Brian Head is at a high elevation and can reach extremely cold temperatures during the
morning and evening, pads are recommended- especially helmets!
-DONT BRING: Alcohol/tobacco, weapons, drugs. YOU WILL BE SENT HOME IF BROUGHT

TIPS:

-Stay in groups of at least 3 people at all times.

-Dont damage rooms or equipment- you are responsible.
-If you get hurt, go immediately to ski patrol. If someone is unable to move, leave a person with
them, and send one or two to ski patrol for help. Notify a leader immediately. Dont move
anyone who has a neck injury.
-Dress in layers, and be ready for hot or very cold. Bring very good gloves and a helmet/hat.
-Remember sunscreen, lip balm, sunglasses/goggles, etc. Its difficult to ride without goggles
when it gets cold, windy or snowy.
-The person downhill from you ALWAYS has the right of way.
-Be careful and know your skill level. Start slow- especially the first day.
-Skiing/snowboarding off trail is not for beginners
- Always wear a helmet!

LIABILITY RELEASE, INDEMNITY, AND HOLD HARMLESS AGREEMENT

Please Read Carefully Before Signing
In consideration for using the rental equipment, I agree as follows:
1.

I understand that skiing, snowboarding, ski boarding, snow tubing, and other snow sports activities (collectively hereafter
Snow Sports) are HAZARDOUS, and that injuries are common and ordinary occurrences during these activities. I
EXPRESSLY AGREE TO ASSUME ALL RISKS of injury or death while participating in Snow Sports, and if applicable,
while using rented equipment, including NEGLIGENCE of others. I understand that a helmet designed for Snow Sports use
may reduce the risk of some types of injuries to the user at slow speeds, but that serious injury or death can result from both
low and high energy impacts, even when a helmet is worn. I understand and agree that many risks of Snow Sports may be
reduced by following YOUR RESPONSIBILITY CODE and by using reasonable care and common sense.

2.

To the fullest extend allowed by law, I hereby agree to FULY RELEASE, INDEMNIFY, AND HOLD HARMLESS, Brian
Head Acquisition Partners, LLC, all manufacturers and distributors of the rented equipment, as well as their owners, agents,
officers, employees, and affiliated companies (collectively hereafter the Resort) from any and all responsibility or liability
for any injuries, damages, or death resulting from participation in Snow Sports, use of the rental equipment or facilities at the
Resort including any NEGLIGENCE of the Resort or breach of contract. I agree that my indemnification includes repayment
of all attorneys fees, costs, or judgments incurred by the Resort.

3.

I understand that the Alpine ski boot binding system is designed to release the boot from the ski when certain forces on the
system reach preset values, but that the binding WILL NOT RELEASE OR RETAIN at all times when release or retention
may prevent injury, and it CANNOT prevent all injuries. Injuries due to unwanted release or retention are inherent risks of
skiing. I understand and agree that a Resort employee will verify the visual indications on my ski bindings. For Snowboards
and Ski boards, I understand that these systems binding WILL NOT ORDINARILY RELEASE in falls or accidents. I

understand that these systems DO NOT PROTECT against any type of injury, and that any injuries resulting from their use
are inherent risks of Snow Sports.
4.

I understand how the rental equipment works, and have received satisfactory instructions. I agree to check the equipment
thoroughly before each use. If at any time the rental equipment does not seem to be working properly, I will stop using it
immediately and return it to the Resorts rental shop for inspection. I understand that proper binding settings or stance
depends upon the accuracy of my statements about my weight, height, age, skier type, and stance. I have confirmed that the
ski binding visual indicator settings or stance on the rental equipment corresponds to the information I have provided. I will
not change, adjust, or modify the settings or stance. I accept the rental equipment AS IS WITH NO WARRANTIES
express or implied beyond those in manufacturers limited warranty.

5.

I agree to return the rented equipment clean and undamaged by the agreed upon time and date. I agree to pay for any repair,
cleaning, or replacement at the full retail value or rate as determined solely by the Resort, as well as for the full rental value
of any additional days.

6.

This Agreement constitutes the FINAL and ENTIRE AGREEMENT regarding this transaction, and is intended to provide a
COMPREHENSIVE RELEASE OF ALL LEGAL LIABILITY that is binding upon all parties, their heirs, and assigns, but is
not intended to assert any claims or defenses that are prohibited by law. If any part of this Agreement is held to be
unenforceable, the remainder shall be given full force and effect. This Agreement is governed by Utah law, and any lawsuit
filed against the Resort must be filed in Utah.

Parent/Legal Guardian: I represent that I am the parent, legal guardian, or authorized adult of the Child who is under 18 years old
(Minor). I verified the information concerning the Minor, and the accuracy of the visual indicators on all the equipment. I agree to
make all decisions and take all responsibility to educate, control, and protect the minor from risks involved in Snow Sports. I agree to
be financially responsible for all of the Minors medical bills (without right of subrogation), and for the rental equipment. I agree to
fully release and indemnify the Resort from all claims that I may have resulting from the Minors participation or use of the rental
equipment even if the Resort is negligent. To the fullest extend allowed by law, I individually and on behalf of the Minor read,
understood, and agree to all terms of this Agreement including my and the Minors release and indemnity of the Resort.
