatattheNationalTreasury.
Gazettment of regulations to guide the implementation of
preferencereservation

Setting up of registration desks at the County Levels. To


date forty (40) counties have been assisted in setting up

registrationdesks.
SetuptheDisabledBusinessOwnersAssociation(DBOA)to
assist persons with disabilities to access tender

opportunities.
Launchedanonlineregistrationportaltoassistmorepeople
inthetargetgroupstoregister.

Successfullynegotiatedwithseveralbankinginstitutionsfor
Local Purchase Orders/Local Service Orders (LPO/LSO)
financingforthetargetgroups.

5. Status of Migration from Analogue to Digital Television


BroadcastinginKenya
Cabinet wasinformedthat thecountryisnow ready toundergo
digitalmigrationfollowingresolutionandagreementontheissues
thatinitiallyhinderedthisprocess.
Cabinet noted that Kenya had delayed a lot in the process of
migrationfromAnaloguetoDigitalTelevisionBroadcasting.Inthis
regard, Cabinet approved the switch to digital television
broadcastinginNairobicommencing30thDecember,2014and30th
January,2015fortherestofthecountry.
The Cabinet Secretary for Information, Communications and
Technologywasaskedtocommencethedigitalmigrationprocess
immediately.
SeparatelytheCabinetdirectedtheCabinetSecretary,Ministryof
Information, Communications and Technology to immediately
commenceaconsultativereviewofthelegislativeframeworkinthe
communicationsectorwithaviewtoenforcingprudent,equitable
andapragmaticsharingofthenationalcommunicationresource.

6. JointVentureinCurrencyPrintingBetweentheGovernment
ofKenya(GoK)andDeLaRueCurrencyandSecurityPrinting
(K)Limited.

Cabinetapprovedajointventureincurrencyprintingbetweenthe
Government of Kenya and De La Rue Currency and Security
Printing(K)Limited.Thejointventurewillbeona40:60%basis.
De La RueCurrency andSecurity Printing (K)Limited has been
operatinginKenyasince1992,incurrencyandSecurityPrinting.
ItisawhollyownedsubsidiaryoftheDeLaRueInternationalUK.
The companys investments in Kenya total over Kshs.3 billion.
Currentlythecompanyemploysover300Kenyansandcontributes
totaxrevenueandforeignexchangeearnings.

7. EstablishmentofTourismInterMinisterialCommittee
The Cabinet today approved the creation of an InterMinisterial
CommitteetorevamptheTourismSectorwhichiscurrentlyfacing
challengesduetointernationalterrorismandtraveladvisoriesin
thesourcemarkets.
ThecommitteetobechairedbyH.E.thePresidentwillworkwith
industryplayerstoputinplacemeasurestoensuretheTourism
Industryisbackontrack.Inthisregard,thecommitteewillseek
to operationalize the stimulus package announced by the
Government for the sector in mid, 2014 and other necessary
measurestoensuretheindustryflourishes.
